5712ORDINANCE ITO. _r 2 T ROAN ORDINANCE AP PROV- ING REVISED RATE SCHEDULE NO. 1 OF THE LITTLE ROCK 11UNICIPAL WATER WORKS FIXING THE EFFECTIVE DATE OF SAID SCHEDULE, AND FOR OT ER PURPOSES." WHEREAS, The Board of Water Works Commissioners in charge of the Little Rock Municipal Water Works has presented to this Council its petition asking for approval of a revised rate schedule setting forth rates for water sold and water service supplied by the Little Rock Municipal Water Works. � Upon consideration of the petition and schedule, the Council finds that: (a) It costs the sum of 11.51 per thousand gallons to concentrate and impound water in Lake Winona, transmit the same to the filtration and treating plants in Little Rock, and the treatment and purification of the same preparatory to turning it into the city distribution system; (b) The schedule of rates now in effect and applicable to water furnished all customers of the Little Rock Municipal Water Works is what is known as a "step - rate ", with the exception that the rate applicable to water furnished to railroads and other public utilities for which water said schedule provides a flat rate of 4� per thousand f gallons; (c) The schedule arbitrarily, and without regard to the, quantity of -v ter' used, places railroads and other public utilities in a favored and exclusive class of customers and gives to them unreasonable preference and advantages by allowing them a rate of 4� per thousand gallons, irrespective of the amount of water used, while the lowest rate at which any customer not in said favored class may receive water is 5� per thousand gallons, irrespective of the quantity used; (d) That said schedule subjects the customers of the Li't�tle Rock I'unicipal Water Works not in said favored class to an unlawful and unreasonable prejudice and dis- advantage, and grants to those in said favored class an unlawful and unreasonable preference and advantage; (e) That under the present schedule, those using more than 1,333,300 Dubuc` feet of water per month pay for said excess at the rate of 3.75¢ per hundred cubic feet or 5¢ per thousand gallons; (f) That a rate of 3.75 cents per hundred cubic feet or 5� per thousand gallons, and a flat rate of 4� per thousand gallons are not compensatory, and those entitled to water at said rates are not paying the actual cost, including depreciation and return, of putting water in the city distribution system, and are paying not part of the cost for maintaining and operating the distribution system; (g) That the rate of 4� per thousand gallons is discriminatory and un- lawful in -,that it permits many customers of the Little Rock yunicipal Yfater Works to -1- Af� receive water at 4/ per t iousand gallons, while nany other customers who use more water than some of those entitled to water at the rate of 4/ are required to pay an average of 1OX to 14� per thousand gallons; (h) That the Little ;L"ock 1 unici.pal Water Works is now supplying via.ter to the ?orth Little lock 1'Tater Company, successor in interest to t -he Ar? -Mnsas 7later Company, under a contract, at a flat rate of 4� per thousand gallons; (i) That the contract rate of 4� per thousand gallons to the Yorth Little Rock Water Company is inadequate, unjust and unreasonably low, and does not yield the Little Rocs: ! "Unici al Water . orks sufficient compensation to cover the cost and expenses of supplying said -�mter, and a reasonable depreciation and return upon the property used and useful in supplying the service; (j) That by reason of said rate of 4¢ to the Piorth Little Rock Water Company it has reduced the rate to its domestic, corz;_ercial and industrial customers located in Borth Little Mock and the territory adjacent thereto; (k) That the contract rate of 4� grants an unlawful and unreasonable preference and advantage to the Borth Little Rock Dater Company , l and subjects the domestic, cozwiercial and industrial customers of the Little Rock i.:unicipal Water :Yorks to an unlawful and unreasonable prejudice and disadvar_tage; (1) That the public interest demands that the Little Rock 1- unicipal Water Works receive more for water sold ITorth Little Rock than 4/ per thousand gallons, and that said timter works furnishes no water, irrespective of the quantity, at -the rate of 3.75¢ per hundred cubic feet; (m) That the rate schedule now in effect, and the rates in effect under the contract aforesaid, are unjust and unreasonably discriminatory and do not equitably distribute among the customers of the Little Rock ' >:unicipal dater Works the cost of service, and places an undue and unjust burden upon many thousands of domestic and commercial users of water in Little Rock, and requires them to bear an unreasonable proportion of the cost of supplying water service to the Cities of Little Rock and North Little Rock; (n) That the rate schedule hereinafter set out is fair and reasonable, and its adoption would be in the public interest. NOVV, THEREF'OR'E, BE IT ORDAII ED BY TAI✓ CC' 'T" IL OF Tlm CITY OR LITTLE ROCK: SECTION 1. That the following schedule of rates be, and the same is hereby approved. -2- r _ a REVISED RATE SCHEDULE NO. 1 OF THE LITTLE ROCK ]MUNICIPAL WATER MRKS APPLICATION: This schedule is applicable to all water and water service supplied by the Little Rock Municipal Water Works from and after the effective date hereof. ]METER IZASUREIMTT. All water and water service supplied by the Little Rock ]Municipal Water Works shall be measured through meters, except that used for the prevention and extinguishment of fires, and that reasonably necessary for flushing of streets and sewers, testing of fire hydrants, and practice of city firemen. RATES. METERED SERVICE, Subject to the meter minima discounts and penalties hereinafter set out, the following rates shall apply to all measured water service, except that supplied the City of Little Rock. All water used by the City of Little Rock and not included in the water furnished under the Public Fire Service Clause hereof shall be metered and paid for at the rate of 10X per hundred bubic feet, and shall not be subject to the meter minima. ]METER MINIMA. For 2 -inch meter (5/8 -inch thread) $1.25 per month, except for residences occupied by one family having one water fixture only, the minimum charge for water service shall be 95� per month. For meters larger than 2 -inch (5/8 -inch thread) the minimum charges for water service shall be proportional to the area of the size of the meter, based on a minimum of "1.25 per month for 2 -inch meter (5/8 -inch thread). The size of the meter shall be commensurate with the use of water, and shall be determined by the Water Commission. PUBLIC FIRE SERVICE. The City of Little Rock shall pay to the Little Rock Municipal Water Works for the privilege of taking water from fire hydrants for the prevention and extinguishment of fires, and that reasonably necessary for the flushing of streets and sewers, testing fire hydrants, and the practice of city firemen, a fire hydrant rental of $35.00 per hydrant per year. -3- Per 100 Cubic Feet For the first 6,700 cubic feet per month, or less - - - - - - - 30 cents For the next 6,700, cubic feet per mont�i, or less - - - - - - - 25 cents For the next 20,000 cubic feet per month, or any part thereof - 22 cents For the next 26,000 cubic feet per month, or any part thereof - 15 cents For the next 32,000 cubic feet per month, or amy part thereof - 12 cents For the next 400000 cubic feet per month, or any part thereof - 10 cents For the excess of any quantity over 131,400 cubic feet per month, - - - 6.75 cents Note. --One cubic foot of water is equivalent to 72 gallonswaighing 622 pounds avoirdupois. BILLINGS. All bills shall be computed and rendered monthly except that those for priv afire service shall be rendered on a semi - annual basis on the first days of January and July of each year for the succeeding six months' service. All annual rates for public fire service shall be payable in twelve equal monthly installments by the City of Little Rock on or before the twentieth (20th) day of each month for service furnished in the preceding month. DISCOUNT. 'Where payment in full is made of a current bill on or before the tenth (10th) day following the original date of billing, a discount of 5 per cent (5f) shall be allowed on that part of the bill which is for the first 6,700 cubic' feet of water per month or any part thereof; provided, however, that minimum bills shall not be subject to a discount. PENALTY AND DISCONTINUANCE OF SERVICE. 'Where water bills are not paid before the twentieth (20th day following the original date of billing, a ten per cent (loo) penalty shall be added to the original bill. If the bills are not paid within thirty days from rendition, service shall be discontinued and the premises shall be disconnected from the water system. EFFECTIVE DATE OF SCHEDULE. This schedule shall become effective for all water and water service supplied on and after the day following the date of the approval hereof by the Council of the City of Little Rock. SECTION 2. That all ordinances, parts of ordinances, all rate schedules, and all agreements for rates fixing charges for water and water service supplied or to be supplied by the Little Rock Municipal Water System, be, and the same are hereby repealed, set aside and henceforth shall be for nought held. SECTION 3. It is found and declared that the Board of Commissioners of the Little Rock Municipal Water Works are now furnishing and supplying water to some of its customers at a financial loss of at least $50.00 per day; that the schedule of rates now in effect are unlawful, unreasonably discriminatory and do not equitably distribute among the customers of said water works the cost of supplying water to the citizens of Little Rock; That the immediate preservation of the public welfare, peace, health and safety demand that said revised rate schedule be immediately put into effect; THEREFORE, An emergency is declared to exist, and this ordinance shall take effect and be in force from and after its passage.
