7222I -J t I ORDINANCE N0._L222 AN ORDINANCE TO CREATE A BOARD FOR EXAMINING AND LICENSING MASTER E+;LECTRICIANS, JOURNEYMAN ELECTRICIANS, MAINTENANCE ELECTRICIANS, SPECIALIST ELEVATOR ELECTRICIANS, SPECIALIST REFRIGERATOR ELECTRICIANS AND SPECIALIST SIGN ELECTRICIANS: TO PROVIDE FOR THE LICENSING OF PERSONS ENGAGED IN THE BUSINESS OF ELECTRICAL CONTRACTING, ELECTRICAL ELEVATOR CONTRACTING, ELECTRICAL REFRIGERATOR CONTRACTING, AND ELEC- TRICAL SIGN CONTRACTING: TO PROVIDE FOR RULES AND REGULATIONS FOR LICENSING SUCH PERSONS OR FIRMS, TO PROVIDE FOR FILING OF A SURETY BOND BY SAID PERSONS OR FIRMS, TO PRESCRIBE PENALTIES FOR THE VIOLA- TION OF THIS ORDINANCE: PROVIDING THAT INVALIDITY OF PART SHALL NOT EFFECT VALIDITY OF REMAINDER: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARK. SECTION 1. A. There is hereby established a board of five members to be known asthe Board of Electrical Examiners and Supervisors. Such Board shall be composed of the personnel having the following qual- ifications: (a). One member shall be the Chief Electrician of the City of Little Rock. (b). One shall be an electrical contractor duly licensed to do business in the City of Little Rock employing less than three people. (c). One shall be an electrical contractor duly licensed to do business in the City of Little Rock employing three or more people. (d). One shall be a journeyman electrician who has qualified as a master electrician as herein defined. (e). One shall be a representative of the Arkansas Fire Prevention Bureau, B,. Said Board shall have the power and it shall be the duty of said Board to examine into the qualifications of all persons, firms, or corporations who are engaged in the business of contracting elec- tric wiring work or installing electric vA ring, lighting fixtures, or apparatuses operating at a potential of 30 volts or more. SECTION 2. The members of said Board other than the Chief Electrician of the City of Little Rock shall be appointed by the Mayor of the City of Little Rock within 10 days after the effective date .,of this ordinance, subject to the approval of a majority of the -2- elected members of the City Council of the City of Little Rock. The term of the members of said Board shall run concurrently with the term of office of the Mayor making their appointment, and until their successors are selected and qualified. Vacancies for any un- expired term shall be filled in the same manner as is herein provided for by the original appointment-of members. The City Electrician shall be the Secretary who shall keep a full and complete record of all acts and business of the Board. The Board shall also select one of its members as Chairman and promulgate such rules and regulat- ions for the conduct of its meetings as may be appropriate. SECTION 3. A majority of the Board shall constitute a quorum to transact the business thereof. The Board shall meet at least onee a month and may hold special meetings upon call of the chairman of the Board whenever the business of the Board requires it. The books, papers, and records of the Board shall at all times be open and sub- ject to inspection. He shall file a report with the City Council on or before the 15th of each month, setting forth the acts and doings of the Board for the preceding month. Any member of the Board may be removed by the City Council of the City of Little Rock for incompetency, inefficiency or dereliction majority of duty by a/&Ak vote of the duly elected members of the council. The Board of Electrical Examiners and Supervisors shall adopt such rules and regulations 'for the examination of all applicants for license and for the conduct of the business of the Board as may be j necessary, not in conflict with the laws of the State of Arkansas, the prov sions of this ordinance or any ordinance which may hereafter be passed, and shall have the power to change and amend the same, subject to this limitation. A copy of any rules and regulations adopted before becoming effective shall be approved by the City Council and filed with the City Clerk of the City of Little Rock, Arkansas. A complete list of all licenses issued,,renewed or re- voked shall be on file in the office of the Chief Electrician of the City of Little Rock. ..3.. iSECTION 4. No person, member and /or employee of a firm or cor- poration shall engage in the electrical business of installing, al te r- in g� or repairing any electrical wiring, fixtures, devices or equip- ment operating at a potential of 30 volts or more in the City* of Little Rock, Arkansas, unless such persons, members, and /or esey ees of a firm or corporation have been duly examined and have been I issued a license to engage in said business, such licenses to have been issued b,- the Board of Electrical Examiners and Supervisors. Permits to perform electrical work shall be issued by the City Elee- trieian only to such persons, members and/or employees of a firm or corporation holding such licenses. T Any person, member and /or employee of a firm or corporation in I the City of Little Rock doing electrical work covered by this ordin- anee or holding himself or itself out as licensed en ed to do electrical work or engage in the electrical business of any one or more branches of j l the electrical industry as hereinafter defined ttthout first suceesa- fully passing an examination given by the Board and securing a license in the manner hereinafter set forth shall upon conviction thereof be guilty of a misdemeanor. SECTION 5. Every person, member, and /or employee of a partner- ship, firm, or corporation desiring to engage in the electrical bus - iness as heretofore and hereafter defined shall, before engaging in such business, successfully pass an examination upon his qualifications. Sueh'examination shall be prepared, conducted, and held by the Board ! of Electrical Examiners and Supervisors,-. Ali applicants desiring to take such examination shall apply in writing to the Secretary of the Board of Ebetrical Examiners and Supervisors at least five days be- fore such examinations are to be held, for the privilege of taking such an examination, and shall pay- to the City Collector- Of the City of Little Rock an examination fee in the sum as hereinafter set forth, and shall exhibit a receipt for such fee to the Secretary of the Board of Electrical Examiners and Supervisors before he shall be allowed to take such examination. The Board shall fix the time and place for the examination of applicants, and if the Board shall find upon -4- examination that any applicant has a reasonable knowledge of the nat- ural and practical laws. and functions of electricity, the safe, correct and approved manner of installing devices, apparatus, and in_- strumentalities for electric light, heat, power and signaling pur- poses, and,the ordinances of the City of Little Rock governing the installation of electrical devices, apparatus, and instrumentalities, then the Board shall issue to such person the license for which he has applied, which license shall indicate thereon his qualifications and the fact that he has successfully completed and passed the exam- ination given by the Board for his particular type of electrical work. All such licenses shall expire on the 31st day of December of each year, and all duly licensed perscns who apply for renewal of such licenses within 30 days after the expiration date thereof shall be i granted a new license without further examination, upon the payment of the fee hereinafter mentioned for renewal. If such renewal is not applied for on or before the 30th day of January succeeding the period of the license the applicant shall be re- examined by the Board and shall be required to pay the examination fees for such examination as hereinafter prescribed. Any license for such work issued prior to the effective date of this ordinance shall be null and void and the holder of such license shall not be entitled to a renewal thereof until he shall have successfully passed the examination.for the license provided and held by the Board of Electrical Examiners and Supervisors, and shall have paid the fee therefor. *" " 'V "SWITON 6. The classification of the various branches of the electrical industry and the qualifications required of applicants for each classification shall be as follows: (A) A "Master Electrician ", shall b defined to include ary individ- ual who possesses the necessary qualifications, training and technibal knowledge to plan, lay out and supervise the install- ation, maintenance and extension of electrical conductors and equipment, 1. He shall be a person of not less than 21 years of age and a person of good moral character. -5 2. He must be a graduate electrical engineer from a recognized university or college, with at least one year# actual exper- ience installing wires, conductors, and electrical equipment used inside of buildings for the transmission of electrical current for .limit, heat or power purposes, or 3. Examination fee for Maintenance Electrician shall be $3.00 Renewal fee for Maintenance Electrician shall be 1100 (D) "Specialist Sign Electrician" shall be defined to include any -6- individual engaged in the business of building, erecting, maintain- ing and repairing electrically illuminated or operated signs, and gaseous tubing for illumination, making all connecti m s on secondary side of transformers and primary connections only where there is a sign circuit or an outlet of sufficient capacity available within fifteen feet of the sign or transformer to be connected. 1. He shall have had at least two years experience in the work of building or erecting, maintaining and repairing electric- ally illuminated or operated signs and gaseous tubing for illumination. Examination fee for specialist sign electricians $3.00 Renewal fee for specialist sign electricians 1.00 (E) "Specialist Refrigeration Electrician" shall be defined to in- elude any individual engaged in the business of servicing, main - taining, repairing, and installing electrical equipment in cdun- ection with refrigeration providing they do not make] final connect- ions to electric current unless there is an approved outlet of sufficient capacity available within fifteen feet of the machine to be connected. 1. He shall have had at least two years experience in the in- stallation maintenance and repair of electrical equipment in connection with refrigeration. Examination fee for specialist refrigeration electrician -$3.00 Renewal fee for specialist refrigeration .electricial 1.40 . • "Spseialist Elevator Electrician " , shall be defined to include any individual engaged in the work of installing, repairing, and maintaining electrical equipment and apparatus from the mainline switch in the pent house or machine room, to control electrical equipment for elevators. 1, He shall have had at least two years experience in the in- stallation, maintenace and repair of electrical equipment for elevators. Examination fee for specialist elevator electricians shall be3.. Renewal fee for specialist elevator electricians shall be 1, -7- (G) "Apprentices" shall be defined to include any person, working or serv- ing to learn or be skilled in any branch of the electrical business and cannot perform actual work of installing repairing or maintain- ing electrical wiring or equipment, unless under the direct supervis- Eion of a master, journeyman, maintenance, specialist sign, special - ist refrigerator, or specialist elevator electrician. There shall not be more than one sp prentice under the supervisor of each lic- ensed electrician. Said apprentice is not required to be licensed under this ordinance. (H) "Electrical Contractor" shall be defined to include any person, member and/ or employee of a firm, partnership, or corporation en- gaged in the business of installing, erecting or repairing or contract- ing to install, erect or repair electric wires or conductors to be used for the transmission of electric light, heat or power purposes or to install or repair, mouldings, ducts, raceways or conduit for the reception or protection of such wires or conduits, or any elec trioal machinery, apparatus,,or systems to be used for electrical light, heat, power or signalling purposes operating at a potential of 30 volts or more. Any person, or.a member, and /or employee of a firm, partnership or corporation desiring to engage in the business of "Electrical Contractor" may apply for and be issued a license upon satisfying said Board that he or it is either a Master Electrician or employs a Master Electrician as its superintendent or manager, and shall execute the bond hereinafter provided. Such electrical contractor shall pay a license fee of $75.00 with- in 10 days after becoming eligible therefor which license shall be valid to December 31st, 1947, and 075.00 annually thereafter., pay- able on or before the 36th day of January of each year. Before any person, firm, partnership, or corporation shall engage in the business of electrical contracting as herein defined, the name, residence and place of business1 of such person, firm, partnership, or corporation shall be registered in a book to he kept for that purpose by the Secreatry of the Board of Electrical Examiners and Supervisors, a copy.of which shall at all times be kept on file -8- in the office of the City Electrician of the City of Little Rook. In said book shall also be recorded the name of the Master Elec- trician managing or supervising the business of such person, firm, partnership, or corporation as I superintendent or manager and the date on which such person qualified as a Master Electrician under the terms and provisions of this ordinance. 'shall require immediate notice thereof to the Secreatry of said Board who shall make the proper changes in the record book heretofore mentioned. Every electrical contractor shall promptly report to the Secretary of said Board the deaths resignation or discharge of his or its Master Electrician; and if another master electrician is not secured within three (3) days after the next succeeding.ex- amination held therefor by the Board, the license of such contract- oil shall be suspended until a new licensed master electrician is employed, No licensed master *10atri cian *an represent more thainii one firm ata time. The actual work shall be done by a qualified master or journeyman electrician. "Electrical Sign Contractor" shall be,defined to include any person, firm or corporation engaged in the business of manufacture, install- ations erection and repair Of electrically illuminated or operated signs. They shall be entitled to install the tubing for illumination OL- interior gaseous tube lighting and to make final connection be- tween the transformer secondary wiring and the tube electrode. The primary connection to transformers and signs can be mad6 pr ovided there are sign circuits or outlets of sufficient capacity available within 15 feet of the sign or transformer to be connected. The actual' work shall be done by a qualified., master, journeyman, or special sign electrician. Electrical sign contractor shall pay a license fee of $75.00 within 10 days after becoming eligible therefor to December 31, 1947 and $75.00 annually thereafter on or before the 15th day of Janusy of .each year, for the privilege of engaging in such business. -9- ,w (J) "Electrical. Refrigeration Contractor ", shall be defined` ,to include any person, firm, partnership, or corporation engaged in the business of installing, repairing, or maintaining electrical equipment in connection with refrigeration. They shall be entitled t6 install, maintdLn and replace electrical equipment, make necessary connections to refrigeration equipment, providing they do not make final connection to electric current un- less there is an approved outlet of sufficient capacity available within--fifteen feet of the machine to be connected. Actual work shall be done by master, journeyman, or specialist refrigerator electrician. Electrical Refrigeration - Contractor, chall pay a license fee of $75.00 within 10 days after becoming eligible therefor to December 312 1947, and $75.00 annually thereafter on or before the 15th day of January of each year,fbr the privilege of engaging in such business. (g)_ "Moctrical Elevator Contractor" shall-be defined to include any person, firm, partnership, or corporation engaged in the business of installing, repairing and maintaining electrical equipment and apparatus from the mainline switch located in the pent house or machine room to control all electrical equipment and apparatus for elevators. The actual work shall be done by a qualified master, journeyman, or specialist elevator electrician. Electrical Elevator Contractors license shall be governed by Ordinance No. 2588. SECTION 7. That every person, firm, or corporation holding a license issued by the Board, pursuant to the terms and provisions of this ordinance, shall conform strictly with the ordinances of the City of Little Rock governing the installation, repair, construction and in- spection of electrical work inthe City of Little Rock. SECTION 8. Be it further ordained, that every person, firm or cor- poration doing business in the City of Little Rock as a licensed elec- trical contractor shall file with the City Electrician a -bond in the penal i -10- sum of Five Hundred Dollars 0500.00) with recognized insurance company as surety, authorized to do business in the City of Little Rock, the bond and surety shall be approved by the City Attorney, of Little Rock, the condition of said bond being that the City of Little Rock, for the use Of itself, or any citizen of said City damaged by improper electrical work, lthd conditioned further that the principal shall strictly comply with the ordinances of the City of Little Rock governing such work; that the principal Ull do or suffer no work to be done without a permit, and will report work done for inspection by the electrical inspection department in conformity with the laws and ordinances,of the City of Little Rock. SECTION 9. That no license certificates issued by said Board shall be assignable or transferable. Any license issued may be .suspended or revoked by the Board for any violation.of the terms of this ordinance, or any ordinance governing the installation or inspection of electrical work, or ..any rules and regulations promulgated by the Board after a hear- ing to be held at the convenience of the Board. It shall be unlawful for any person, firm, partnership, or corpor- ation licensed under this ordinance to do any electrical work covered by this ordinance, after the expiration of the license issued, or after the revocation or suspension of such license or to perform any such work with- out a valid license from the City of Little Rock. SECTION 10. Every person, firm, or corporation licensed under this ordinance shall display such license in his or its place of business, SECTION 11. It shall be unlawful for any person, firm, or corporation licensed under this ordinance to alter, transfer, lend orrent his or its license certificate or use a license not his or its own. It shall also be unlawful for any person to falsely represent himself or themselves to be licensed under this ordinance, or to wrongfully use a license issued by said Board. SECTION 12. The City Electrician of the City of Little Rocks Arkansas is hereby prohibited to issue electrical construction permits to any per- son, firm, or corporation other than those licensed under this ordinance, 1 ti -11- except in the event said person, firm, or corporation has a permanent employee who.is a licensed journeyman electrician to install or maintain electrical wires or apparatus in or upon their own prerises. SECTION 13. If any section, subsection, sentence, clause or phrase { this :ordin q + s f s* r _ a , . *p son :..field to. SECTION 14. An person V�&iit3.n an of the t Any P g y provisions of this or- dinance shall, upon. conviction thereof, bedeemed guilty of a misdemeanor and shall- be fined not less than Fifty Dollars ($50 <000) nor more than -Three Hundred Dollars:($300 00), and;each day of such violation shall - constitute: a separate offense. 16. SECTION 16. That new construction in the City of Little Rock is rapidly increasing, and there is inadequate protection furnished the gen- eral public ooneerning electrical wiring in such construction. It is common knowledge that inferior work upon electrical wiring results in fires, log of life and property, and general inconvenience, and unless the provisions of this ordinance are placed into effect immediately the public peace, health and safety will be adversely affected, therefore an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
