6483i ORDINANCE NO. 6 46S AN ORDINAICE GRANTING TO THE ARK ASPS LOUISIANA GAS COMPANY, ITS SUCCESSORS AND ASSIGNS, AN EASEMENT AND RIGHT OF WAY OVER AND THROUGH ISAAC T. GILLA'A, SR. MEMORIAL PARK FOR THE PURPOSE OF LAYING, MAINTAINING AND REMOVING GAS DISTRIBUTION !MAIN AND APPURTENANCES INCIDENT THERETO. WHEREAS, on the 15th day of November, 1934, the Union Trust Company of Little Rock, as trustee, and Marion 5 asson, as Bank Commissioner of the State of Arkansas in charge of Union Trust Company for liquidation, were the owners of the following described land situated in Pulaski County, Arkansas, to wit: The North Half (N2) of the Northeast Quarter (NE-,_j-) of Section 26, Township 1 North, Range 12 West, and on said date granted to Arkansas Louisiana Pipe Line Company, the predecessor of Arkansas Louisiana Gas Company, an easement and right of way across said lands for the purpose of laying a gas main thereon and maintaining, operating, repair- ing and removing the same, and WHEREAS, the City of Little Rock thereafter purchased said lands for use as a public park by its negro citizens, and the City of Little Rock is now the owner thereof, and WHEREAS, the Arkansas Louisiana Gas Company has found it necessary to install and extend additional gas mains from its main gas line to Sweet Home and vicinity for the purpose of supplying Dulin Aluminum Company and other mining operators engaged in mining bauxite in and near Sweet Home, Arkansas, for defense purposes, with an adequate supply of natural gas for use in their mining operations, and stands in need of additional right of way and easement across the aforesaid lands for such purposes and has applied to the City of Little Rock for the grant- ing of such additional easement and right of way; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: SECTION 1. That there is hereby granted to Arkansas Louisiana Gas Company, its successors and assigns, an easement and right of way along and over the lands hereinabove described, which easement and right of way shall be along side of Loud ad acent to the right of way and easement heretofore granted to Ark - ansas/Pipe leine 8C ompany and hereinbefore mentioned, together with the right of ingress and egress to and from said lands for such purposes. SECTION 2. Said easement and right of way shall be for a period of Fifty years or so long thereafter as it is used for the purpose of distributing natural or artificial gas and shall be for the purposes of laying, maintaining, repairing, operating and removing gas distribution mains and pipes and appurtenances incident thereto. SECTION 3. All mains and pipe lines laid over and across said lands under the authority and provisions of this Ordinance shall be laid at a depth of not less than Eighteen (18) inches beneath the surface of the ground, and all ex- cavations made in connection with installation, or repairs, or removal of same shall be filled and tamped and maintained level with the adjoining surface. In the event the City at any time should change or alter the present grade or soil level of that part of said lands traversed by such pipe lines and it should be- come necessary by reason Ahereof to lower the same to a greater depth, the cost thereof shall be borne by Arkansas Louisiana Gas Company, its successors and assigns. SECTION 4. The City shall receive the sum of Forty Dollars (;x40.00) as a consideration for the granting of this easement and right of way, to be paid upon the passage and approval of this Ordinance. SECTION 5. All ordinances and parts of ordinances in conflict here- with are hereby repealed. SECTION 6. This Ordinance shall take effect and be in force from and after its passage.
