An Ordinance amending Ordinance #5420 of the Ordinances of
the City of Little Rock to provide for the Re- zoning and Re- classification
i;;.- ; -y_ .._ _ of bet One (1), Block Nine (9), Worthen & Brown's Addition to the City of
Little Rock, and for other purposes:
Whereas, it is ascertained that the real property herein-
after described in Section One (1) of this Ordinance is situated in
close proximity to present existing business property, and
Whereas, said real property because of the topography and
location of same is now and will in the future be suitable only for business
and industrial purposes, but by the terms of Ordinance #5420 such use is
prohibited, and
Whereas, the Little Rock Zoning Board of Adjustment and the
City Planning Commission have both recommended that said lot be re -zoned
and re- classified so as to place it in the light industrial district subject
to the condition that the residential building line parallel with
Fourteenth Street be maintained, and
Whereas,the City Engineer has approved a building which has
been erected on the rear and of said lot# and
Whereas, it appears that the terms of Section 25 as amended
and other parts of Ordinance #5420 relating to the amendment of said
Ordinance have been strictly complied with, and
Whereas, after due notice a public hearing has been held at
which time all interested parties were given an opportunity to be heard by
this Council, and
Whereas, this Council has duly deliberated and is fully aware
of all the facts; therefore, be it ordained by the City Council of the City
of Little Rock, Ark.:
Section 1. That Ordinance #5420 and the plat exhibited and
referred to therein and made a part thereof be and same are hereby amended
in the following particulars,to -wit: That the real property described as
Lot One (1), Block Nine (9)1, Worthen & Brown's Addition to the*City of
Little Rock, be and the same is hereby declared to be a "J" Light Industrial.

District subject to the following conditions:
(a) The residential building line parallel with
Fourteenth Street shall be maintained
(b) Section 15 of Ordinance'#5UO insofar as it
applies to said property is amended so as to eliminate the
requirements of side and rear yards
(c) Subparagraph (e) of the Fifth paragraph of Part II of
Section 17 of Ordinance #5420 is declared to be inapplicable
insofar as said property is concerned.
Section 2. The building heretofore erected and at present
standing on Lot One (1), Block dine (9)., Worthen & Brown's Addition to the
City of Little Rock was properly erected and is hereby found to comply
with the terms of Ordinance #5420 as amended.
Section 3. All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
Section 4. It appearing to the Council that a large sum of
money has been spent in the erection of the present building on Lot One (1),
Block Nine (9), Worthen & Brown's Addition to the City of Little Rock, and
that extensive litigation is pending relative to same and to the use of said
lot and that said litigation is expensive both to the litigants and the
general public and this being a time when economy in all things is imperative
and that if the position of this Council be made known immediately the
necessity for said litigation may be obviated and the expense to be imposed
on the general public by said litigation may be avoided, and said immediate
action being neeeasary for the public, peace safety and general welfare,
an emergency is hereby declared to exist, and this Ordinance shall be in
full force and effect from and after its passage.
