4 THE CURRENT CONTRACT WITH JCON, INC., FOR THE 13TH
5 STREET TO GAINES STREET AND WRIGHT AVENUE (STATE
6 STREET TO GAINES STREET) DRAINAGE IMPROVEMENTS TO
7 INCREASE THE ALLOWABLE CONTRACT AMOUNT BY AN
8 ADDITIONAL TWENTY THOUSAND DOLLARS ($20,000.00); AND FOR
9 OTHER PURPOSES.

WHEREAS, the Board of Directors adopted Little Rock, Ark., Resolution No. 13,557 on September
4, 2012, which awarded a contract to JCON, Inc., under Bid No. 2012 -258, for the 13`h Street at Gaines
Street and Wright Avenue (State Street to Gaines Street) Drainage improvements , in the amount of
Ninety-One Thousand, Eight Hundred Seventy-Four and 20/100 Dollars ($91,874.20), being Eighty-Two
Thousand, Five Hundred Twenty-Two Dollars ($82,522.00), plus 10% contingencies; and,
WHEREAS, the original project consisted of replacing an under -sized failing clay storm sewer pipe
with new pipe and inlets, however, during the course of construction it was determined that additional
street restoration will be required above what was anticipated in the original design; and,
WHEREAS, it has been determined that additional funds in the amount of Twenty Thousand Dollars
($20,000.00) will be required to facilitate construction and complete this improved drainage project;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK. ARKANSAS:
Section 1. The Board of Directors hereby authorizes the City Manager to amend the current contract
with JCON, Inc., by increasing the allowable contract amount for the 13`h at Gaines and Wright Avenue
Drainage Improvements by an additional Twenty Thousand Dollars ($20,000.00), for a maximum
contract price of One Hundred Eleven Thousand, Eight Hundred Seventy-Four and 20/100 Dollars
($111,874.20).
Section 2. Funding for this contract amendment will come from 2012 3/8 -Cent Capital Improvement
Sales Tax Project funds previously allocated to the project.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
