7265.R ORDINANCE NO. 7265. AN ORDINANCE CREATING A LEGAL DEPARTMENT IN THE CITY OF LITTLE ROCK, ARKANSAS, ESTABLISHING POS- ITIONS THEREIN, DEFINING THE DUTIES AND RESPON- SIBILITIES OF THE MEMBERS THEREOF, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, the duties of the legal officer of the .city government of the City of Little Rock have increased many fold within the last decade due to the enormous amount of litigation to which the city has been made a party, because of the zoning ordinances, building codes, and other ordinances which have been adopted during that period of time, and WHEREAS, the system under which the City Attorney has been oper- ating has become obsolescent, and the need for the ser- vices to be performed by a legal department have become more pronounced and in demand by the various departments of the city government, BE IT ORDAINED BY THE C 0 CITY COUNCIL OF THE CITY. OF LITTLE ROCK, ARK: SECTION 1. A legal department of the City of Little Rock is hereby established. The duly elected City Attorney shall be the head of such department and shall be responsible for its function- ing and operation. SECTION 2. The City Attorney shall, through said legal department of the City of Little Rock, take charge of and direct the management of all litigation ?i4which the City may be a party or in wb1ch the City may have an interest. The City Attorney shall pro- , ._. + A-a6$to' all cases coming before the Municipal Court of the City of Little Rock to which the City may be a party, and all such cases which may be appealed from said Court. The City Attorney shall re- .present the City ajad all city officials in their official capacity in all legal matters and proceedings in which they may be a party to, or interested in. 0 -2- SECTION 3. The-City Attorney shall advise the Council, or any committee, or member thereof, and the Mayor, and the heads of all departments, and through the Mayor and heads of departments, all other officers or officials of the City upon any and all legal questions affoeting the city's interest. The City Attorney shall approve as to form all contracts, bonds, insurance policies, and /or other documents filed with the City pursuant to the ordinances and :p regulations thereof, which are in the name or are made to, or with the City. SECTION 4. In addition to the above named duties, the City Attorney shall prepare or cause to be prepared in the Legal Department of the City of Little Rock a supplement to the latest digest of ordinances and resolutions of the City of Little Rock. Such supplement to the`digest of ordinances and resolutions of the City of Little Rock shall be made every five (5) years from-and after the effective date of this ordinance, covering the ordinances and resolutions passed during the five (5) years immediately succeed- ing the date of this ordinance. SECTION 5. There are hereby created and established the positions of two (2) Assistant City Attorneys, and the position of Secretary to the City Attorney. The City Attorney shall be paid the same salary as is now fixed by law, and each assistant City Attorney shall receive .a salary in the sum of One Hundred and Seventy Five Dollars ($175.00) per month. The Secretary to the City Attorney and the Legal Department shall receive a salary'of One Hundred and Fifty Dollars ($150.00) per month. The persons to fill the above created positions shall be selected by the City Attorney. SECTION 6. In addition to the duties imposed upon the City Attorney and Legal Department by this ordinance, he shall per- form the duties which are imposed by the general law of the state, beyond the competence of this ordinance to alter or require. SECTION 7.
