6974ORDINANCE No. 6974 AN ORDINANCE REGULATING THE HEIGHT OF HEDGES AND SHRUBS, DE- CLARING AN EMERGENCY, AND FOR OTHER PURPOSES. Whereas, various hedges and shurbs have been permitted to grow to such heights in the City of Little Rook that they interfere with the capacity of motorists to observe other traffic on the streets, highways and alleys and Whereas, this condition is dangerous to both pedestrians and motorists and aggravates the traffic problem in the City of Little Rook, and Whereas, this condition should be corrected, now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. It is hereby declared to be a misdemeanor for any person, persons or corporation owning real property at any intersection of streets, alleys, or highways to permit any hedge and /or shrubs to extend more than three feet (31) above the earth in which said hedge and /or shurbs are growing, within a distance of thirty feet (301) from said intersection. SECTION 2. Any person, persons, or corporation violating Section 1 of this ordinance shall be guilty of a misdemeanor and on conviction shall be fined any sum not less than Five Dollars ($5.00) nor more than Fifty Dollars ($50.00) and each day that the violation shall continue shall constitute a sepa- rate offense. SECTION 39 In the event of any violation of Section 1 of this ordinance, in addition to the fine mentioned in Section 2 of this ordinance, the City is authorised to go upon said real property and to take any usual and reasonable steps to trim AW irrgnro the hedge and /or shrubs in question and the owner of said real property shall be liable for the cost of such action by the City. - 1 - .?' . s, •0 SUCTION 4. Because hedge and shrubs have been permitted to grow to such heights in this City that they constitute a hazard to motorists and pedestrians, which hazard should be removed at once$ an emergency is hereby declared to exist and ^ this ordinance is found to be necessary for the preservation of the public peace, health and safety and shall be in full force and effect from and after May 10 1946.
