6616ti ORDINANCE NO. 6616 . AN ORDINANCE AUTHORIZING AND DIRECTING THE EXECUTION OF A LEASE OF CERTAIN SPACE IN THE SOUTHEAST CORNER OF THE MAIN LOBBY OF THE CITY HALL TO ARKANSAS EIMPLOY111ENT SERVICE FOR THE BLIND; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. The Mayor and City Clerk are hereby authorized to ex- acute on behalf of the City of Little Rock as Lessor, the following lease; Agreement made between the City of Little Rock hereinafter known as the Lessor, and Arkansas Employment Service for the Blind hereinafter known as the Lessee. For and in consideration of the sum of one dollar ($1.00) cash in hand paid by the Lessee to the Lessor, receipt of which is hereby acknowledged, the Lessor hereby leases to the Lessee for a period of one year from the date hereof, space within its premises as follows: Southeast corner of main lobby of Little Rock City Hall, and the Lessor agrees that the right to sell on the leased premises,such articles as tobacco products, candy and confection, newspapers and periodicals and soft drinks except coca -cola sold through vending machines, to employees and visitors shall belong exclusively to the Lessee. The Lessor further agrees that the Lessee may appoint an agent to conduct this business, and shall have the privilege of super- vising this business, and of replacing the agent at will. The Lessor further agrees to notify the Lessee immediately as to any misconduct or mismanagement by the agent which may come to his attention. The Lessee agrees to install suitable equipment in this space provided by the Lessor, for the serving of the merchandise agreed upon to the employees and visitors of the building. The Lessee further agrees to place in the stand a suitable agent in the person of a blind man or woman with such a sighted assistant as may be necessary to carry on this businesF in a satisfactory manner, and to meet every requirement for quality of merchandise and proper service. The Lessee will remove immediately any agent or employee of this concession stand who is unsuitable or unsatisfactory to carry on the business. The Lessee further agrees that the Lessor shall not be liable for any loss of property of the Lessee or of agents thereof which might occur. The Lessor agrees to allow the Lessee to remove on the ex- piration of this agreement all property, fixtures and fittings installed and owned by the Lessee for the purpose of conducting the business before described. This agreement and all its terms shall continue after the expirQtion of the above period subject to cancellation upon thirty (30) days notice by either party, and shall inure to the benefit of and be binding upon the parties hereto, their successors and assigns. In witness of this agreement the parties hereto have by their proper officers hereunto set their hands and have affixed their corporate seals on this day of February, 1944. Because the furnishing to blind persons of an opportunity to earn their own livelihood is a proper function of government] and because the foregoing lease will afford to some blind person an oppor- tunity for earning his livelihood, which opportunity has not heretofore existed; and because the facilities of City property should be utilized to their maximum advantage; and because this ordinance will enable the use of such facilities; an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall be in full force and effect from and after its passage.
