5615.p ORDINANCE NO. 5615 AN ORDINANCE CREATING A BUDGET COIDIITTEE OF THE CITY COUNCIL FOR THE CITY OF LITTLE ROCK, PRESCRIBING ITS. DUTIES; PROVIDING FOR PENALTIES FOR FAILURE TO OBSERVE THE BUDGET AND FOR OTHER PURPOSES BE IT ORDAINED BY TH`A CITY COUNCIL OF r.-HE CITY OF LITTLE ROCK, A.RaANSAS .. QTION 1. Immediately upon - t4e..passage his Ordinance there is hereby created a permanent committee of the e! •,'City Council to be known as the Budget Committee. This Committee five !'shall be composed of irr"D members of the City Council and the Mayo of the City of Little Rock shall be an ex- officio member. The ers of the Budget Committee shall be elected by the City Counci land shall serve at the pleasure of the Council. SECTION 2. Immediately after the passage and approval of !this Ordinance the Council shall proceed to elect a Budget Committee- and.the said Committee shall proceed to effect a budget for the Cit iaf Little Rock for the remainder of the year 1938. Said, be reported to the Council for action as soon as possible. The Council -gay approve said budget in full or may approve such portion of the budget as it deems proper and instruct the Budget Committee to make further study and further recommendations on such portion or portions of the :budget as the Council does not desire to approve SECTION 3. In December of each year the budget Committee (shall prepare a budget for the operation of all City departments an shall submit same to the Council for approval not later than the, 15th day of December. Said budget shall be for the ensuing i'1saa1 year. Upon approval of said budget said budget shall be binding on all department heads, departments and employees of the'C ty of 1- 1 ILittle Rock, and said budget shall not be exceeded except by specif�ia approval of a majority of the members of the Council. SECTION 4. In June of each year beginning with the :calendar year 1939, the budget committee shall submit to the Coune a report showing how each department head, department and employee of the City has operated in relation to the budget prepared the preceeding December. The budget committee shall have the autherit t v -2_ - t this time to submit to the Council any recommendations for ither increases or decreases in the budgets of any of the departm or the rema3 Wing six months of the _year,4 and if such. reommenlsti re adopted by the Council they shall be binding on the department eads, departments and employees. SECTION 5. In order that the budget plan may become active each and every department head of the City is charged witt he enforcement of the Budget adopted by the Council. It is hereby de the duty of the City Clerk of the City of Little Rock within 5 days after final adoption of the budget(or any changes thereto) o give written notice to each department head of the budget.adoptec r his department. The City Clerk shall take a receipt for the elivery of such copy of the department budget from the department +' ead. Such receipt shall be prima facie evidence of th e receipt of such budget If after receipt of notice of the budget for the various departments o: the City (or any changes thereto) any depart ment or agency of the City exceeds the budget (for the purpose of determining whether or not the budget has been exceeded at any time the budget for th year shall be divided by 12 and the budget shall be deemed to be exceeded if the amount paid out or contracted to be paid out and /or obligated in any way shall exceed the amount allote to the department or agency for the pro -rata part of the year) the. head of the department or agency may be removed and a successor elected by the Council, if after a hearing the Council finds that such head of the department or agency exceeded the budget. SECTION 6. The Council takes cognizance of and condemns the practice of the City incurring bills at one time and presentin them at a later date. From and after the passage of this Ordinanc all bills shall become effective and shall become charges against the budget of any and all.departments and agencies of the City at the time of purchase and not at the time of presentation of the Bi s s. .P . N, -3- In order to be valid all bills must be presented to the City within 30 days after purchases are madq, and all bills must be filed in duplicate, the original being filed with the department or agency contracting for the bill and the duplicate being SECTION 7. Whereas, the finances of the City are in a precarious condition and it is necessary for the immediate adoption of a system of budgetary control to insure stability of City finances, an emergency is hereby declared to exist and this ordinance is found to be necessary for the immediate preservation- of the public peace, health and safety, the same shall be in full force and effect from and after its passage and approval.
