AN ORDINANCE GRANTING TO JOSEPH B. FLEMING AND AARON COLNON,
TRUSTEES OF THE CHICAGO, ROCK ISLAND AND PACIFIC RAILWAY COMPANY,
THEIR SUCCESSORS AND ASSIGNS, A RIGHT OF WAY ACROSS SHERMAN STREET
AND ALLEY IN BLOCK SIX (6), POPE'S ADDITION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. Joseph B. Fleming and Aaron Colnon, Trustees of
The Chicago, Rock Island and Pacific Railway Company, their succes-
sors and assigns, are hereby authorized to construct, maintain and
operate a spur track across Sherman street and the alley running
north and south through Block Six (6), pope's Addition, said track
being an extension to connect the tracks now located on the West
fifty (50) feet of Block Seven (7), Pope's Addition, and the East -
half of Block Six (6), Pope's Addition, and to cross Sherman Street
at a point approximately one hundred forty -four (144) feet south
of the south line of Markham Street, in accordance with plans pre-
pared by the City Engineer dated October 21, 1944.
Section 2. Said Trustees, their successors or assigns, shall
maintain said track so that the top of the rails shall be on a
level with the grade of the Street as now or hereafter established,
and shall be built and maintained so as not to interfere with any
water way or flow of same, and the City shall have the right to
alter said grade at its pleasure without responsibility to the Trus-
tees, their successors or assigns. The Trustees, their successors
or assigns, shall also maintain between -the rails of said track and
two (2) feet on each side thereof pavement of like character and
material as is now, or may be hereafter, constructed at said point.
Section 3. The use of said track shall be so conducted as not
to interfere with the usual traffic along Sherman Street.
Section 4. For this grant the said Trustees, their successors
or assigns, shall pay to the City the sum of Twenty -five Dollars
($25.00) per annump payable annually in advance..
Section 5, This grant shall be and remain in force and effect
for a period of twenty -five (25) years from and after the date of
the acceptance of this ordinance by the Trustees of The Chicagoo Rock
Island and pacific Railway Company, provided that same is accepted
within ninety (90) days after its passage.
