AND RIGHT OF NAY OVER BOYLE PARK FOR THE PURPOSE OF
LAYING, MAINTAINING AND R MOVING GAS DISTRIBUTION
MAIN A 23 APPURTENANCES INCIDENT THERETO.
`NHER +'A.S, the City of Little Rock is the owner of a tract of land
situated in Pulaski County, Arkansas, known as "Boyle Park ", heretofore con-
veyed to the City of Little Mock by John F. Boyle and wife, and
SHERRE'A,S, the United States Government is preparing to construct
war emergency plants in the vicinity of the City of Little Rock and is
planning to enlarge Camp Robinson, and the Arkansas Louisiana Gas Company
proposes to install additional and increased capacity gas mains for the pur-
pose of providing a sufficient supply of gas to meet the requirements of the
Government in connection with the said plants and development, and
WHEREAS, the construction of an extension main from the present
main now located on Highway #70 to Highway #10 will contribute toward the
development of property adjacent to the City and increase the population of
Additions within and without the western boundary lines of the City, and the
Arkansas Louisiana Gas Company has asked the City for an easement and right
of way over said "Boyle Park" for the laying of such an extension main,
NC'iV, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 11'_H CITY OF
LITTLE ROCK:
SECTION 1. That there is hereby granted to the Arkansas Louisiana
Gas Company, its successors and assigns, an easement and right of way from
the north to south boundary line and adjacent to the west boundary line of
the lands situated in Pulaski County, Arkansas, and heretofore conveyed to
the City of Little Rock by John F. Boyle and wife, Snow Yowell Boyle, and
known as "Boyle Park ", said easement and right of way being granted to the
Arkansas Louisiana Gas Company for the sole and restricted purpose of in-
stalling, maintaining, repairing, operating and replacing an underground gas
distribution main pipe and appurtenances incident thereto.
SECTIOI'y 2. Said easement and right of way shall be for a period of
fifty (50) years and so long thereafter as it is used for the purpose of dis-
tributing natural or artificial gas.
SECTION 3. The gas pipe main installed across "Boyle Park" under
the provisions of this Ordinance shall be laid and maintained at a minimum
depth of not less than two (2) feet below the surface of the ground; and should
the City at any time change or alter the present grade of that part of "Boyle
Park" traversed by such easement and right of way and it should become necessary
by reason thereof to lower the main laid by the Arkansas Louisiana Gas Company,
the cost thereof shall be borne by Arkansas Louisiana Gas Company, its suc-
cessors and assigns.
SECTION 4. All ord antes and parts of ordinances in conflict here -
with are hereby repealed.
SECTION 5. This ordinance shall take effect and be in force from and
after its passage.
