7204ORDINANCE NO. Zpp4 —
AN ORDINANCE TO REQUIRE THE COUNTY TO REMOVE THE BODIES BURIED
IN THE OLD COUNTY HOSPITAL GROUNDS BEYOND THE LIMITS
OF THE CITY OF LITTLE ROCK.
WHEREAS, Pulaski bounty is the owner of the following-
described property, to -wit:

All that part of the Northwest kuarter of the
Northwest Quarter of Section Sixteen, Tow4ship
One North, Range Twelve West, Pulaski County,
Arkansas, lying West of the Missouri Pacific
Right -of -way;
WHEREAS, The County has for many years buried paupers
who died in the Old County Hospital on a plot of ground in the
Southwest corner of the above mentioned lands, being 187 feet
East and West and approximately 600 feet North and South; and
WHEREAS, said burial groundvias abandoned as a graveyard

by the County in 1944 and no further bodies have been buried
there and same is no longe&ept up or used as a burial ground; and
WHEREAS, same is now within the city limits of the
city of Little Rock; and
WHEREAS, the orders of the Pulaski County Court show
that the county is preparing to sell and transfer said lands
to private individuals for commercial purposes, in which event
said burial ground would be exempted from taxation and the
city, county and state would lose revenues which should be de-
rived therefrom; and further that said graves would not be
maintained as a graveyard: NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
Section 1. The County of Pulaski and the County
Judge acting threfor be and they are hereby required to remove

all the dead buried within the said plot and to cause the
same within thirty days from the passage of this ordinance
to be removed and buried in a more suitable location beyond
the limits of the city of Little hock.
Section 2. After the publication of this ordinance,
as required by law, and after the removal of the bodies re-
maining in said graves, that said grounds be declared vacated
as a cemetery or burial ground and no longer a cemetery, and
same shall become subject to taxation like other property.
Section 3. It being ascertained that said graveyard
has been abandoned, that the head markers have decayed or
fallen down and been removed, if ever having existed, to prac-
tically all of the graves in said section, and that it is to
the best interest of the public and all persons interested in

or having affection for the bodies deposited in said paupers'
field that same be promptly removed to a burial ground outside
the city, the immediate operation of this ordinance is necessary
for the preservation of the public peace, health and safety.
An emergency is declared to exist and this ordinance shall take
effect and be in force on and after its passage .
