AN ORDINANCE ESTABLISHING JUST AhD EQUITABLE
RATES OR CHARGES FOR THE USE OF AND THE SER-
VICE RENDERED BY THE PROPOSIM IMPROVEZAENTS
TO SEWER SYSTEM TO BE CONSTRUCTED BY THE CITY
OF LITTLE ROCK, IN THE COUNTY OF PULASKI,
STt3Tl; OF ARKANSAS; AND PROVIDING FOR THE, COL-
LECTION OF SAID RATES OR CHARGES.
- ZERFA.S, the City of Little Rock, in the County of
Pulaski, State of Arkansas (also referred to as the "City ") is
contemplating the purchase of land rights -of -way for, and the
construction of improvements to sewer system at a maximum cost
of $1,640,000.00;
WHEREAS, the City proposes to issue revenue bonds
therefor in the aggreg ^te principal amount of �J,037,000dO0,
bearing interest at the rate of 4% per annum, and maturing in
the amounts and years as follows:

TdFIEREAS, the City desires at this time to establish
rates or charges for the use of and the services rendered by said
improvements if the same be constructed; and,
111HEREAS, the City is authorized by law to establish and
maintain such rates or charges;
NOW, THFMEFORE, BE IT ORDAINED, by the said City Council
of said City of Little Rock, Arkansas, as follows:
Section 1. That there are hereb✓r established just and
equitable rates or charges for the use of and the service ren-
dered by the improvements to be made to sewer system for said
City (herein called the "Project ") which shall be paid by each
land owner wiose premises are connected with and use the Project
by or through any part of the sewage system of the City of Little
Rock, Arkansas, or whose - premises in any way use or are served
by the Project (excepting vacant, unoccupied property not ac-
tually using the Project) , in accordance with the following
schedule:

Section 2. Tnat the minimum rote or charge for each connect-
ion, either directly or indirectly as described in Section 1 here-
of, to the Project, shall be 15 cents per month.
Section 3. That it is hereby found and declared that the
rates and charges as above set forth will produce a total .revenue
sufficient in each year for the payment of the proper and reason-
able expense of operation, repair, replacements and maintenance
of the Project 9nd for the payment of the sums required to be paid
into a sinking fund for revenue bonds and the interest thereon to
be issued to construct the Project.
:section 4. That the City may change and adjust the foregoing
rates or charges from time to time, substantially pro rata as to
Ell classes of service, or the City may change the basis of rates
or charges to a basis of�w�ater con d by the occupant of all
property subject to 4emw6tj� under the provisions of this ordinance,
and in any event such rates or charges shall be established, ad-
justed and maintein ed so as to be sufficient in each year for the
payment of the proper and reasonable expenses of operation, repair,
replacements and maintenance of the Project and for the payment

of the suns required to be paid into the sinking fund for the
revenue bonds and the interest thereon issued to pay the costs
of t:ie construction of the Project and the purchase of land
rights -of -way therefor.
Section 5. Bills to consumers for the rates or charges
herein established :end maintained or as hereafter adjusted and
maintained, shall be due and payable quarterly in each year, be-
ginning after completion of said construction work, and, if not
paid when due, shall constitute a lien upon the premises served
by the Project; in case the rates or charges are changed to a
water consumption basis as herein provided for, then the City, if
it deems best, may collect same monthly instead of quarterly in
each year, and all the powers, rights and privileges conferred by
Act 132 of the regular session of the General Assembly of the
State of Arkansas for the year 1933, relative to the collection
of such rates or charges are hereby expressly reserved to the City.
Section 6, That all ordinances and resolutions or parts
thereof in conflict herewith be, and the same are hereby, repealed.
Section 7. vHERF_4,S1 the City, of Little Rock is at the
present time without an adequate sewer system; and
4VHMEAS2 the sewer system vitally affects the health and
welfare of the citizens of the City of Little Rock;
IT IS HX""1iFBY FOIRM AND DECLARED that an emergency exists
and that this ordinance is necessary for the immediate preserva-
tion of the public peace, health and safety and this ordinance
shall take effect and be in force from and after its passage and
approval in accordance wi th law.
