5355ORDINANCE NO. 5 AN ORDINANCE AMENDING SECTION ONE (1) OF ORDINANCE NO. 280,0 PASSED APRIL 113, 1921; SECTION THREE (3) OF ORDINANCE NO. 2594 PASSED AUGUST 11, 1911; SECTION THREE (3) OF ORDINANCE^ `NO. 1157 PASSED DECEMBER 19, 1904; REPEALING SECTION TWEtvE 12) OF ORDINANCE NO. 1157, PASSED DECEMBER 19, 1904; AND FOR col PURPOSES: , "Ok' ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That Section 1 of Ordinance No. 2800 be and the same is hereby amended to read as follows: ` "Section 1. That Section x#83 ofOrdinance No. 712, passedDecember 6, 1897, being Section 1030 of -dales Digest of the City Ordinances, be., and the same is hereby amended to read as follows:- 'Each telegraph, electric light,or power company shall pay annually a sum equalto seventy- five (.75¢) cents for each pole used by them or set up, and a license tax on all conduits constructed to an amount equal to four poles to each block, whether such poles are leased, rented or awned by them.'" SECTION 2. That Section 3 of Ordinance ho. 2594 be and the same is hereby amended to read as follows; by strik- ing out all reference to telephone companies and the rates there- ,_ .,_ _. . of and insertingin place and stead thereof the following: "TELEPHONE COMPANIES: Each person, firm or corporation operating a telephone exchange or exchanges in the City (it not being the purpose thereof to tax interstate or foreign messages or any United States business) per year #250000v . SECTION 3. That Section 3 of Ordinance No. 1157 be and the same is hereby amended to read as follows: "In consideration of the rights and privi- leges herein granted and as a condition upon which the same are granted the said Southwestern Telegraph & Telephone ,Company shall, during the life of this oidi- ` tae; furnish to said Cit�­and -maintain free of- a !! to said City such wires through its oven underground cables, now or hereafter laid, as may be necessary for the present and future police, wid,fire alarm service of said City, and in addition thereto shall connect said underground and overhead police and fire alarm wires with- - out charge to the City, but no other City wires except those provided herein shall be allowed in said'co nduits." SECTION 4. That Section 12 of said Ordinanee 1157 be and the same is hereby repealed. • 2- SECTION 5. That the license fee for the operation of telephone companies herein provided for in Section 2 hereof shall be paid in the sum of $$5,000 for the year 1936 promptly upon the passage and approval of this ordinance and for each suc- ceeding year thereafter shall be paid as provided in Section 2 of Ordinance No. 2594. SECTION 6. It is the intention of this ordinance to provide and levy a license fee for the operation of telephone com- panies in the pity of Little Rock of $25,000 for each calendar year, or part thereof, that said companies are operated in the City of Little Rock beginning with the year 1936 instead and in lieu of any further license, charge, fee or imposition levied by free the City (except as now provided for/fire alarms and free police telegraph wires) other than the usual general or special ad valorem taxes now or hereafter levied. SECTION 7.
