ORDINANCE NO. 6730
AN ORDINANCE DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO A CONTRACT
FOR THE DISPOSAL OF THE CITY'S GARBAGE, REFUSE, WASTE, TRASH, ETC., DECLAR_
ING AN EMERGENCY, AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS:
"SECTION 1. The Mayor and City Clerk are hereby directed to enter
into a contract with Douglas G. Brown for the disposal of the garbage,
refuse, waste, trash, etc. collected by the Garbage Disposal Department,
WkW,19ntract, shall contain the following provisions:
(1)) The entrant • ihitld be , for a period of five ( 5) years "
beginning February 7, 19450
(2) Douglas G. Brown shall agree to furnish the premises,
equipment and all other expenses necessary to provide adequately
for the sanitary disposal of all garbage, refuse, waste, trash,
etc. collected within the City of Little Rook by the Garbage Dis-
posal Department, and Douglas G. Brown agrees to dispose of all
the garbage within 24 hours after said garbage is delivered to
him by the method known as "sanitary trench and fill". In the
event that natural forces create a condition making it imprac-
tical to dispose of the garbage within 24 hours after delivery,
the period of disposal may be extented at the discretion of the
Director of the Department of Garbage Disposal.
(3) Douglas G. Brown reserves the right to feed hogs on
the garbage delivered to him.
(4) The contract may be cancelled by either party at the
expiration of two years from February 7, 1945 upon giving six
months written notice to the other party. In the event of
cancellation by either party, the City retains the option to
bray from Douglas G. Brown any lands or premises purchased by
him for use in disposing of the garbage, said land or premises
not to exceed 20 acres in extent, and the City agrees to pay to
Douglas G. Brown for any lands so purchased, the cost price
paid by him for said lands not to exceed #400.00 per acre, plus
10;x.
SECTION 2. Because the present Garbage Disposal Contract
will soon expire and it is found to be vital to the public health that
early and definite arrangements be made for disposal of the city's
garbage, refuse, waste, trash, etc., and because the above contract
41111accomplish these ends, an emergency is hereby declared to exist
k and this ordinance being necessary for the preservation of the public
peace, health and safety, shall be in full force and effect from and
after its passage.
