6173A '&­ "S ORDINANCE N0. 6173 AN ORDINANCE AUTHORIZING THE SALE OF ABANDONED PROPERTY IN THE POSSESSION OF THE POLICE DEPARTMENT, PRESCRIBING THE PROCEDURE TO BE FOLLOWED IN THE SALE OF SUCH PROPERTY, PROVIDING FOR THE DISPOSITION OF THE PROCEEDS REALIZED FROM SUCH SALES AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS, i Section 1. Definitions The term, "Abandoned Property, shall refer to and include the following: All personal. i property, except automobiles, found on the streets of the City of Little Rook and in the possession of the Little Rook Police Department, which has not been claimed by any person claiming to be the owner, within a period of six months after the personal property is placed in the posses- lion of the Police Department, all chattels and other personal property, eatoept automobiles, rightfully coming into the possession of the Little Rook Police Department, the posses- sion of which has not been retaken by any person claiming to be the owner thereof within a period of one year following the acquisition of possession by the Little Rock Police Department., Section 2. Whenever, in the opinion of the Police Committee and the Chief of Police, it is desirable to make a disposition of the abandoned property in the possession i of the Police Department, the Chief of Police is hereby authorized to advertise the same for public sale at auction. The advertisement shall be published once weekly in a news- paper having a general circulation in the City of Little Rook I : for a period bf three consecutive weeks, the last notice to be published not less than five days prior to the date of sale. i The sale shall be held in some suitable place open to the public. If, for any reason, in the opinion of the Chief of Police, it is desirable to postpone the sale, notice shall be given to those who have assembled for the sale, and it shall not be necessary to readvertise the sale. The sale shall be conducted by the Police Department, which is author- ized to receive bids for individual items, groups of items, �' a Y y• or for the entire list of abandoned property being offered for sale. The official conducting the sale is further authorised to reject all bids if, in his opinion, it is desirable to do so. Section 3. A description of all articles offered for sale shall be kept in a book maintained by the Police Depart- ment, which book shall retleot when and where each article was offered for sale, and the price received therefor. Section 49 The proceeds received from any such sale of abandoned property shall be turned in to the City Treasurer to be held by him in a separate account for a period of six months. During this six months' period, any person claiming to be the owner of any abandoned property sold as set out above may make claim for the proceeds of said sale. If said person successfully establishes ownership of any of such articles, he shall be paid the amount realized from the sale " of his abandoned chattel. Any sums remaining in the hands of the City Treasurer, and not claimed within the six months, period, shall be paid in to the general revenue fund of the City of Little Rock. Section 5.
