57106 - -4- ..-,.w ORDINANCE # 5710 AN ORDINANCE FIXING LICENSE FEES FOR THE OPERATION OF CERTAIN COIN MACHINES; LEVYING A PRIVILEGE TAX UPON THE OPERATORS THEREOF; AUTHORIZING THE CITY COLLECTOR TO FIX RULES AND REGULATIONS FOR THE OPERATC[ON OF SUCH MACHINES; PROVIDING PENALTY FOR THE VIOLATION HEREOF; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 1 LITTLE ROCK, ARKANSAS. SECTION 1. There is hereby levied an annual license fee upon all machines licensed by the State of Arkansas as follows to -Nit: On each coin operated penny weighing scale .:................41.00 On each penny gum vender..... ........... .................... 1.00 On each United States Stamp vender .......... ................ 1.00 Oneach cigarette vender..... ............................... 2.50 On each combination cigar and cigarette vender................. 2.50 Oneach penny peanut vender... ........... .................... 1.00 On each music vending phonograph .............................. 5.00 On all other coin operated devices for less than 5�.......... 1.00 On all other coin operated venders for less than 5..........1.00 On all other coin operated devices for 5� or over............ 2.50 On all other coin operated venders for 5� or over........... 2.50 On all coin operated machines with over three slots, for each slot over three ............................. 5.00 Said fees shall be paid to the City Oollector of the City of LittlE Rock before any such machine shall be operated in the City of Little Rock. The operation and /or display of any machine hereinabove mentioned without the payment to the City Collector of "the Lilian" fee shall be a misdemeanor, and any person, firm or corporation owning, operating and /or exhibiting such machine shall, upon conviction, be fined in any sum not less than Five Dollars ($5.00,)' nor more than Twenty -five Dollars ($25.00), and each day's opersC and /or exhibition without the proper license shall constitute a separate offense. SECTION 2. Amusement games shall include such games as Raido Rifles, Miniature Football, Golf, Baseball) Hockey, Bumpe�, :�I- -2— Tennis, Shooting Galleries, Pool Tables, Bowling and other miniature games whether or not it shows a score and not hereinafter excluded, and where the charge for playing is collected by a mechanical device, and the operation of any of said games shall not be construed to be in violation of any of the laws of this State when operated in accordance with the provisions of this Ordinance.; SECTION 3. On each amusement game, as mentioned in Section 2, of this Ordinance, there shall be imposed an annual privilege tax of V"5.00. From the passage of this Ordinance until the beginning of July 1p 1939, the City Collector may issue a license or permit and charge therefor one -half (2) the regular annual tax, and after July 1, 1939, he shall collect for each machine the full annual license fee when paid during the first Six (6) months of the year, but any license fee paid during the last Six (6) months of the year shall be upon the basis of one -half (2) of the annual tax. Upon the payment of the tax, the City Collector will issue a license tag, which shall state the period of time said amusement game may be operated. SECTION 4. The business of owning and operating machined, as outlined in Sections 2 and 3 of this Ordinance, is hereby declar d a privilege and any person, firm or corporation owning and /or operating one or more machines hereinabove licensed shall pay a privilege tax in the sum of One Hundred Dollars ($100.00) per year, payable in advance to the City Collector. Any person, firm or corporation owning and operating any machine as hereinabove referred to without the payment of the privilege tax herein provide shall be guilty of a misdemeanor and upon conviction shall be fined in any sum not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500..00). SECTION 5, The City Collector shall have the right to set up rules and regulations governing the issuing of licenses, the ollection of same, and the proper enforcement of this Ordinance. Section 6.. Any person found guilty of using slugs or any substitute for coins with the intent to defraud, tampering witl �or abusing any machine licensed by this Ordinance shall be guilty o ja misdemeanor, and upon conviction shall be fined not less than -3- �en Dollars ($10.00) nor more than Two Hundred Dollars ($200.00) nd may be imprisoned for a term not to exceed Six months (6). SECTION 7. All Ordinances or parts of Ordinances which re in conflict to the provisions of this Ordinance are hereby i epealed. Section 8. WHEREAS, the State has authorized the icensing of machines herein mentioned, and whereas said law is iately effective, it is necessary for the City, in order to btain revenue and to be able to-properly police location of such achines, to make this Ordinance effective immediately, and an mergency is, therefore, hereby declared to exist and this Ordinanc s found to be necessary for the immediate preservation of the publ c eace, health and safety, and same shall be in full force and effect om and after its passage and approval.
