6549ORDINANCE NO. 6549 AN ORDINANCE REQUIRING REAL ESTATE BROKERS TO SECURE LICENSES, FILING THE AMOUNT OF THE LICENSE FEE, PROVIDING PENALTIES FOR A VIOLATION, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. It shall be unlawful for any person or in- ~° 'dual to engage in the b-d°airess or act is the a real estate broker or dealer in real-estate in the City of Little Rook, Arkansas, or real estate located elsewhere, when having an office and pursuing said business in the City of Little Rock, without first obtaining a license therefor. SECTION 2. A real estate broker or dealer is one who, for a commission or other compensation for himself or others, sells or offers for sale, buys or offers to buy, or negotiates the purchase or sale of real estate, or who, for compensation, rents or offers for rent, or collects rents upon real estate or improvements thereon, or takes option on property for the purpose of selling such property at an advanced price within the life of the option or who holds himself out to the public as a real estate agent, or advertises himself as such either in newspapers or by signs on offices or elsewhere, or in any other manner, either for himself or for others, as a whole or partial vocation. This section shall be held to include all salesmen or solicitors employed by any real estate broker,- each of whom shall secure a license as provided herein.. Provided, however, this definition is not intended to apply to a person or individual who sells or offers to sell real estate or otherwise handle real estate owned by themselves in good faith. �P y SECTION 3. Every person or individual engaged in any part or all of the business defined in the foregoing section, shall pay an annual license fee of #10.00 SECTION 4. Any real estate broker, as defined above, who fails to comply with Section 3 of this ordinance, by procuring a license as therein provided, shall not be entitled to any commission or compensation for the sale of any real estate which he may perfect, -and any contract between him and any person, firm or corporation for a commission or other compensation, shall be null and void. SECTION 5. The license or licenses required under this ordinance shall expire on Demember 31st of each year. In the event that application for such a license is made on or after July lst of any year, the license fee shall be $5.00 for the remainder of the calendar year. SECTION 6. The city council reserves the power to revoke and declare forfeited any license issued under the provisions of this ordinanoe at any time the holder thereof is guilty of a wilful attempt to violate the provisions of this ordinance. SECTION 7. Every person or individual licensed under the provisions of this ordinance is required to have and maintain an office in the City of Little Rook for the trans- action of his business; and upon a change in the location of his office no business shall be transacted in the new location until the pity collector has notice of suoh change within i 48 hours. SECTION S. Any person or individual who violates any of the provisions of this ordinance shall be guilty of a mis- demeanor, and upon conviction thereof shall be subject to a fine of not less than twenty -five dollars nor more than fifty dollars;.and each day during which the provisions of this ordinance are not complied with.shall constitute a separate offense. If any person.or individual shall be convicted in any one year of two violations of this ordinance, his license shall automatically be revoked for .` % i the balance of that year. SECTION 9.
