3 AN ORDINANCE TO ESTABLISH AND LAY OFF CITY OF LITTLE
4 ROCK MUNICIPAL PROPERTY OWNERS' MULTIPURPOSE
5 IMPROVEMENT DISTRICT NO. 21 (BELLA ROSA PROJECT); AND
6 FOR OTHER PURPOSES.

8 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners'
9 Multipurpose Improvement District No. 21 (Bella Rosa Project) has been filed with the
10 Little Rock City Clerk, and
11 WHEREAS, the City Clerk has presented the petition to the Mayor, and
12 WHEREAS, the Little Rock Board of Directors has determined from an
13 abstractor's certificate of property ownership that those signing the petition constitute
14 all the owners of the real property to be located in said district, and
15 WHEREAS, the Arkansas Municipal Property Owners' Improvement District
16 law provides that if the governing body determines that all the owners of the real
17 property to be located in the district have petitioned for the improvements, it shall then
18 be its duty by ordinance to establish and lay off the district as defined in the petition
19 and to appoint the commissioners named in the petition.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
21 OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. That the real property described in Exhibit "A" attached hereto and
23 made a part hereof is hereby established and laid off as City of Little Rock Municipal
24 Property Owners' Multipurpose Improvement District No. 21 (Bella Rosa Project) for
25 the purpose of constructing and installing facilities for waterworks, recreation,
26 drainage, gas pipelines, underground trenches and excavations necessary for the

I installation of electric and telephone distribution systems, sanitary sewers, streets,
2 including curbs and gutters, sidewalks, together with facilities related to any of the
3 foregoing within said district.
4 Section 2. The following three individuals are hereby appointed as
5 commissioners of said improvement district: Clint Wilson, Andrew Adkins and Daniels
6 Bynum.
7 Section 3. The name of the improvement district shall be City of Little Rock
8 Municipal Property Owners' Multipurpose Improvement District No. 21 (Bella Rosa
9 Project).
10 Section 4. Severability. In the event any title, section, paragraph, item,
11 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
12 or unconstitutional, such declaration or adjudication shall not affect the remaining
13 portions of the ordinance which shall remain in full force and effect as if the portion so
14 declared or adjudged invalid or unconstitutional was not originally a part of the
15 ordinance.
16 Section 5. Repealer. All ordinances, resolutions, bylaws, and other matters
17 inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
18 Section 6. Emergency. The Board of Directors hereby determines that there is a
19 need for additional infrastructure within the City and hereby determines that the
20 passage of this ordinance will facilitate construction of additional infrastructure within
21 the City; therefore, an emergency is hereby declared to exist, and this ordinance being
22 necessary for the public health, safety and welfare shall be in full force and effect from
23 and after its passage and approval.
