55500 ORDINANCE NO. 5550, AN ORDINANCE PROVIDING FOR AN ANNUAL PRIVILEUR TAX FOR LUMBER DEALERS; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS, AS FOLLOWS: SECTION 1. That the following schedule be and the ,s is hereby declared to be the schedule of the annual privilege license for engaging in or carrying on the kind of business as hereinafter designated and defined in the City of Little Rock, Arkansas during the year 1838 and subsequent years. Each and every person, firm, corporation, association, or company engaged in the following business within the corporate limits of the City of Little hock, Arkansas shall pay for and take out such license in such sums for the businesses set out and defined as follows: Lumber and building material dealers and manufacturers, each dealer in lumber,. - either wholesale or retail, or both, regularly engaged in the delivery of lumber and building material. to retail or wholesale customers and- possessing unloading, storage, delivery, sales and service facilities adequate to the needs of the retail trade area served and equipped with and using an approved wagon or truck, and maintaining an office accessible to and open to the public during reasonable business hours of each day, except Sunday, with a competent person on duty therein, shall pay an annual license fee in the minimum amount of Fifty Dollars ( #50.00), J . where inventory is in. excess. of Five Thousand Dollars ( #5,000.001 and up to Fifty Thousand Dollars ( #50,000..00) one -half of One �er Cent, and for all over Fifty Thousand Dollars one - fourth of One Per Cent. SECTION 2. For the purpose of this ordinance, each-4i, i' separate yard shall be classed as a dealer, even though owned by same person, firm or corporation. SECTION 3. Itinerant Lumber Dealer: Each itinerant person, firm, or corporation dealing in, selling, or delivering lumber and building materials, either wholesale or retail, or and both, and not maintaining unloading, storage, /sales facilities as hereinabove last set forth and defined for a lumber and build- ing material dealer or manufacturer, and any agent, salesman, or deliveryman for any such itinerant dealer shall pay an annual license fee of One Hundred Dollars ($100..00) . SECTION 4. That the above schedule of license shall be for the calendar year 1938 and for each calendar year there- after, except in case the license be taken out on or after the first day of July, when only one half of the license shall be charged and collected. SECTION 5. That each holder of a license issued undez this Ordinance shall keep on display said license in his place of business or delivery vehicle, that the same may be inspected by the officers and officials of the Oity of Little Hock, &rkan at all times. SECTION 6. That the license required under this Ordinance shall be taken out and paid for before any business I for which they are required is engaged. SECTION 7. That any person who engages in any of the businesses, occupations or professions, or who shall keep any establishment or other thing, or do any business act for which a license is required, without having.paid such license charge and obtained a license from the City Collector, as pro- vided by this ordinance, shall be guilty of a misdemeanor, and on conviction shall be fined not less than ten, nor more than one hundred dollars, and may be imprisoned in the city prison or put to hard labor for the city for not more than sixty days Iand each day that a business, occupation or profession is in without a license as provided for in this ordinance shall constitute a separate offense. SECTION 8. That [here any person, firm or corporat is subject to the payment of a city license tax due the City of Little Hock, Arkansas, and has failed or refused to pay the same then any officer, agent, servant, or employee of such person, firm or corporation who undertakes to carry on such business je wr+ a W". a for said person, firm or corporation, for which a license is required, shall be guilty of a misdemeanor and shall be fined not less than ten dollars nor more than one hundred dollars, and may be imprisoned in the "ity prison for not more than sixty days and each day that any offiAer, agent, servant or employee • . =undertakes to carry on such business for such person, firm, or corporation shall constitute a separate offense. SECTION 9. That all ordinances, or parts of -ordinances in conflict with the foregoing are hereby repealed. SECTION 10. WHEREAS, this ordinance is for the pro- tection of the citizens of Little Rock, an emergency is hereby declared to exist and this ordinance is found to be necessary for the preservation of the public peace, health and safety, and the same shall be in full force and effect from and after its passage and approval.
