ORDINANCE No. 6189
AN ORDINANCE AUTHORIZING THE USE OF AN APPROVED TYPE OF SEPTIC TANK
FOR THE DISPOSAL OF SEWERAGE FROM PROPERTIES NOT SERVED BY AN ACCESS-
IBLE SEWER.
Whereas, the City of Little Rock, in the County of Pulaski,
State of Arkansas (also referred to as the "City "), did on June 28,
1909, adopt Resolution 467, which provided that thereafter no permits
shall be issued for private septic tanks by any city official, and that
j all septic tanks in existence on the date of said Resolution 467 be
oonmected with a sewer district as soon as sewers are built in their
vicinity, and
i Whereas, there near exists within the city limits of the City_
certain properties which are not now accessible'to the Municipal Sani-
tary Sewerage System, which properties are otherwise desirable as sites
for the erection of homes, and
Whereas, the City desires at this time to authorize the use
of an approved type of septic tank for the disposal of sewerage from
such property not so accessible to the Municipal Sewerage System=
NOW THEREFORE BE IT ORDAINED by the City Council of said
City of Little Rock, Arkansas, e�
SECTION 1. Resolution 467, insofar as its provisions con-
flirt with the provisions of this ordinance, is hereby repealed.
SECTION 11. The City Health Officer, the City Engineer, and
the Sanitation Committee of the City Council of the City of Little Rock,
Arkansas, are hereby authorised to grant a permit to axy owner of pro-
portion now situated within the city limits of said city, where said
property is not accessible to the Municipal Sewerage System of said Cityv
to install an approved type of septic tank for the sewerage disposal
from such property.
SECTION 111. Before permission authorized in Section 11 of
this Ordinance may be granted it must appear to the satisfaction of the
officials enumerated therein that the property is not now accessible
to the Municipal Sewerage System of the City of Little Rook and that
no municipal sewerage facilities will become accessible or available to
such .property within a reasonable _ length of time im the future,
SECTION IV.
The permit herein authorized shall only be granted
under the express condition that, when municipal sewerage services do
become available for and aocessible to the properties herein contemplated,
such properties shall be connect6d to the Municipal Sewerage System of
the City of Little Rock.
SECTION V. If any section or provision of this Act shall be
held to be unconstitutional, such holding shall not render the remaining
sections or provisions of this Act unconstitutional, or affect the validity
thereof.
