AN ORDINANCE PROTECTING THE PUBLIC HEALTH BY REQUIRING THE
ABATEMENT OF CERTAIN NUISANCESI REQUIRING THAT CERTAIN BUILDIN GS
BE RAT- PROOF; DECLARING A NUISANCE; EMPOWERING THE CITY HEALTH
OFFICER TO MAKE CERTAIN INSPECTIONS, FIXING A PENALTY FOR
VIOLATIONS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES
Whereas, endemic typhus fever and other rat borne diseases
are known to be present in this area, and
Whereas, Little Rock, a center of increasing military and
industrial importance, is abnormally crowded as to population,
housing, and building conditions, making the city vulnerable
to'these diseases, and
Whereas, it is necessary for the preservation of public
health and the elimination of economic loss to control certain
nuisances favoring rat infestation, now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS
SECTION 1• That all business houses where food is stored,
restaurants, hotels, and other places where food is served, all
slaughter houses, all public structures in which feed stuffs
may be, stored, and all other business houses who`re rats say
be harbored shall be kept and maintained in a rat -froe condition

and the said structures shall -be rat -proof in order to prevent

the entry of rats into and upon said premises; that the keeping
or maint &woof such houses or structures in other than rat-

Section 2, That all garbage, decaying vegetables, or similar
substances, shall be shored in metal containers with tight fitting
lids or in other containers that are WAt- proof.
Section 3, That the City Health Officer or his duly authorized
representative is empowered to make such interior or exterior - --
inspections of premises or buildings as is in his opinion
neoessary. to determine that full compliance with this ordinance
has been made.
Section 4, That from and after the passage of this ordinance,
it shall be a misdemeanor for any person, whether owner or tenant,
to fail promptly to remove or abate any nuisance, source of foulness,
or cause of sickness hazardous to the public health, upon order
Of the City Health Officer or his duly authorised representative.

Section b, That each day any person, firm, or corporation
shall violate any of the provisions of this ordinance shall
constitute a separate offense.
Section 6, That any person, firm, or corporation who
shall violate the terms of this ordinance, or any of the
provisions herein, shall be deemed guilty of a misdemeanor and,
upon conviction, be. subject to a fine not to exceed One Hundred
Dollars (100.00) or imprisonment for not more than thirty (30)
days.
Section 7, If any part, phrase, clause, section or sub-
section of this ordinance be held to be unconstitutional or
invalid, such unconstitutionality or invalidity shall not affect
the validity of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed the
remaining parts of this ordinance if it had known that such
part, phrase, clause, section or sub- section thereof would be
declared unconstitutional or invalid.
Section 8, The control of rats ant rat- borne diseases
being vital to the pease, health, and safety, an emergency is ✓
hereby declared to exist and this ordinance shall be in full
force and effect from and after its passage and approval.
