5825+° � - December 18, 1939. To the Members of the City Council, Little Rock, Arkansas. Gentlemen: I return herewith Ordinance #5825 passed December 11th, 1939, which I have disapproved. This ordinance provides a curb set -back on West Markham Street, vhich is an important traffic artery in the City. In the past, the City has granted a sufficient number of these special privileges to property owners that we now have had an oppdrtunity to study the results. My action in disapproving this measure is based upon our experience that curb set -backs such as the one proposed, will -- a. Complicate, rather than facilitate, the flow of traffic past this spot. b. Impair efficient cleaning of the street, and c. Possibly impede the drainage flow. The property ovmers petitioning for this privilege assert no angle parking will be desired. The public is accustomed to using all other curb set -backs for angle parking and I serioushy doubt that in the future, the proprietors of this business will police the parking of customers so as to ef- fectively prohibit angle parking here. If not, special po- lice work by the City will be required. It is my belief that no further special curb set -backs should be granted until a uniform policy regarding these special prlivileges is set up so as to apply fairly and equally to all petitioners. AN ORDINANCE TO PERMIT THE R]=VAL OF THE CURB AND AND RELOCATION OF THE SIDEN A K _ IX FRONT -OF LOTS TEN (10) AND ELEVEN (11) IN BLOCS 236 OF THE ORIGINAL CITY OF LITTLE ROCK* BE IT ORDAINED BY THE CITY COUNCIL OF TBE CITY OF LITTLE ROCK, ARKitA S&S. SECTION 1. That Charles A. Ehrman and L. Julian Alexander, owners of Lots Ten ('10) and Eleven (11) in Block 236 of the Original Arkeniw-li, Ds d.. hi a hereby q t r W . remove the eurbinjj and sidewalk in front of said lots in the follow - ing manner, to -wit (a) By the removal of the curbing beginning at a oint on the North side of Markham Street four feet west of the intersection of the. East Boundary Line of Lot Eleven (11) in Block 236 to a point at the intersection of the West Boundary Line of Lot Ten (10) in said Block 236 with the North Line of Markham Street. (b) By the removal of all that portion of the sidewalk lying between the North Line of Markham Street and a line eleven (11) feet and five (5) inches North of and parallel to the North Line of Markham Street lying West of a Line Described as beginning at a point on the North Line of Markham Street four (4) feet west of the inter- section of the East Line of Lot Eleven(11) in Block 236, of the City of Little Rock, thence ih a Northwesterly direction at an angle of forty - five (45) degrees to a point eleven (11) feet - five (5) inches north of the North Line of Mark- ham Street; and lying East of a line described as beginnin at the intersection of the West Line of Lot ten T10) in Block 236 of the Original City of Little Rock, with the North Line of Markham Street, thence in a Northeasterly direction at an angle of forty -five (45) degrees to a point eleven (11) feet, five (5) inches North of the North Boundary Line of Markham Street. SECTION 2. That the said Charles A. Ehrman and Le Julian Alexander be required to pave the area described in Section 1, paragraph (b) hereof,with reinforced cement of a thickness of nt , leas than _ inches to be approved by the city engineer. SECTION 3. That the said Charles A. Ehrman and L. Julian Alexander and their successors in title to said Lots 10 and 11 in Block 256, Original City of Little Rock, be and they are hereby, required to construct and maintain a concrete sidewalk for the use and benefit of the traveling public over that portion of Lots 10 and 11 in Block 236, Original City of Little Rock described as all I E r _ a - i�6 that portion of a tract of land, the south Boundary Line of which is the North Boundary Line of Markham Street, and the North Boundary Line of which is a line twenty (20) feet and one (1) inch north of and parallel to the North Boundary Line of Markham Sheet, save :ept that portion of the property hereinbefore described in ar ph (b.),, and save and a •. a tract of land des - as follows: Beginning at a point on the West Line of Lot Ten (10), Block 236, Original City of Little Rock, 20.1 feet north of the North Line of Markham Street, thence East five (5) feet, thence in a Southwesterly direction at an angle of 45 degrees to a point on the West Boundary Line of Lot Ten (10), Block 236, Original City of Little Rock thence North to Point of Beginning. SECTION 4. That upon completion of the paving of the land described in Section 1, paragraph (b), as hereinbefore pro- vided, the City of Little Rock shall take over and maintain said paving. SECTION 5. That the rights of the traveling public and the City of Little Rock in and to the sidewalk to be constructed under the provisions under Section 1 is an easement only, and that nothing herein contained shall prevent the said Charles A. Ehrman and L. Julian .Alexander, their successors and assigns, from re- establishing the north curb of Markham Street as now located and t { relocating the sidewalk on the north side of Markham Street as 1 now located, provided that in such event the owner or owners of said property shall be required to replace the 4idewalk in good condition. SECTION 6. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7. That whereas a traffic hazard exists on West Markham Street between Chester and Ringo Streets, and whereas the passage of this ordinance is necessary for the promotion of the public peace, health, and safety, an emergency is hereby de- i clared and this ordinance shall be in force from and after its passage.
