5876f)10 r• w ORDINANCE NO. 3-S 76 MW AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF LITTLE ROCK AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Words and Phrases Defined Section 1. Definition of Words and Phrases. The following words and phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively a$cribed to them in this ordinance. Section 2. (a). Vehicle. Every device in, upon, q„r ly which any person or property is or may be transported or draWJ dton a highway, except devices moved by human power or used exclusively upon stationary rails or tracks. (b). Motor Vehicles. Every vehicle which is self- propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. (c). Authorized Emergency Vehicle. Vehicles of the fire department (fire patrol), police vehicles, and such ambulances and emergency vehicles of municipal departments or public service corporations as are designated o 4uthorized by the Chief of Police of this city. Section 3. ( a) . Railroad. A carrier of persons or property upon cars, other than street cars, operated upon stationary rails. (b). Railroad Train. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except street cars. (c). Street Car. A car other than a railroad train for transporting persons or property and operated upon rails prin- cipally within a municipality. (d). Congested ested District. Includes all streets bounded by Cumberland street on the east side; Broadway on.the west side; Markham street on the north side except on Main, which shall l�F f i ~ i Yip have Bridge Street as the north boundary; Eighth street on the south�'`'] side, except on Main, which shall have Tenth street as the south boundary. Section 4. Traffic., .Pedestrians, ridden or herded animals, vehicles, street oars and other conveyances either singly or a t#gether trkile using any street for. purposes of travel. Section 5, Right -Of The privilege of the immediate use of t ill roadway. Section 6. (a). Stoa. When required means complete cessation of movement. (b). St_ or Stopping. When prohibited means any `supping of a vehicle except when necessary to avoid conflict with other traffic or in compliance with the direction of a'police officer or traffic oontrol sign or signal* (c). Standing. Any stopping of a vehicle, wither ewftpied or not. (d)* P The standing of a veh e , who4ber 08"pied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading. Section 7. Official Time Standard. Whenever certain hours are named herein they shall mean standard time or daylight-saving, time as may be in current use in this city. PERSONS. ETC,_DEFINED p t Section 8. (a)* Pe_ rsson. Every natural person, firs►, pie ship,'assooiation, or corporation. (b). Driver. Every person who drives or is in actual physical control of a vehicle. (o). Pedestrians. Any person afoot. Section 9. Police officer, Every officer of the pQl #ce department or any officer authorized to direct or regulatm*c or to make arrests for violations of traffic regulations. STREETS, ETC. DEFINED r a r . L Section 10. (a). Street or Highway. The entire width between property lines of every way or place of whatever nature when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular traffic. (b). Private Road or Driveway. Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons. (c). Roadway. That portion of a street improved, designed, or ordinarily used for vehicular travel. (d). Sidewalk. That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. Section 119 Intersection. The area embraced within the pro- longation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which loin one another at or approximately at right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict.. Section 12. Crosswalk. (a). That portion of a roadway ordinarily included within the prolongation or connection of the lateral lines of sidewalks at intersections. (b). Any portion of a roadway distinctly indicated j for pedestrian crossing by lines or other markings on the surface. I Section 13. Safety Zone. The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone. Section 14. (a). Official Traffic Control Devices. All signs signals, markings, and devices not inconsistent with this omitance placed or erected by authority of a public body or official having juriddiction, for the purpose of regulating,warniag, or guiding traffic. ST 1 1 7 ­4- (b). Official Traffic. Signal. Any device, whether manually, electrically, or mechanically operated, by which traffic is alternately directed to stop and to proceed. Section 15. (a). Business District. The territory contiguous to and including a highway when fifty percent or more of the frontage, thereon for a distance of 300 feet or more is occupied by buildings in use for business. (b). Residence D *, riet. The territory contiguous to and including a highway not comprising a business district when the property on such highway for a distance of 300 feet or more is in the main improved with dwellings or dwellings and buildings in use for business. REWIRED OBEDIENCE TO TRAFFIC REGULATIONS rr. Section 16, Required Obedience to Traffic Ordinance. It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this ordinance. Section 17. Obedience to Police. No person shall wwlihy fail or refuse to comply with any lawful order.or direction of a police officer. Section 18. Public Employees to Obey Traffic Regulations. The provisions of this ordinance shall apply to the driver of any vehicle owned by or used in the service of the United States Government, this State, County, or City, and it shall be unlawful for any said driver to violate any of the provisions of. this ordk4ance, .except as otherwise permitted in this ordinance or by State ,tatatjeo- Section 19. Exemptions to Authorized Emergency vehicles. (a). The provisions of this ordinance regulating the operation, parking, and standing of vehicles shall apply to authorized emergency vehicles, as defined in this ordinance, except as follows: (1) Park or stand notwithstanding the provisions of this ordinance. (2) Proceed past a red or stop signal or stop s'fgn- but only after slowing down as may be necessary for safe operation; } (3) Exceed the prima facie speed limits so 4 g= as he µ does not endanger life or property; ,4 . i 1 ' 15D (4) Disregard regulations governing direction of movement or turning in specified directions so long as he does not endanger life or property. (b). The foregoing exemptions shall not, however, protect the driver of any such vehicle from the cono%rences of his reckless disregard of the safety of others. Section 20, Persons Propelling Push Carts or Riding Bicycles or Animals to Obey Traffic Regulations. Every person propelling any push cart or riding a bicycle or any animal upon a roadway and every person driving any animal -drawn vehicle, shall be subject to the provisions of this ordinance applicable to the driver of any vehicle, except those provisions of this ordinance which by their very nature can have no application. OBEDIENCE TO TRAFFIC CONTROL DEVICES Section 21. Obedience to Official Traffic Control Devices. (a). The driver of any vehicle and the motorman of any street..ce shall. k obey the instructions of any official.traffic control device applicable thereto placed in accordance with the traffic ordinances of this city, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this ordinance. (b). No provision of his ordinance for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not I i state that signs are required, such section shall'be effective without signs being erected to give notice thereof. Section 22. Obedience to No-Turn _and _Turning Markers. Whenever authorized signs are erected indicating that no right or left or "U" turn is permitted, no driver of a vehicle shall disobey the directions i of any such sign, and when authorized marks, buttons, or other indications are placed within an intersection indicating the coax to be traveled by vehicles turning thereat, no driver of a vehicle' _ M, shall disobey the directions of such indications. Section 23. Zone of quiet. Whenever authorized signs are erected indicatinm q zone of ri tP, no person operating a motor vehicle within any such zone shall sound the horn or other warning device of said vehicle except in an emergency. Section 2 -4. Play Streets] Whenever authorized signs are erected indicating any street or part thereo -f as a play street, no person shall drive a vehicle upon any such street or portion thereof except ;drivers of vehicles having business or whose residences are within such closed area, and then- any said driver shall exercise the greatest; care in driving upon any said street or portion thereof. Section 25. Traffic Control Signal Legend. Whenever traffic Is controlled by traffic control signals exhibiting the words "Go" "Caution ", or "Stop ", or exhibiting different colored lights successively one at.a time, the following colors only shall be used, and said terms and lights ahell indicate as follows: (a) . Green alone or "Go". 1. Vehicular traffic facing the signal mar proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic shall yield the right -of -way tc other vehicles and to pedestrians lawfully within the intersection at the time such signal is exhibited. 2.' Pedestriane facing the signal may proceed; across the roadway within any marked or unmarked crosswalk. (b). Yello,7 alone or "Caution ", when shown following the green or "Go" signal. 1. Vehicular traffic facing the signal shall1i stop before entering the nearest crosswalk at the intersection, but if such stop cannot be umde in safety a vehicle may be driven cautiously through the intersection. 2. Pedestrians facing.such signal are thereby �.av� sped tra.t trlere is insufficient tame to cross ` a roadway, and any pedestrian then starting to cross shall yield the right- of -wa.y 1 to all vehicles... I.. "7- 13 ( c) . Red alone or "Stop". 1. Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at an intersection or at such other point as may be indicated by a clearly visible line, and shall remain standing until green or "Go" is shown alone, provided however, drivers of vehicles shall be permitted to make a right- hand,turn. when facing the red or "Stop" light, after the driver shall have-first- brought the vehicle to a.complete stop and then proceeded forward after giving the hand signal for a right turn. In all cases where a right turn shall be made upon a red light, vehicles making such turns shall give the right -of -way to pedestrians who may be crossing on the green light. Section 26. Flashing Signals. Whenever flashing red or yellow signals are used they shall require obedience by- vehicular traffic as follows: 1. Flashing Red (Stop Signal). When a red lens is illuminated by rapid intermittent flashes driver of vehicles shall stop before entering the nearest crosswalk at an interseetic a limit line when marked, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign. . 2. Flashing Yellow_ (Caution Signal). When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution. Section 27. Display of'Unauthorized Signs, Signals, or Markings. (a). No person shall place, maintain, or display span ©r in view of any highway any unauthorized sign, signal, marks Ag or dovi which purports to be or is an imitation of or resembles an official traffic control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or inter- feres with the effectiveness of any official traffic control device or any railroad sign or signal, and no person shall place or maintain, nor shall any public authority permit upon any highway; any traffic' sign or signal bearing thereon any commercial advertising. not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information an$`.'bf a type that cannot be mistaken for official signs. (b). Every such prohibited sign, signal, or marking is hereby declared to be.a public nuisance, and the authority having jurisdiction over the highway is hereby empowered to remove the same or cause it to be removed without notice. Section 28. Interference With Official Traffic Control Devises or Railroad .Sias or Signals. No person shall without lawful authority r I attempt to or in fact alter, deface., injure, knock down or remove any official traffic control d -evice or any railroad sign or signal, r or any inscription, shield, or.insignia thereon, or any other part thereof. I (b). Penalty. Every person convicted of a violation of this section shall for the first conviction thereof be punished by a fine of not less than $10 nor more than $100 or by imprisonment for not more than 10 dgys; for a second such conviction, a fine -of not less than $25 nor more than $200 or by imprisonmeit.for not more than 30 days, or by both such fine and imprisonment; for a third or subsequent conviction, by a fine of not less than $100 nor acre.,,, 4.a than $500-or by imprisonment for not more than 6 months, or by both such fine and imprisonment. STOPPING, SANDING AND PARKING Section 29. Parking Prohibited on Narrow Streets. When signs prohibiting parking are erected on narrow streets no person shall park a vehicle in any such designated place. Section 30. No Stopping or Parking near Hazardous or Congested Places. When signs are erected upon approach to hazardous or con- gested places no person shall stop, stand, or park a vehicle in any such designated place. Section 31. Vehicles About to Start Away From Curb to Give Warning A standing vehicle at curb about to start shall give moving vehicles the right of way and the operator thereof shall give a timely and visible signal before so starting. No vehicle shall start or pull away from curb while a street car is passing abreast of such vehicle or without giving a timely visible signal to vehicles in the rear. Section 32. Parking Adjacent to Schools. When signs are erected indicating no parking upon that side of the street adjacent to any school property, no person shall parka vehicle in any such designated place. Section 33. Parking Prohibited in Certain Places. (a).. No person shall stop, stand, or park any vehicle epoa a street, other than an alley, in such a manner or under such conditions as to leave available less than 14 feet of the width of the roadway for free movement of vehicular traffic, except that a driver may stop temporarily during the actual loading or unloading of passengers or when necessary in obedience to traffic regulations or, traffic signs or signals of a police officer (b). No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than 14 feet of the width of the roadway for the free movement of vehicular traffic. (c). It shall be unlawful for any person to park any vehicle Wany alley, except comiercial cars or wagons for purpose of loading and unloading, and not longer period than is actually necessary to load or unload. (d). Drivers of delivery trucks and wagons are re- quired to load and unload in the alley if there be one. In case the alley is blocked, the driver of vehicle second in position shall be fined if alley is blocked. i Section 34. All bight Parking Prohibited. No person shall park a vehile on any street outside of the congested district for a period f of time longer than 34 minutes between the hours of 2 a.m4 aa; of any dap,'except physicians on emergency calls. Section 35, Parking Prohibited at All Times in Designated Plact When signs are erected giving notice thereof, that parking of vah4olOW is prohibited at all times upon the following streets: (a). From Bridge street north on Main street bridge equal to one -half the distance of the Main street bridge, except on most side of Main street bridge parking parallel with street for a distance of 75 feet from Bridge street: worth for ten minutes in paint -� ger none. Penalty for violation of this section applies the saw.as, '' If other viglations of parking restrictions in the congested dstri11%, (b). Under Main street bridge from Bridge street, north to C. J, Lincoln Company loading platform. (c). From Scott street to Louisiana street inclusive, on Bridge street; from Markham street to Bridge street on east side of ]forth Main, except buses; on the south side of Last Second street fro& Rock-0 root to a point 200 feet west. (d). From Kavanaugh Boulevard to I street on Beech street on the east side of the street. (e). From Confederate Boulevard to ;ohnson street on Roosevelt Road. Section 36. Parking Prohibited During Certain Hours in DesifiRated Ply. No person shall parka vehicle between the hours designated on the following streets: Markham to 5th on Scott street - 2 a.m. °to 6 a.m. 5th to 6th on Scott street 4 a.m. 5 ark. 6th to 8th on Scott street - 2 a.m. to i a.m. Bridge street to 10th on Main street 4 a.sti to a.m. Markham to 8th on Louisiana street - 4 a.m. to 5 a.m. Markham to 8th on''Center street - 2 a.m. to 6 a.m. Markham to 8th on Spring street - 2 a.m. to 6 a.m. Scott to Broadway on 8th street - 2 a.m. to 6 a.m. Scott to Broadway on 7th street - 2 a.m. to 6 a.m. i t. Parking Time Limited in Designated Places. Markham to 8th on Cumberland - Two Hours Markham to 8th on Scott - One Hour Bridge to 10th on Main street - Thirty Minutes Markham to 8th on Louisiana - One Hour Markham to 8th on Center - One hour Cumberland to Center on 8th - One Hour Cumberland to Center on 7th - One Hour Cumberland to Center on 6th - One Hour Cumberland to Main on 5th - One Hour Main to Gaines on'5th Thirty Minutes Cumberland to Center-on 4th - One Hour Cumberland to Center on 3rd - One Hour Cumberland to Center on 2nd One Hour Cumberland to Center on Markham - One Hour (b).. Each violation over the time stated in this section shall constitute a separate offense. t. Section 38, Standing For Loading (a). No person shall I atop, stand, or park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger zone during hours when the regulations are applicable to such passenger zones are effective, and then only for a period not to exceed three minutes. (b). No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pick up and loading of materials is any place marked as a loading zone during hours when the provisions i applicable to loading zones are in effect. In no case shall the stop for loading and unloading of materials exceed thirty minuted. Section 39. Bus and Taxi -Cab Stands. (a). The driver of a -bus f or taxicab shall not stand or park upon any street in any business district at any place other than at a bus stop, or taxicab stand respectively, except that this provision shall not prevent the;drlvera,., of any such vehicle from temporarily stopping in accordance with �41,, other stopping or parking regulations at.any place.for the purpe" of r { - . iii . , . • _12,. v� ,fi:, . and while actually engaged in loading or unloading passengers. (b). No person shall stop, stand, or park a vehicle other than a bus in a bus stop, or other than a taxicab in a taxioab stand when any such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading and unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter., or about to enter such zone. Section 44. Standing or Parking Close to Curb. No person shall I j stand or park a vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of traffic, and with, i i the curb -side wheels of the vehicle within 12 inches of he edge of the roadway, except as provided in the following paragrapbd: ( a) . Upon such streets which have been marked or signed for angle parking, vehicles shall be parked at an angle to I the curb indicated by suoh mark or signs. (b) . In places where and at hours when stoppixgjor, the loading or unloading of merchandise or materials is permitted, vehicles used for the transportation of merchandise or materials j may back into the curb to take on or discharge loads when the owner of such vehicle holds a permit granting him such privilege, and such permit shall be 6i6her in the possession of the driver or on the vehicle at the time such vehicle is backed against the curb to take r on or discharge a load and it shall be unlawful for any owner nor driver to violate any of the special terms or conditions o:t ahy such special permit. Section 41. Unlawful Parking. No person shall stand or park a vehicle upon any roadway for principal purpose of: (a). Displaying it for sale; i (b). Washing, greasing or repairing such vehicle ! except repairs necessitated by emergency. Section 42. Using Vehicle for Primary Purpose of Advertisi g Prohibited. No person shall operate or park on any street W vehicle for the primary purpose of advertising. I r .•"'13., Section 43., Stopping, Standing or Parking Prohibited in Specified Places. (a)* No person shall stop, stand, or park a vehicle except when necessary to avoid conflict with other traffic or in 60*pliance with the directions of a police officer or traffic�!:;.control device, in any of the following places: 1. On a sidewalk. ' 2. In front of a public or private drivmway. 3. Within an intersection. I 4, Within 15 feet of a fire hydrant 5. On a crosswalk. 6. Within 20 feet of a crosswalk at an intersect•; ion. 7. Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic control signal located at the side of a roadway. 8. Between a safety zone and the . ada or within 30 feet of points on the.aurV.` I immediately opposite the ends of a safety zone, unless the traffic authority indicates a different length by signs or markings. 9. Within 30 feet of the nearest rail of a I railroad crossing. 10. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station. within 75 feet of said entrance.' 11. Alongside or opposite any street excavation or obstruction when such stopping, standing, E or parking would obstruct trarfis. 12. On the roadway side of any vehicle strop ii ' o . parked at the edge or curb of a street. 13. Upon any bridge or other elevated struethre upon a highway or within a highway tun iel, 14. At any place where official signs prohibit stopping. . i (b). No person shall move a vehicle not owned by such person into any such prohibited area or away from a curb such distance - is unlawful. OPERATION OF VEHICLES Section 44. Vehicle Entering Through Highway or., Stop Inter- seems. (a). The driver of a vehicle shall stop re quirsa by this ordinance at the entrance to a through highway an shall { yield the right -of -way to other vehicles which have entered the E intersection from said through highway, or which are approaching so closely on said through highway as to constitute as immediate hazard, t but said driver, having so yielded, may proceed, and the driver of all other vehicles approaching the intersection on said through highway small yield the right -of -way to the vehicle so proceeding i into or across the through highway. (b) . The driver of a vehicle shall likewise setup in obedience to a stop sign as required herein at an intersects ?n where a stop sign is erected at one or more entrances heretar, not a part'of a through highway, and shall proceed cautiously, yielding to vehicles not so obliged to stop which are within the j intersection or approaching so closely as to constitute as immediate hazard, but may then proceed. (c), The following streets shall be Boulevards or j Through Streets: 1. Broadway, from Markham street to Roosevelt Roa 2. 14th street from Main street to Woodrow (west) 3. 8th street, from Main street west to Battery. 4. Battery street, from 7th street to Wright Ave. d t 5. Roosevelt Road, from Confederate Boulevard to do)mson street. 6. Cross street, from 8th street north to t f ::,:, Missouri Pacific Viaduct, thence continuing northwest on Lincoln Aveiene tfo Cantrell Road, and continuing west on q street to City Limits. 7. Third,street, from Broadway west across.t viaduct, turning north at Summit Avenue, continuing northwest onio,; Markham street at Barton street and thence west to Cedar, incll+�i 1 .i a -YS- 8. Kavanaugh Boulevard, from its intersection with Markham stree0o ,Cedar street) inclusive. Section 45. Stop-When Traffic Obstructed. No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to a000modate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians; notwithstanding any traffic control signal ;I indication to proceed. Section 46. Driving Through Procession. No driver of a vehicle or mntorman of a street oar shall drive between the vehicles oon- prising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this ordinanoe. This provision shall not apply at intersections where ttaffio is controlled by traffic control devices or police officers. Section 47. Permits for Parades and Processions. No fwWral procession or parade containing 200 or morepersons or 50 ar mcre vehicles, excepting the forces of the United.Statea Army or Navy, the military forces of this State, and the forces *of the police and fire departments, shall occupy, march, or proceed along any street except in accordance with a permit issued by the Chief of Police and such other regulations as are set forth herein which may apply. Section 48. Funeral and Other Processions. (a). A funeral procession shall be identified as such by the display upon the outside of each vehicle of a pennant of a type designated by the Traffic Division of the Polioe,Department. (b) . Each driver in a funeral or other procession, shall drive as near to the right -hand edge of the roadway as practical and follow the vehicle ahead as close as it is practical and safe. Section 49. Limitations on Turning Around. The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district and shall not upon any other street so turn a vehicle unless such movement can be lade in safety and without interfering with other traffic. to Section 50. Limitations on Backing. The driver of a vehicle shall not back the same into an intersection or over a crosswalk and shall not in any event or at any place back a vehicle unless such movement can be made in safety. Section 51. merging from Alley or Private Driveway. The driver of a vehicle emerging from an alley, driveway, or building, shall stop such vehicle immediately prior to driving onto a sideway f or into the sidewalk area extending across any alleyway, and upon entering the roadway shall yield the right -of -way to all vehicles approaching on said roadway, Section 52. Vehicles Shall Not Be Driven on the Sidewalk. The driver of a vehicle shall not drive within any sidewalk area eaeept at a permanent or temporary driveway. Section 53. Clinging to Moving Vehicles. Any person riding upon any bicycle, motorcycle, coaster, sled, roller skates,-or any toy vehicle shall not attach the same or himself to any.stredt Car or moving vehicle upon any roadway. Section 54. Riding'0a Handlebars Prohibited. The operat or a motorcycle or bicycle when upon a street shall not carry any other j person upon the handle bar, frame, or tank of any such vehicle, nor I '`shall any person so ride upon any such vehicle. Section 55. Use of Coasters, Roller Skates, and Similar Devices Restricted. No person capon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall.go upon any ! roadway except while crossing a street on a crosswalk and except upon streets set aside as play street when and as authorized by ordinances of this city. Section 56. Lights on Motor Vehicles. Every vehicle upon the r streets of this city at any time from a half hour after sunset to a half hour before sunrise and at any other time when there is not I sufficient light to render clearly discernable persons and vehie,116 ! on the highway at a distance of 500 feet ahead shall display lighted lamps and illuminating devices as hereinafter respectively requitfed for different classes of vehicles, subject to exceptions with respa 4 to p arked vehicles as hereinafter stated. p �.� X17• � � � . Section 57. Headlights on Motor Vehicles. (a). Every motor vesicle other than a motorcycle shall be equipped with two headlights with at least one on each side of the front of the motor vehicle, which head- lights shall comply with the requirements and limitations set forth in this ordinance. (b). Every motorcycle shall be-equipped with,.at, least one and.not more than two headlights which shall comply with requirements and limitations of this ordinance. Section 58. Rear Lights and Reflectors. (a). Every motor vehicle and every vehicle driven upon the streets of this city, shall be equipped with a lighted rear light, exhibiting a red light plainly visible from a distance of 500 feet to the rear. (b). Every new motor vehicle, trailer, or semi - trailed except passenger cars for private use, hereafter sold and every commercial . vehicle hereafter operated upon the streets of this eity, shall carry at the rear, either as a part of the rear lamp or separately, a gyred reflector °meeting the requirements as specified under state law. Section 54. Lights on Bicycles. Every bicycle shall be: equl .,._... • i with a light on the front exhibiting' a white light visibly a= distance of at least 500 feet to the front and with a lamp bu the -'rear exhibiting a red light visible from a distance of 500 feet to the rear; j except that a red reflector may be used in lieu of a rear light. Section 60. Persons Under the Influence of Intoxicating Liquor or iarcotia Drugs. (a). It is unlawful and punishable as provided in subditision (b) of this section for any person who is an habitual user of narcotic drugs or any person who is under the influena#,of I intoxicating liquor or narcotic drugs to drive any vehicle within this eity (b) .. Lvery person who is convicted of a violation. ®f this section shall be punished by imprisonment for not less than 10 days nor more than one year, or by fine of not less than $100 nor more than $1,000, or by both such fine and imprisonment. on a second; or, •oubsegmeat- conviction he shall be punished by imprisonment for not less thas-4 -0 days nor more than one year, and , in the discretion of the Court, a fine of not more than $1,000. The State Revenue Commissioner shall "voke the operator's or chauffeurs license of any person ooi*leted r .. under this section. ` 4� -1$+ Section 61. Reckless Driving. (a). Any person who drives any vehicle in such a manner as to indicate either a wilful or a wanton disregard for the safety of persons or property is guilty of reckless driving. (b). Every person convicted of reckless driving shall be punished upon a first conviction by imprisonment. er a period of not lose than 5 days nor more than 90 days, or by fine of .*6 j less than $25.00 nor more than $500, or by both such fine and imprisonment, and on a second or subsequent conviction shall be punished by imprisonment for not less than 10 days nor more than 6 months, or by a fine of not less than $50.00 nor more than $190009 or by both such fine and i.mprisoz"nt,.. Section 62. Speed Restrictions. (a).. No person shall drive.a vehicle on the streets of this city at a speed greater than is r reasonable and prudent under the conditions then existing. (b), Where no special hazard exists, the fell ®ihng speeds shall be lawful, but any speed in excess or sai'd`'lim is shall be prima facie evidence that the speed is not rea&oatable or prudent and is unlawful: t 1. Twenty miles per hour in any business district, 2. Twenty -Five miles per hour in any residence district. 3. Forty -Five miles per hour under other conditions. (c). The fact that the speed of a vehicle is lower than the foregoing prima facie limits shall not relieve the driver, 'from the duty to decrease speed when approaching and crossixg an ntersection when a reaching an8 going arou ,a ourvm. wht� s pP i approaching a hill crest, when traveling upon any narrow or witAi.ng roadway, or when special hazard exists with respect to pedestrians or other traffic or by reason of weather or highway condttion.010 and speed shall be decreased as may be necessary to avoid colli8ing;'h any person, vehicle, or other conveyance on or entering the lk way in compliance with legal requirements and the duty of all peradas,c use due ease. Fifteen miles an hour shall .be. the maximum speed when passing a school during school recess, or while children are g►f:A& to or leaving school during the opening or closing hours. ( d) . In every charge of violation of this section, I , the complaint, also the summons or notice to appear, shall specify the speed at which the defendant is alleged to have driven, also the prima facie speed applicable within the district or at the location. (e). The foregoing provisions of this section shall not be construed to relieve the plaintiff in any civil action from the burden of proving negligence upon the part of the defendant as the prakmate cause of an accident. Section 63. Minimum Speed Regulation. No person shall drive r a motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law. Police officers are hereby authorized to enforce this provision by directions to drivers, and in the event of apparent willful dis- obedience to this provision and refusal to "comply with direction of an officer in accordance herewith the continued slow operation by a i driver shall be a misdemeanor. Section 64. Drive.on Right Side of Roadway, Exceptions. UPOR ill roadways of sufficient width a vehicle shall be driven upon *, *e ,' " right half of the roadway,, except as follows= 1. When overtaking and passing another vehicle pro- ceeding in same direction ynder the rules governing such movement. 2. When the right half of a roadway is closed to i traffic while under construction or repair. 3. Upon a roadway divided Into three marked lanes for traffic under the rules applicable thereon; or 4. Upon a roadway designated and sign - posted for one -way traffic. I Section 65. Passing Vehicles Proceeding in opposite Directions. ! Drivers of vehicles proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more tan one line of traffic in each direction each driver shall give to the other at least one -half of the main traveled portion of the roads as nearly as possible. A. i 0 M90- J Section 66. Overtaking a vehicle on the Left. The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions, and special rules hereinafter stated: (a). The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a.safe distance and shall not again drive to the right,, i side of the roadway until safely clear of the overtaken vehicle. (b). Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give ray to the right in favor of the overtaking vehicle on audible signal, and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. Section 67. When Overtaking On the Right Is Permitted. (a). The driver of a vehicle may overtake and pass upon the right of another vehicle which is making or about to make a left turn. (b)* The driver of a vehicle may overtake ago, allowing sufficient clearance r; pass another vehicle preeeedimg in the same direction either upon the left or upon the right elm a roadway with unobstructed pavement of sufficient width for four or I more lines of moving traffic when such movement can be made in safety. No person shall drive off the pavement or upon the shoulder of the roadway in overtaking or passing on the right. Section 68. Limitations on Overtaking on the Left_ (a)* vehicle shall be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction unless such left side is clearly visible and is freo,: f of oncoming traffic for a sufficient distance ahead to permit sua t overtaking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the op "Bite direction or any vehicle overtaken. In every event the 777� vehicle must return to the right-hand side of the roadway befogs., coming within 100 feet of any vehicle approaching from the opposite i direction. (b)e No,vehiele shall in overtaking and passing another vehicle or at any other time be driven to the left side of the roadway under the following conditions: le When approaching the crest of a grade or upon a curve in the highway or street where the driver's view along Y the highway or street is obstructed. 2• When approaching within 100 feet of any bridge, viaduct, or tunnel, or when approaching within 100 feet of or traversing any intersection or railroad grade crossing; 3, Where official signs are in place directing that traffic keep to the right, or a distinctive center line is marked, which distinctive line also so directs traffic as declared in the sign (Wasual adopted by the State Highway Commission. Section 69. Driving On Roadways Laned for Traffic, Whenever any roadway has been divided into three or more clearly marked lanes for traffic, the following rules in addition to all others consi►t herewith shall apply. (a). A vehicle shall be driven as nearly as practical entirely within a single lane and shall not be ram4ve4 from such lane until the driver has first ascertained that such- movement can be made with safety, (b). Upon a roadway which is divided into three lanes a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle where the roadway ahead is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation for a left turn, or where such - I center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is sign - posted tee. give notice of such allocation. (c). Official signs may be erected directing slow moving traffic to uare a designated lane or allocating specified lama to traffic moving in the same direction, and drivers of vehicles shall obey the directions of every such sign. Section 90. Turning At Intersections, The driver of a vehicle intending to turn at an intersection shall do so as follows: Z -22- (a). Both the approach for a right turn and a right turn shall be made as closely as practical to the right -hand curb or edge of the roadway. i (b). Approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof, and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. (c). Approach for a left turn from a two -way street into a one -way street shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection. A left turn from a one -way street into a two-way street shall be made by passing to the right of the center line of the street being entered upon leaving the intersection* RIGHT OF WAY RULES Section 71, Vehicles Approaching or Entering Iat uec' as (a) . The driver of a vehicle approachi.g an er section shall yield the sight- of,way to a vehicle which has entered the intersection from a different highway. (b) . When two vehicles enter an intersection from different highways at the same time, the driver of the vehicle on ! the left shall yield the right -of -way to the vehicle on the right. l (c). The foregoing rules are modified at through highway and otherwise as hereinafter stated in this ordinance. Section 72. Vehicles Turning Left At Intersection. The driver of a vehicle within an intersection intending to turn to the loft shall yield the right -of -way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard, but said driver, having so yielded and having given a signal when and as required by this ordinance, may make such left turn, and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right -of -way to the vehicle making the left turn. *I , -83- 4 Section 73e Signals by Hand and Arm or Signal Device. The signals required herein shall be given either by means of the hand and aria or by a signal lamp or signal device of a type approved by the State Highway Commission, but when a vehicle is so constructed or loaded that a hand and arm signal would not be visible both to the front and rear of such vehicle then said signals must be given by such a lamp or device. Section 74e Method of Giving Hand OLIW Arm SigWalse All signals herein required given by hand and arm shall be given from the left side of the vehicle in the following manner and such signal I shall indicate as follows; le Left turn - Hand and arm extended horizonialltl j 2. Hight turn - Hand and arm extended upward. 3. Stop or decrease speed - Hand and arm extended downward. Section 75. Operation of Vehicles and Street Cars on Appreseh of Authorized Faergency Vehicles, (a). Upon the immediate approach } of an authorized emergency vehicle, when the driver is giving audible signal by siren, exhaust whistle, or bells, the driver of every otber vehicle shall yield the right -of -way and shall immediately drive to a position parallel to, and as closely as possible to, the right -hand 'r edge or curb of the highway, clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a police officer.. (b). Upon the approach of an authorized emergency vehicle as above stated, the motorman.of every street car shall immediately stop such ✓car clear of any intersection and ke t it in such position until the authorized emergency vehicle has except when otherwise directed by a police off icere (c). This section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highwayet (9) i C � [ t MISCELLANEOUS RULES Section 76. Ambulances To Comply With Traffic Regulations, All ambulances driven on the street of this city shall comply with all existing traffic regulations or which may hereafter be enacted in like manner as all other motor vehicles except as otherwise directed by traffic officers, and shall be subject to.the, -sate penalties for the violation of such traffic regulations. Section 77. Driving Through Filling Station. It shall be unlawful for any person, after having driven a motor vehicle into any filling station where gasoline is sold in this city, to leave the same without having first brouglt the said vehicle to a full stop ! and without sounding his horn. Section 78. Following Too Closely* (e) . The driver *fee iior vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway* (b). The driver of any motor truck or m ®tar; truck - drawing another vehicle when traveling upon a roadway ot�i.a• of a business or reside :. � nee district shall. not follow wit�i� X00 feet of another motor truck or motor truck drawing another vehicle. Tbc `_ provisions of this subdivision shall not be construed to prevent k j overtaking and passing nor shall the same apply upon any lane specially designated for use by motor trucks. Section 79. Protecting Loads. It shall be unlawful to drive any vehicle so loaded that any material extends beyond two feet of the sides or eight feet at the rear of such vehicle, unless a red I light by night and a red flag .by day is affixed to the projecting and of such material. Section 80. Barriers. It shall be unlawful to drive any vehicle i j- over any street where there is a barrier, or person, or sign warning not to cross, and it shall be unlawful to so barrieadeaa street without authority from the Chief of Police. 1 i Section 81e Bra. (a). Every motor vehicle other than a motorcycle, when operated upon a highway shall be equipped with brae= adequate to control the movement of and to stop and hold such vehicle, including two separate means of applying the brakes, each of which means shall be effective to apply the brakes to at least two wheels. If these two separate means of applying the brakes are r connected in any way, they shall be so constructed that failure of any one part of the opeeating mechanism shall not leave the motor i vehicle without brakes on -at least two wheels. (b). Every motorcycle and bicycle with motor :attachad, when operated upon a highway shall be equipped with at least one brake which may be operated by hand or foot. (c). Every new motor vehicle, trailer, or semi-trailer hereafter sold in this city and operated upon the highways shall be ! t equipped with service brakes upon all wheels of every such vehicle# except any motorcycle, and except that any semi - trailer of less than 1,500 pounds grass weight not be equipped with brakes. Section F82. Horns and warning Devices.- (a). Every motor E vehicle when operated upon a highway shall be equipped with a horn in good working order and capable of emitting sound audible under normal conditions from a distance of not lees than 200 femt, horn or other warning device shall emit an unreasonably loud or harsh sound or a whistle. The driver of a motor vehicle shall, when i reasonably necessary to insure safe operation, give audible warning with his horn but shall not otherwise use such horn when upon a highway. (b). No vehicle shall be equipped with nor shall any person use upon a vehicle any siren, whistle, or bell, except..as. otherwise permitted in this subdivision. It is permissible but ni&'�i:: required that any commercial vehicle be equipped with.a theft alarm signal device which is so arranged that it cannot be used by the driver as an ordinary warning device. Any authorized emergency vehicle may be equipped with a siren, whistle, or bell, capable ct emitting sound audible under normal conditions from a distance of not less than 500 feet and of a type approved by the department, but each siren shall not be used except when such vehicle is operated., i 2'� I in response to an.emergency call or in the immediate pursuit of an actual or suspected violator of the law, in which said latter events - the driver of such vehicle shall sound said siren when necessary to warn pedestrians and other drivers of the approach thereof. (c). No bicycle shall be equipped with nor shall any person use upon a bicycle any siren or whistle. Section 85. Mufflers* fflers. Every motor vehicle shall at all thee. j be equipped with a muffler in good working order and in coastal =F j operation to prevent excessive or unusual noise and annoying Sete, and no person shall use a muffler cut -out, bypass, or similar device upon a motor vehicle on a highway. Section 84, Mirror. Every motor vehicle shall be equipped with a rear -view mirror. Every motor vehicle which is so constructed or loaded as to obstruct the driver's view to the rear thereof from the driver's position shall be equipped with a mirror so located,, as to reflect to the driver a view of the highway for a distana*.9 -f at least 200 feet to the rear of such vehicle. '4 Section 85. Windshields Must Be Unobstructed and Equipped With "$ e.: Lip_errss ( a) . No person shall drive any motor vehic1*,,LJjftjj any sign, poster or other non - transparent material upon the front windshield, sidewings, side or rear windows of such vehicle other than a certificate or other paper required to be so displayed by law. (b). The windshield on every motor vehicle shall be equipped with a device for cleaning rain, snow, or other moisture from the windshield, which device shall be so constructed as to be controlled or operated by the driver of the vehicle. Section 86, License Tag. It shall be unlawful for any motor .vehicle to operate upon the streets or alleys of the city, ezeeY it shall display regulation license tags of the State of Arkansas for the current year, both front and rear, and if it be a Little ? Rock car, the license tag of the city for the current year. Sack numbers shall be displayed conspicuously in an upright position and in an unobstructed view on the car for which they were issued, and { 0, i to,be kept reasonably clean. ­2e- Section 89. Authority To Remove Vehicle From Street. The Chief of Police is hereby authorized to remove or cause to be removed from the streets and public places of the City of Little Rock any vehicle j parked thereon in violation of any of the ordinances of the City of 4 i Little Rock or laws of the State of Arkansas. Section 88, laproper Licanse and Towage Charges. When say motor vehicle is being driven upon-the street of Little Rock Vi�kh( license plates thereon either state of, city, which are fictitious 1 t or improper, the Police Department shall cause the same to be jtowed to some police garage or to some garage authorized by the Jy Police Department. Should any vehicle be towed to storage which has 4•; been stolen from the rightful owner and has been operated by.:scme t I { person without the .owner's consent, such owner shall pay the accrued f } towage and storage charges. Said towage charges to be $2.50 in city limits and storage charges 25¢ per twanty -four hours or fraction thereof. When the owner, operator, or person in possession of any` ; motor vehicle disregards ,a traffic summons or fails to appear in- f Court to answer a traffic summons which has been placed on said motor vehicle and where such owner cannot be located for the ppose of serving a warrant of arrest on him., said ear shall be towed "` F the Police Department and held until the fine prescribed for f►ai 4 4 particular violation is paid. Section 89, Used Car Dealer Regul_ ions. All automobile dealers I i in Little Rock are required to furnish to the Police Department a l list of all used cars sold by the dealer, setting forth certain r k information prescribed by the Police Department. Any dealer failing to comply with these provisions, upon conviction shall be fined in any sum not less than $5.00 nor more than $25900. Section 90. Failure to Transfer State License. Any person purchasing a used car and failing to have license plate registered I` in his name within three days of date of bill of sale or whom shall E i give a fictitious address when having car registered, shall be ' guilty of a misdemeanor and upon conviction thereof shall be fined ,six any sum not to exceed $25.00. P ­2e- Section 89. Authority To Remove Vehicle From Street. Garage Keepers to Report Damaged Tehicles. The person in charge of any garage or repiir shop in Little Rock to which is brought any motor vehicle which shows evidence of having been involved in a serious accident or struck by any bullet, shall report same to Police Headquarters within twenty -four hours after suo# motor vehicle is received, giving the engine number, registration amber and the name and address of the owner or operator 'of .such , veh slwol Section 92. -Avoiding Arrest. It shall be unlawful r, arms to tarn off any lights on a motor vehicle for the purpose` of avoiding arrest or identification. Section 93e unattended Motor Vehicle. No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stepping the engine, locking the ignition and removing the;.._` key, and effectively setting the brake, or when standing upon any perceptible grade without effectively setting the brake thereon and turning the front wheels to the curb or side of the highway. Section 04. Obstruction to Driver's View or Drivina Mechanism ,Four In Front Seat). (a). No person shall drive a vehicle when it is so loaded' or when there are in the front seat such number of ,persona.:.! exceeding three, as to obstruct the viers of the driver to tAe front Y. or sides of the,vehiele or as to interfere with the driver's control f over the driving gechanism of the vehicle. No passenger in a vehicle or street car shall ride in such position as to interfere with the driverts or motorman's view ahead or to the sides, or to interfere with his'oontrol over the driving mechanism of the vehicle or street car. Section 96. Crossing Fire Hose. No street car or vehicle sha be driven over any unprotected hose of a fire department when laid down on any street, private driveway, or street -car track,,to be used at any fire or ,alarm of fire, without the consent of the fi , depar4lext officialin eonmand. 4 .W29- Loa 97. Putting Glass Etc. On Highway prohibited, (a). No person shall throw or deposit upon any highway any glass.bottle, glass, nails, tacks, wire, cans or any other substance likely to injure any person, animal, or vehicle upon such highway. (b). Any person who drops, or permits to.be dropped or thrown upon any highway any. ;destructive or injurious ,ate* s all immediately remove the same or cause it to be removed, (c). Any person removing a wrecked or dmmaged' vehicle from a highway shall remove any glass or other injurious substance dropped upon the highway from such vehicle Section 98. Trucks and Tractors Not Having Rubber Tires. It shall,be unlawful for any person to move or propel any truck, tractor or other piece of machinery having spiked tires or other than smooth tires, upon the streets or alleys of the city except under thn,-: { 0': direction of the building commissioner. 1GMTS Section' 99: Accidents Iavolti�Dew or personal In. luiefs, (a), The driver of any vehicle involved in an accident resulting in injury to or death of any person shall immediately stop such vehicle at the scene of such accident or as close thereto as possible but shall then forthwith return to and in every s=ent shall remain at the scene of the accident until he has fulfilled the requirements of Section 101. Every such stop shall be made withmit obstructing traffic more than is necessary. (b). Any person failing to stop or compll "tb said requirements under such circumstances shall upon conviction be punished by imprisonment for not less than 30 days nor more than one year, or by fine of not less than $100 nor more than $5,000, or by both such fine and imprisonment. (c). The State Revenue Commissioner shall revoke the operators or, chauffeur's license of the person so "r convicted. • Section 100. -, 30- Accident Involving Damage to Vehicle. The driver of any vehicle involved in an accident resulting only in the dametge to a vehicle which is driven or attended by any person shall immed *=' iately stop such vehicle at the scene of such accident or as close thereto as possible, but shall forthwith return to and in every event j shall remain at the scene of such accident until he has fulfilled the. requirements of Section 99. Any person failing to stop; or comply with said requirements under such circumstances shall be guilty of "- a misdemeanor. The driver of any vehicle involved in an accident resulting in injury to or death of any person or damage to any vehicle which is driven or ,attended by any person shall give his name, address, and the regis tration number of the vehicle ke is driving, and shall upon request and if available exhibit his operator's or chauffeW s license to'the v person struck, or the driver or occupant of or person attending any vehicle collided with, and shall render to any person injured is� sech accident reasonable assistance,- including the carrying, or the of arrangements for the carrying, of such- person. to a physician, `; C surgeon, or hospital for medical or surgical treatment if it is apparentl that such treatment is necessary or if such carrying s requested b 8 q y f the injured person. Section 102. Duty Upon Striking Unattended Vehicle. The driver of any vehicle which collides with any vehicle which is unattended shall C � immediately stop and shall then and there either locate Md notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle striking the unattended ,VW4,a. 0r i shall leave in a conspicuous place in the vehicle struck a written notice giving the name and address of the driver and.of the owner of thei vehicle doing the striking and a statement of the circumstances thereof.f Section 103. Duty Upon Striking Fixtures Upon a H= ghrray. The driver of any vehicle involved in an accident resulting only in damage to fixtures legally upon or adjacent to a highway shall take reasonable., 30 i steps _to locate and notify the owner or person in charge of such property of such -faot and of his name and address, and of the registration number of the vehicle he is driving, and shall upon request and if available exhibit his operator's or chauffeur's , license and shall make report of such accident when and as required In Section 104 hereof. j Section 10.4. Dom' To Re_ port Accident. (a) . The driver of n ,fv, f ,vehicle iavolved.in an accident resulting in injury to or death. I of any person or total property damage to an apparent extent of $50 or more shall within twenty -four hours after such accident, forward a written report of such accident to the police department of this city, which report may be a copy of the accident report required,to be filed with the State Department of Motor Vehicles i under the laws of this State. (b) . The Police Department of this city may require any driver of a vehicle involved in an accident of wsi , i report must be made as provided in this section to films supplemental �. reports whenever the original report is insufficient in the opinion-, { of said department, and may require witnesses of accidents to reE reports to said departmsnt. Section 105. When Driver Unable To Retort. Whanever the f C driver of a vehicle is physically incapable of making a required accident report and there was another occupa%f in the vehicle at the j time of the accident capable of making a report, such occupant shall ! make or cause to be made said report. Section 106, Accident Reports Confidential. All required accident reports and supplemental reports shall be without prejudep to the individual so reporting and shall be for the *confidential' ": use of the police department, except that the police department may disclose the identity of a person involved in an accident when such idenity is not otherwise known or when such person denies his j j I presence at such accident. No such report shall be used as evidence in any trial, civil or criminal, arising out of an accident$ except that the police department shall furnish upon demand of any per*" who has or claims to have made, such a report, or upon demand ofliky i ' r raMa court, a certificate showing that a specified accident report has or has not been made to the police department, solely to prove a compliance or a failure to comply with the requirement that such a report be made to the police department. Section 109, Pedestrians-Subject To Traffic Pedestrians shall be subject to traffic control signals at into seotions-as heretofore declared in this ordinance, bat alk"A >. Ot places pedestrians shall be accorded the privileges and shall be subject to the restrictions as hereinafter stated. Section 108. Pedestrians' Right -0f -Way At Crosswalks. (a). Where traffic control signals are not in place or in operation, the driver of a vehicle shall yield the right -of -way slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within any marked crowsiralk or within any unmarked crosswalk at an intersection, except as otherwise provided in this i i article. (b). (c). Between adjacent intersections at which traffic control signals are in operation, pedestrians shall not cross at any place except a marked crosswalk. (d). No person.shall board of alight from an street car or vehicle while such street car or vehicle is in motion,,- �r 4" Section 113• Unlawful Riding. No person shall ride on any street car or vehicle upon,any portion thereof not designed or- intended for the use of passengers. This provision shall.not apply to an employee engaged in the necessary discharge' of a duty., or to, persons riding within track-bodies in space intended for merchandise, Section 114. 1411road Trains. and Street Cars,: Mot Z'o AIM- street S. It shall . he unlawful `for. the. directing officer-, " operator of any railroad train or street car to direct th® Leh pf or to operate the same in such a manner as to prevent the W of i any street for purposes of travel for a period of time longer than five minutes, except that this provision shall not apply to trains or cars in motion other than those engaged in switching. It shall be unlawful for any railroad train or street car to stop within ,' intersection or on a crosswalk for the purpose of receiving, or. H+ . z discharging passengers. Section.115. Passing Street Car on Left. (-a). The driver of a vehicle shall not overtake and pass upon the left or drive upon the left side of any street car proceeding in the same direction, whether such street car is actually in motion or temporarily at rest, except: 1. When so directed by a police officer =. 2. When upon a one -way street; or 39 When upon a street where the tracks are"" i f j located as to prevent compliance with this section. (b). The driver of any vehicle, when permitted to overtake and pass upon the left of a street car which has stopped for the purpose of receiving or discharging any passengers, shall reduce speed and may proceed only upon exercising due caution for � pedestrians, and shall accord pedestrians the right-of-way when I required by other sections of this ordinance. , `j Section 116, Passing Street Car On Right. We It is a misdemeanor for any person to violate any of the provisions ofhis ordinance unless such violation is by this ordinance or other law of this state declared' to be a felony.;* (b). Unless another, penalty is in tl#W� it ordinance or by the laws of this State provided;`every peP .oan+ victed of a misdemeanor for the violation of any provision of thin f ordinance shall be punished by a fine of not more than $500 or`br imprisonment for not more than six months, or by.both such fine and imprisonment. Section.120. Failure to Obey Notice or Summons. (a). Any person who violates his written promise to appear given to au officer upon an arrest for any.,.,,, traffic violation is guilty of a misdemeanor regardless of the, r, t disposition of the charge on which he was originally arrested. I (b) . Any driver of a motor vehicle Athat 4 wilfully neglects to answer to the charges set .f jis► a affixed to such motor vehicle by a police officer as provided �1qW ,. any ordinance of this city is guilty of the charge for which they notice was orginally issued. Section 121. Owner Responsible for Illegal Parking. No person shall allow, permit, or suffer any vehicle registered in his name to ..-stand or park in any street in this city in violation of any of the ordinances of this city regulating the -standing or parking of vehicles. Section 122. Effect of Ordinance. If any part or part*, } this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Section 123, Repeal. All ordinances or parts of,,, aril! ss in conflict with or inconsistent with the provisions,of this ordinance are hereby repealed, except that this repeal shall wlt. OWN ti affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 124. publication Of Ordinance. The City Clerk shall certify to the passage of this ordinance and cause same to be published in a local newspaper. Section 125, Short Title. This ordinance may be known and cited as the Traffic Ordinance. Section 126. Effective Date. That this ordinance is hereby declared to be an emergency measure, the necessity therefore being the immediate preservation of the health, safety, and welfare of the citizens of the City of Little Rock, and shall take effect and be in full force from and after its passage and approval by the Mayor.
