AN ORDINANCE TO PREVENT THE BUILDING OF CERTAIN
TYPES OF MALLS AND FENCES VeITHIN THE CITY OF
LITTLE ROCK UNTIL A PERMIT FOR THE CONSTRUCTION
OR ERECTION HAS BEEN GRANTED BY THE CITY COUNCIL,
PROVIDING A PENALTY FOR THE VIOLATION HEREOF;
AND FOR OTHER PURPOSES
WHEREAS, CERTAIN PROPERTY OWNERS OF THE CITY OF
LITTLE ROCK HAVE CONSTRUCTED WALLS AND FENCES
FOR SPITE, AND :WHERE SUCH WALLS ARE NOT�NECESSARY,
THEY DAMAGE ADJOINING PROPERTY, AND SAME SHOULD BE
PROHIBITED. THEREFORE, BE IT CRDAINED BY THE CITY
COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS
SECTION 1. That from and after the passage and
approval of this ordinance, it shall be unlawful for any property
owner to erect or to permit the erection of any wall or fence
of any kind or nature where such wall or fence is more than four
feet in height until application has been made to the t3ity
Council for a permit, and such permit has been granted. Any
property owner desiring to build a wall more than four feet in
height shall file an application for a permit with the City
Clerk, and such application shall be reported to the City Council;
and it shall be the duty of the City Council to determine whether
the construction of said wall or fence is necessary and if same
is not necessary, City Council shall have the right to deny said
application.
SECTION 2. Any person, firm or corporation violating
any.provisions of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction shall be fined in any sum not
less than Ten Dollars 010.00) nor more than One Hundred Dollars
($100.00), and each day that said violation continues shall be
considered a separate offense.
SECTION 3. +HEREAS, it is necessary for the public
welfare to protect the value of the property of the citizens of
Little Rock against unnecessary damage, an emergency is hereby
declared to exist and this ordinance is found to be necessary
for the preservation of the public peace, health and safety,
and the same shall be in full force and effect from and after
its passage and approval.
