6788ORDINANCE NO. E788- AN ORDINANCE REQUIRING THE OPERATORS OF PARKING LOTS TO CARRY INSURANCE FOR THE BENEFIT OF THEIR PATRONS, 11AKING VIOLATIONS A IISDEMEANOR, DE- CLARING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. A Parking Lot is hereby defined to be any building or area or space of ground in the City of Little Rock, Arkansas, where vehicles of any nature are parked for a consideration paid to the per- son, firm or corporation in the business of operating said parking lot. SECTION 2. From and after the effective date of this ordinance, each person, firm or corporation operating a parking lot within the City of Little Pock, Arkansas is hereby required to carry a policy or policies of insurance to indemnify any person or persons parking vehicles on the parking lot in question, against loss by fire or theft or property damage to a vehicle occurring while the vehicle in question is parked on the parking lot. SECTION 3. The insurance shall be wititten by some approved in- surance company and shall be in an amount reasonably sufficient to in- demnify persons parking vehicles on said parking lots as said amounts may be fixed from time to time by the City Collector provided that the minimum insurance carried shall be 42,500.00. Provided, however, that in lieu of insurance against loss from property damage, any parking lot operator may furnish to the City Collector a surety bond written by an approved corporation in the minimum amount of 42,500.00; said surety bond to guarantee payment up to $2,500.00 of any judgment that may be recovered against said parking lot operator for property damages suffered by the owner of any vehicle while said vehicle is parked in the custody of any parking lot operator. SECTION 4. All such policies of insurance or authenticated copies, satisfactory to the City Collector, shall be kept on file in the office of the City Collector of Little Rock, Arkansas. SECTION 59 The insurance coverage anticipated in the foregoing section shall apply only to those persons who park their vehicles on said parking lots for compensation to the parking lot operator. SECTION 6. The City Collector is hereby directed to refuse to issue parking lot operators' license to any applicant until and unless such applicant furnishes to the Collector an appropriate insurance policy in a sufficient amount as is set out above. SECTION 7. It is hereby declared to be a misdemeanor for any person, firm or corporation to operate any parking lot without securing and maintaining in force during the operation of said parking lot, the insurance as required above; and any person, firm or corporation opera- ting a parking lot in violation of the terms of this ordinance shall, on conviction, be fined in any sum not less than X5.00 nor more than $250.00, or imprisoned for a period not to exceed 30 days, or both fined and imprisoned, and each separate day's operation in violation of the provisions of this ordinance shall constitute a separate offense. 1945. SECTION St The effective date of this ordinance shall be July 1, SECTION 9. Because at the present time many persons in Little mock are suffering substantial loss and damage by reason of operators of parking lo-'--,s conducting their operations in such a lax manner as to en- courage theft and other law violations and makes possible a ;treat injury and damage to vehicle owners making use of the facilities of said park- ing lots; and because this promotes violence and encourages law viola- tions, and because this ordinance will remedy this situation, an emergency is hereby declared to exist and this ordinance is found to be necessary for the preservation of the public peace, health and safety and shall be in full force and effect from and after its passage.
