ORDINANCE NO. loll;
AN ORDINANCE CLOSING STREETS AND ALLEYS IN
A. C. PENZEL'S ADDITION TO LITTLE ROCK AND
IN A. C. PENZEL'S SUBDIVISION, EXCEPT "A"
STREET AND AUTHORIZING THE WIDENING AND RELO-
CATION OF "ATM STREET AND FOR OTHER PURPOSES.
WHEREAS, a petition was duly filed with the City Council of the City
of Little Rock, Arkansas, on the 9th day of July, 1946, asking the City
Council to vacate and abandon all streets and alleys designated on the plat
of A. 0. Penzel's Addition to said city now appearing of record in Plat
Book 1, Page 196, and on the plat of A. C. Penzel's Subdivision appearing
in Plat Book 1, Page 209 in the Office of the Recorder of Pulaski County,
except the street designated on the plat of A. C. Penzel's Subdivision as
"A" Street and to widen and relocate said "A" Street to conform to the
directions of the City Planning Board.
WHEREAS, after due notices as required by law, the Council has, at the
time and place mentioned in the notice, heard all persons desiring to be
heard on the question and has ascertained that the streets and alleys here -
inbefore described, have heretofore been dedicated to the public use as
streets and alleys herein described; have not been actually used by the
public generally for a period of at least five years subsequent to the fil-
ing of the plat; that the owner of all the property abutting upon said
streets and alleys to be vacated has filed with the council its written
consent to such abandonment by signing said petition; and that public
interest and welfare will not be adversely affected by the abandonment of
such streets and alleys.
NOW THEREFORE, be it ordained by the City Council of the City of Little
Rook, Arkansas:
Section 1. The City of Little Rock, Arkansas, hereby releases, vacates
and abandons all its rights, together with the rights of the public generally
in and to the streets and alleys designated as follows:
All streets and alleys in A. C. Penzel's Addition to the City of Little
Rook now appearing on the plat of said Addition in Plat Book l at Page 196
in the Office of Recorder of Pulaski County, Arkansas,, and all streets and
alleys in A. C. Penzel's Subdivision, now appearing on the plat of said sub-
division in Plat Book 1 at Page 209 in the office of the Recorder of Pulaski
County, Arkansas, except the street designated on the plat of said
Subdivision as "ATM Street, and does hereby authorize the widening and
relocation of said "A" Street to conform to the directions of the City
planning Board.
Section 2. A copy of this ordinance duly certified by the City Clerk
shell be filed in the office of the Recorder of the county and recorded
1A the Deed Records of the County,
Section 3. This ordinance shall take effect and be in force from
and after its passage.
