6249ORDINANCE NO 621L9 AN ORDINANCE TO SUPPRESS AND PUNISH IMMORAL PRACTICES IN THE CITY OF LITTLE ROCK, ARKANSAS; PROVIDING FOR A PHYSICAL EXAMINATION OFTHE PERSONS FOUND GUILTY OF VIOLATING THE TERMS OF THIS HRDINANCEI AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCS, ARKANSAS% Section 1. Every female who shall, in theecity of Little Rook, Arkansas, submit herself for. the purpose of prostitutio% illicit intercourse, or who shall be in the habit of receiving or making visits therefor, shall, together with her male para- mour or visitor, be guilty of a misdemeanor ern da violation of this ordinance. Section Z. Illicit sexual intercourse within the City of Little Rook, Arkansas be, and the same is hereby declared a misdemeanor. Section S. Any person found guilty in Municilal Court of violating Section One. or Section Two of this ordinance shall be fined in any sum not less than five dollars nor more than twenty five dollars, and for each subsequent of- fense shall be fined not less than twenty five dollars nor more than one hundred dollars. Section 4. Whenever any person is found guilty of trio- lating Section One or Section Two of this ordinance, such fact shall be" reported by the Clerk of the Municipal Court to the City Health Officer; and on such conviction, the Municipal Judge or the City Health Officer is authorized to cause such person to be detained and examined by the City Health Officer of by any physician designated by the -City Health Officer by useof „the necessary tests-and examinations, including the Wassermann blood test, to ascertain the presence of any venereal disease in a communioable stage, provided that any evidence so acquired shhll not be used against such person in any criminal prosecution. Section 5. Whenever any person, after the examination pro- vided in Section Four of this ordinance, is found to be infected with a veneraal disease in a communicable stage, the City Health Officer may, pending the imposition of or at the expiration of any jail sentence imposed on such person, when in the exercise of It e his discretion he believes that the public health requires it, commit such person pay -e-vn found to be infected with a venereal diseasd in a communicable stage who fails to t6ke treatment adequate for the protection of the public health, to a hospital or other,place designated by the City Health Officer as a place of quarantine in the State of Arkansas for, such treatment, even over the objection of such person so :.diseased or infected, pro- vided the commitment can be done without endangering.the life of the patient. Section 6. Any person who, after the examination provided in Section Fou}P of this ordinancenin a communicable stage, and is committed to a hospital or other place of quarantine as provided in Section Five of this ordinance, and who fails to remain in o,, aA-u- V" � V_aAo� such place of commitmen , 11 be punished as for contemw of court, andshall be guilty of a misdemeanor, and on convic- tion in the Little Rock Municipal Court shall be fined in any sum not less than twenty five dollars ($25.00) nor more than two hundred dollars ($500.00). Section 7. This ordinance is intended to be cumulative of all other ordinancesnow eaibtdng, and is not intended to repeal any of said ordinances except where there is irreconcilable conflict. Section 89 If any part, phrase, clause, section, or sub- section of this ordinance be held to be unconstitutional or iniralid, such unconstitutionality or invalidity shall not affect the validity of the remaining portional©f, this ordinance. The City Council hereby declares that it would have passed the remaining parts of this ordinance if it had known t1at such part, phrase, clause, section or sub - section would be declared unoonstitutional. Section 9. WHEREAS, the suppression and punishment of vice and immoral practices in the City of Little Rook is a matter of great public concern and directly affects the public health and Welfare, an emi"ency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
