5286ORDINANCE N0. 5256 AN ORDINANCE DECLARING THE OPERATION OF CERTAIN STORES WITHIN THE CITY OF LITTLE ROCK TO BE A PRIVILEGE: FIXING A LICENSE THEREFOR: PROVIDING A PENALTY FOR VIOLATION HEREOF: AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That from and after January 1, 1936, it shall be un- lawful for any person, firm or corporation, association or partnership, either foreign or domestic, to establish, open, maintain or operate through ownership, lease, general control, management, supervision or otherwise, any store or stores within the City of Little Rock, Arkansas, without having first obtained a license as hereinafter provided. Section 2. The term store as used in this ordinance shall be construed to mean and include any and all store or stores, or mercitantile establishments in which goods, wares or merchandise of any kind are sold, either at wholesale or retail. Section 3. Any person desiring a license to operate any such store within the City of Little Rock, Arkansas shall make application there- for to the City Collector on a blank to be furnished by the said City Collector which shall give the name of the owner or owners, lessee, trustee, receiver, manager or other persons desiring such license, the naive of the store, its location, and such other pertinent information as the City Collector may require. A separate application shall be filed for each store which it is proposed to operate. After inspecting such application end upon the payment of the license fee or fees as hereinafter provided the City Collector shall issue a license to such applicant. All licenses issued under the provisions of this ordinance shall expire on the 31st day of December of the year for which they axe issued. Where a license is issued prior to the first day of July of any year, the full annual rate herein provided for shall be paid, but where the license is issued on or after the first day of July in any year, one -half of the annual rate herein provided shall be paid. All licenses must be renewed within thirty (30) days after the date of the expiration of same, and all applications for renewals must be accompanied by the license fees as hereinafter provided. Section 4. The operation of stores as herein defined within the City of Little Rock is hereby declared to be a privilege and for the exercise of such privilege every person, firm, corporation, association or partnership, either foreign or domestic, establishing, opening, maintaining -2- and /or operating, through ownership, lease, general control, management, supervision or otherwise shall pay on annual license fee or fees as follows: (1) Where but a single store is being operated the annual license fee for such store shall be the sum of Seven Dollars Fifty Cents ($7.50). (2) If more than one, but not exceeding five (5) stores, are being operated, the annual license fee for each of such stores shall be the sum of Twenty —five Dollars ($25.00). (3) If more than five (5) stores, but not exceeding ten (10) stores, are being operated, the annual license fee for each of such stores shall be the sum of Fifty Dollars ($50.00). (4) If more than ten (10) stores, but not exceeding twelve (12) stores, are being operated, the annual license fee for each of such stores shall be the sum of Seventy -five Dollars ($75.00). (5) If more than twelve (12) stores are being operated the annual license fee for each of such stores shall be the sum of One Hundred Twenty -five Dollars ($125.00). Section 5. Any person, firm or corporation found guilty of violating any provision of this ordinance or operation in violation hereof shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than One Hundred Dollars ($100.00) and not more than Five Hundred Dollars 0500.00). Section 6. All ordinances and parts of ordinances in conflict herewith are hereby specifically repealed; except that it is hereby ordained that in case a privilege tax license on any business affected by the terms of this ordinance has been heretofore fixed by proper ordinance of the City Council at a higher rate than the privilege tax license herein provided for, then, in that event, such store or business shall be rewired to pay the higher privilege tax license and not the license fee herein provided for that particular business.
