ORDINANCE NO. 6743. AN ORDINANCE PROVIDING FOR THE ABANDONMENT BY THE CITY OF LITTLE ROCK OF THAT PART OF SHERMAN STREET SITUATED BETWEEN MARKHAM STREET AND RAILROAD RIGHT-OF-WAY OF MISSOURI PACIFIC RAILROAD COMPANY. WHEREAS, a petition was duly filed with the City Council of the City of Little Rock, Arkansas on the 5th day of February, 1945, asking the City Council to vacate and abandon all that portion of Sherman Street,according to the original plat of the City of Little Rock, situated between Markham Street on the South and the right -of -way of the Missouri Pacific Railroad Company on the North; and WHEREAS, after due notices, as required by law, the Council has at the time and place mentioned in the notice heard all persons desiring to be heard on the question, and has ascertained.that that portion of Sherman Street as efa, .d.eaeribe- d his heret ©tore been dedicated to the public use as a street; has not actually been used by the public generally for a period of at least five years; that all the owners of the property abutting that portion of Sherman Street to be vacated have filed with the Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of that portion of Sherman Street herein described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Section le The City of Little Rock, Arkansas hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to that part of Sherman Street situated between Markham Street on the South and right -of -way of the Missouri Pacific Railroad Company on the North. s. Section 2. A copy of this ordinance, duly certi- fied to by the City Clerk, shall be filed in the Office of the'Recorder of Pulaski County and recorded in the deed I records of said county.
