AN ORDINANCE ANNEXING CERTAIN
TERRITORY TO STREET IMPROVEMENT
DISTRICT NO. 534 TO THE CITY OF
LITTLE ROCK, ARKANSAS.
WHEREAS, parties claiming to be the owners of a majority
in value of real property in the territory hereinafter described
which is contiguous to Street Improvement District No. 534 of the
City of Little Rock, a duly organized and existing improvement
- district, have filed a petition desiring that said territory be
annexed to said improvement district; and
WHEREAS, the City Clerk has published notice for-two weeks
in the Arkansas Democrat, a newspaper issued and having a general
circulation in Pulaski County, calling upon the property owners to
appear before this council at 8 :00 P.M., November 4, 1940, and
show cause for or against such annexation which action of the
City Clerk is hereby approved and ratified and
WHEREAS, this is the time and place set for the hearing on
said annexation petition and no one has appeared to protest against
said annexation, and there has been exhibited to the City Council
the certificate of the Little Rock,Abstract Company showing that
said petition is signed by more than a majority in value of the
owners of real property within the territory to be annexed; and
'NHEREAS, the City Council has heard all persons who desire
to be heard on said petition and has ascertained that said petition
is signed by more than a majority in value of the owners of real
property within. said territory;
NON, THEREFORE, be it ordained by the City Council of the
City of Little Rock, Arkansas:
Section 1. That Lots 1 to 6, inclusive, of Block 12,
and Lots 4 to 9, inclusive, of Blocks 4 and 5 of W. B. Worthen
Addition; Lots 1,2,3,10,11, and 12 of Blocks 1,2, and 3 of May
Addition to the City of Little Rock, Arkansas which property is

contiguous to Street Improvement District No. 534 of the City
of Little Rock, be annexed to said improvement district for the
purpose of grading, draining, curbing, guttering and paving
the following parts of the following street in the City of
Little Rock, Arkansas; to -grit
Elm Street from the north property line of West 15th
Street to the south property line of ?Hest 12th Street,
except that part thereof to be paved by said Street
Improvement District No. 534.
with such materials and in such manner as the Commissioners of
said Street Improvement District No. 534 shall deem to be for
the best interests of the said territory hereby annexed to said
district, and that the cost thereof, in excess of any aid received
from any federal or other governmental agency, be assessed and
charged upon the real property above described, provided the
liability of each lot or tract of land shall be limited to its
assessed benefits.
Section 2. Said annexation shall be known as Annex
No. 3 to Street Improvement District No. 534, and the Commissioners
of Street Improvement District No. 534 shall proceed to form plans
for said annexation, ascertain the estimated cost thereof and
make the assessment for said improvement on the territory hereby
annexed on the same basis as if said territory were included
in the original district.
Section 3. This ordinance shall take effect and be
in force from and after its passage.
