ORDINANCE NO. -6309-
AN ORDINANCE DECLARING ABANDONED ANY PERMISSION HERETOFORE
GRANTED TO USE FOR PURPOSES OF A STAIRWAY ANY PART OF THE
SIDEWALK SOUTH OF ANY IMPROVEMENTS NOW OR HERETOFORE ERECTED
ON LOT SIX (6), BLOCK FIVE (5), ORIGINAL CITY OF LITTLE
ROCK, AND FORBIDDING THE CONSTRUCTION OF ANY SUCH STAIRWAY
THEREON.
WHEREAS, The Vity Council of. Little. Bock, Arkau as by
this instrument finds and declares that the owners of Lot
Six (6), Block Five (5), Original City of Little Rook have
abandoned and forfeited through non -user and have lost
through prescription any right or authority that they might
possess to construct a stairway in or upon any part of the
sidewalk on the south side of the improvements now or here-
tofore erected on the above described real property, and
WHEREAS, The traffic demands and the needs of the citi-
lens of Little Rock do not justify the use of any part of
the sidewalk for the purposes of said stairway, and,
WHEREAS, any such stairway would be an encroachment
and constitute a public nuisance, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS.
Section 1. Any right, power or authority heretofore
possessed to construct a stairway in or upon any part of
the sidewalk adjacent on the south to Lot Six (6), Block
Five (5), Original City of Little Rock is hereby revoked
and cancelled.
Section 2. This ordinance shall be in full force and
effect from and ifter its passage and approval.
