AN ORDINANCE GRANTING TO THE SPUR DISTRIBUTING COMPANY, ITS SUC-
CESSORS AND ASSIGNS, THE RIGHT TO LAY, CONSTRUCT,MAIN-
TAIN, OPERATE, REPAIR, RELOCATE, REPLACE AND REWYE A
PIPELINE OR PIM I$ES OTTER, UNDER AND ACROSS CERTAIN
STREETS IN THE CITY OF LITTLE ROCK, ARKANSAS, (FOR
OTHER PURPOSES.
WHEBW, in the constr Oct Aon of', the new. City Auditorium
at Markham and Broadway Streets in the city of Little Rock it has
become necessary that the Spur Distributing Company remove its
filling station located at said site to another part of the City;
and
WHEREAS, the Spur Distributing Company has purchased
Lot 6, Block 4, Deaf Dilute Addition to the City of Little Rock for
the purpose of relocating said filling station; and
WHEREAS, it will become necessary to construct a pipeline
from said lot across a street adjacent thereto Northward to the
tracks of the Missouri Pacific Railway Company for the purposeof
transmitting gasoline from tank cars to said filling station; and
WHEREAS, it is to the best interest of the city to have
said filling station of the Spur Distributing Company moved and re-
located at the earliest possible date: NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
Section 1. That the Spur Distributing Company, itssucces-
sors and assigns, be and they are hereby authorized and granted a

pair, relocate, replace and remove a pipeline or pipelines over,
under or across a certain street in the city of Little Rock, Ark-
ansas, as follows: Beginning at a point at the Southwest corner
of Lot 6, Block 4,Deaf Mute Addition to the City of Little Rock;
thence Northward over, under and across certain street running
along the western boundary line of Deaf Mute Addition to the City
of Little Rock, as described in the plat recorded in deed record
"M" No. 2, page 636, Pulaski County,Arkansas, approximately 250
feet to a point on the Missouri Pacific Railway Company right -of -way

where a spur track will be constructed in the future for the pur-
pose of serving said Spur Distributing Compai�y, its successors or

Section 2. It is declared` hereby that the progress .., ,.,
gress of
the construction of the new city auditorium is being delayed by !
the inability of the Spur Distributing Company to relocate said
filling station and it is also declared hereby that it is in the
interest of the public health, peace and safety that said filling
station be relocated and that a rig3ht -of -way and easement be granted
said Spur Distributing Company, its successors and assigns. An emer-
gency is therefore declared and this ordinance shall be in full
force and effect from and after its pasaQge.
