OF SAVE AND LIMITING THEIR USE OF THE STREETS OF THE CITY OF LITTLE ROCK; FIXING PEN.ALTIES FOR VIOt.A- TIONS THEREOF; AND FOR OTC PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, 'aKANNSAS: Section 1. Ordinance No. 2173 as amended is hereby repealed. Section 2. DEFINITIONS. Unless it appears from the context that a different meaning is intended the following words shall have the meaning given i to them by this section: The word "street" shall mean and include any street, alley, avenue, or public place in the City of Little Hock. The word "automobiles for hire" shall mean and include any automobile, or motor - driven vehicle used in public service. The word "jitney bus" shall mean any automobile or other motor - driven vehicle that carries passengers for a fare, from Little mock to Camp Joseph T. Robinson. The word "person" shall mean and include persons, firms and corporations. The word "city automobile inspector" shall mean any person appointed by the mayor of the City of Little Rock whose duty shall be to inspect all automobiles and jitney buses for hire as to their fitness for public service, and who shall examine all chauffeurs or drivers as hereinafter provided. Section 3. LICENSE. There shall be paid to the City Collector of the City of Little Rock by each person securing a license under this ordinance, for each automobile or jitney bus to be operated under such license the following license fees: For each car having a seating capacity for five to seven persons including the chauffeur $3.00 per month For each car carrying eight to twelve passengers including the chauffeur . . . . . . . . . . . . . . . $6.00 per month For each car carrying more than twelve passengers $8.00 per month All such licenses shall be non - transferable. All automobiles or jitney buses licensed under this ordinance shall use only the Broadway bridge when travelling to or through North Little Rock;'Anyt dpi,r6tafsof. -a tomobiles or jitney buses Violating this or any other,;section of this ordinance shall be subject to revocation of permit. v , -2- All licenses shall be paid semi - annually in advance and any failure to make such payments in advance shall render such license void. No license shall be issued for less than six months. Section 4. CHAUFFEUR'S LICENSE. Before any person shall operate or drive any automobile or jitney bus for hire he shall first procure a chauffeur's license as hereinafter provided. An application for license to operate or drive an automobile or jitney bus for hire, on the streets of Little Rock, shall be made in writing and sworn to upon blanks furnished by the City Collector, to the i,Iayor of the City of Little Rock, vTho shall appoint some competent person..to examine the applicant as hereinafter Provided; said application for chauffeurs license shall be accompanied by a fee of $5.00 and shall be signed by three reputable citizens. Upon receipt of said fee the City Collector shall provide the applicant with suitable chauffeur's license-badge, which shall be worn conspicuously displayed by the chauffeur at all times while on duty; such license shall be non - transferable. v;here an applicant is rejected the fee accompanying the application shall be returned to the applicant. Section 5. INS ECTION. All automobiles and jitney buses for hire shall be inspected by the City Automobile Inspector at the city garage once every thirty days or oftener if necessary, and no license shall be issued for same until certificate of inspection has been issued, and upon the payment of $1.00 as inspection fee to the City Collector, accompanied by a certificate of inspection, a license shall be issued. Inspector of any automobiles and jitney buses for hire shall give special attention to the clean eppearance and comfortable condition of vehicle, and the safe condition of wheels, tires, axles, motor, lights, service and emergency brakes, springs, steering gear, clutch and horn. Sect ion 6. 'EXAVj _IJA?Z ON OF CHAUFFEURS. The examination of chauffeurs shall consist of one or more references as to experience, which shall not be less than months in operating automobiles; ability to operate a motor vehicle; character; age, which shall be not less than eighteen (18) years; knowledge of traffic laws and streets of the City of Little Rock. Section 7. The City Collector shall furnish suitable license tags to accompany= every license for jitney buses, which shall be displayed in a conspicuous place upon said vehicle. , v -3- Section 8. :finite and colored passengers shall not be carried at the same time in any automobile or jitney bus for hire in the City of Little Rock; provided that this provision shall not apply to colored nurses or other servants when accompanied by their employer. Section 9. TO PR ENTI CONGESTION OF TR,�FFTC `.D :_UaJOYA1%1C OF PUBLIC. That from and after the passage of this ordinance it shall be unlawful for any person owning, operating or controlling any automobile or jitney bus for hire to solicit or drum for business for said vehicle upon the streets of Little nock, except by the person actually engaged in operating or driving such automobile or jitney bus for hire and then onl- when operator or driver is actually within such vehicle. Section 10. SAFET7' AND COT.JFORT. No person owning, operating or controlling any Jitney bus for hire upon the streets of Little :-,ock shall be permitted to carry a greater number of passengers in any such jitney bus than that alloyed by the manufacturers' declared seating capacity of such. vehicle, nor to permit any person to ride sitting upon the vehicle doors or standing upon the running boards of same. That all such vehicles shall be kept, clean, in good order and repair at all times while offering for business, and give the public first -class bus service. Section 11. DESIGNATION OF STOPPING PLACES. No jitney* bus shall stop, when taking on or discharging passengers, except in places that are designated by the Police Committee of the City Council. Seotiot 12. RACING FORBIDDEN. It shall be unlawful for any parson operating any jitney bus or automobile for hire on the streets of the City of Little nock to race v?ith any vehicle of any kind or drive said jitney bus or automobile at a greater rate of speed than is prescribed by the traffic ordinances of the City of Little Rock in order to pass another cal° or vehicle on the streets to be the first to any prospective passenger or to anyone waiting for a jitney bus, automobile, or street car. _All such racing of cars is expressly prohibited and the operator of such car upon conviction shall be subject to the penalties herein prescribed for violations of this ordinance. Section 13. MONTTMY DEPOSITS TO SECURE LOSSES TO TILE PUBLIC. Before operating any automobile under the provisions of this ordinance the sum of $25.00 for each automobilS Wlbe operated shall be deposited in the bank in the City of • i -4- Y � Little Kock agreed upon between those persons licensed under this ordinance and the City Collector, and a like amount of $25.00 for each automobile operated shall be deposited therein each month thereafter. Said moneys will be.so deposited th--Lt copies of deposit slips shall be placed in the hands of the City Collector each month, and no moneys shall be iithdraun without having the signa- ture of the City Collector along with the persons licensed under this ordinance. Said deposits are placed in escrow to provide a fund to be used as far as possible in the payment of all lawful claims for damages tc'persons or property iniured in the operation of any of the vehicles governed by this ordinance. Section 14. Any person violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction in the ',iunicinal Court of the City of Little Mock shall be fined in any sum not less than .'25.00 nor more than $100.00. Section 15. All ordinances and parts of ordinances in conflict here- with are hereby repealed. Section 16. This ordinance shall take effect and be in force from and after its passage.
