'JUVRE: "S, it has become a common practice in the City of
Little Rock for book- makers to have installed in some secret place a
private or non - listed telephone for the purpose of carrying on their
gambling activities by way of accepting and placing bets on horse races
both in and out of the Z;tate, and
? =EAS, while the Little Lock ',Iity Council is cognizant
of the fact that many law abiding- citizens have private or non - listed
telephones for highly legitimate reasons, which is a matter of their
own concern, at the same time law, violators take advantage of such
privilege and have such telephones installed for the sole and only pur-
pose of aiding them in their gambling enterprises and for other unlaw-
ful purposes, which condition creates a menace to the good morals and
general welfare of the City of Little -ock, and makes it difficult, if
not impossible, for the officers of the City of Little Rock to properly
enforce the law against book - making and kindred law violations, and
,'HEREAS, the Police Department of the City of Little ��ock
lacks legal authority to compel any telephone company operatinj; in the
City of Little Rock to furnish such information;
THERLFCRE, be it ordained by the Little -ock oity Council:
SECTION 1. That , +within ten days from and :after the passage
and approval of this ordinance, any person, firm, or corporation engaged
in furnishing public telephone service in the oity of Little Lock shall
file in ',writing with the Ohief of Police of the Oity of Little bock,
the name, address, and telephone number of each subscriber to any pri-
vate or non- listed telephone, or telephones, within the ,ity of Little
Rock, together with the location of such private or non - listed telephone;
and when any such telephone is hereafter installed in the "ity of Little
Rock, the telephone company installing; the same shall file in ':,writing
the name, address, and telephone number with the Chief of Police within
five days after installation. Provided, further, that when any such

telephone number is changed, or the location of such telephone is changed,
said telephone company shall notify the V'hief of Police in writing within
five days after such change, giving hire the new number and the new loca-
tion of the same.
SECTION 2. The Ghief of Police shall keep the list of tele-
rhone numbers furnished him as provided in = section Gne of this ordinance
in a private place in his office, and he shall not allow the same to be
examined or inspected by any other person or _persons, but _,hen he has
reasonable cause to believe that any such telephone is being used for
gambling or other unlawful purposes, he shall have authority to communi-
cate such information to his sub- ordinates in office .with such instruc-
tions as he deems proper for an investigation of the use :wade or such
telephone.
:,ECTIGN 3. Amy person, firm, or corporation engaged in
furnishing public telephone service in the dity of Little jock who fails
or refuses to comply with .�ecticn (,-ne of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction shall be fined in any sum
-_c less than One riundred Dollars, __cr more than Gne Thousand Dollars,
and the failure to furnish such information as recuired in Secticn One
of this ordinance on each private or non - listed telephone shall be a
violation of said section and each day such information is not furnished
in compliance with said section shall be a separate offense.
SECTION 4. It being ascertained and found by the Little
stock City Council that gamblers are having, installed and are using
rrivate or non- listed telephones for the purpose of carryin,- on their
gamblin; activities in the City of Little -rock, that such practice
constitutes a menace to the morals and general welfare of the City of
Little mock and promotes gambling and other la"vl violations in said Gity,
this ordinance is declared to be for the benefit of the public peace,
health, and safety of the City of Little hock, and an emergency is
hereby declared to exist, and this ordinance shall take effect and be
in force from and after its passage and approval.
