5338ORDINANCE NO. 5338 AN ORDINANCE AMENDING ORDINANCE NO. 533 SBY SHOWING THE DATE OF EXTENSION OF LEASE TO BIG ROCK STONE & MATERIAL COMPANY AND THE RATE OF RENTALS FOR THE EXTENDED PERIOD. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: Section 1. 'That the Lessee has exerej:sed t4e M� privilege of renewing the lease described in Ordinance No. S335-for the period of five (5) years from and after April 30, 1941, at the same monthly rental of One Hun- dred and Fifty Dollars ($150) per month, and the City, as Lessor, has accepted notice of such renewal. Section 2. That the extension of the said ' lease to Big Rock Stone & Material Company on the land at the foot of Ashley Street provided or in Ordinance No. passed by this Council on Hgelt. / be to December 1, 1953; the rate of re tal for t e re- newal period to May 1 1946 to be at the rate of One } Hundred and Fifty Dollars ($150) per month, described in said lease; and the rate of rental for the five - year extended period after April 30, 1946 to be One Hundred and Seventy -five Dollars ($175) per month, and for the remaining two years and seven months of the extended period to be at the.rate of Two Hundred Dol- lars ($200) per month; and that all of said rentals , for the full renewed and extended time be prepaid by Lessee, in materials as described in said Ordinance No. 53 3S, and that the portion of the prepaid rental amounting to $1370.56 be paid in materials in excess of those particularly described in said Ordinance, by either No. 2 stone, or sand, or both, or in mixed stone and sand, in the respective quantities desired by the City during the remainder of the calendar year 1936, at the respective prices set forth in said Ordinance No. Section 3. The size of the stone described in said Ordinance No. S 3 9 S is that known as No. 2. Section 4. The Mayor is authorized and or- dered to execute said extended lease agreement as pro- vided for in said Ordinance No.5 5.35-and this Ordinance, and the City Clerk shall attest such instrument with his signature and the seal of the City; and when so done, and signed by the Lessee, such extension and modifie:ation.bi said lease shall be binding upon the respective parties.
