7274'W- ___A.,,, ORDINANCE NO._727 AN ORDINANCE TO AMEND ORDINANCE NO. 876, ENTITLED "AN ORDINANCE GRANTING A RIGHT OF WAY OVER CERTAIN STREETS OF THE CITY OF LITTLE ROCK, ARKANSAS, TO THE LITTLE ROCK TRACTION AND ELECTRIC COMPANY FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A STREET RAIL - WAY SYSTEM ", PASSED SEPTEMBER 27, 1901; BY GRANTING TO.CAPITAL TRANSPORTATION COMPANY,.ASSIGNEE OF SAID FRANCHISE,ITS SUCCESSORS AND ASSIGNS, THE EXCLUSIVE RIGHT TO OPERATE TRACKLESS TROLLEYS AND BUSES OVER CERTAIN ROUTES AND STREETS IN THE CITY OF LITTLE ROCK, AND FOR OTHER PURPOSES, BE IT ORDAINED BY THE CITY ROUNCIL OF THE CITY OF LITTLE ROCK: Section 1. That the Capital Transportation Company, assignee of e ranchise embodied in Ordinance No.876, entitled "An Ordinance granting a right of way over certain streets of the City of Little Rock, Arkansas, to the Little Rock Traction and Electric Company for the construction, operation and maintenance of a street railway system ", and the amendments thereto, its successors and assigns, herein referred to as the "Company ", is hereby permitted to discontinue the operation of street cars and the maintenance of tracks, and is granted the exclusive right to operate trackless trolleys and /c buses over the following streets and routes: A. The line known as the Pulaski Heights Line, as follows: Beginning at Fifth and Main, West on Fifth to Victory Street, North on Victory to Third Street, Nest on Third to Summit Avenue, North on Summit Avenue to Second, thence in a Northwesterly direction, follow- ing Second to Markham and Barton Streets, West on Markham to Booker Street, or Stifft Station, and thence following Kavanaugh Boulevard to the inter- section of Kavanaugh Boulevard and McKinley Street, North on McKinley to Beacon, East on Beacon to Cleveland, South on Cleveland to Kavanaugh, and then return to Fifth and Main along same route as outbound. B. The line known as the South Main Line, as follows: Beginning at Fifth and Main, South on Main to Twenty Third Street, West on Twenty Third to Ringo Street, South on Ringo to Twenty Eighth Street, East on Twenty Eighth to Gaines Street, South on Gaines to Thirty Third Street, East on Thirty Third to Arch Street, North on Arch to Twenty Third, thence East returning over same route.to point of beginning. Co The line known as the West Ninth Line, as follows: Beginning at Fifth and Main, South on Main to Ninth Street, West on Ninth to High Street, South on High to Thirty Sixth Street to present bus turn - around and then return over the same route to the point of beginning. D. The line known as the Fair Park Line, as follows: Beginning at Fifth and Main, West on Fifth to Victory Street, South on Victory to Eighth Street, West on Eighth to Wolfe Street, South on Wolfe to Eleventh w Street, West on Eleventh to Park Avenue, South on Park to Thirteenth Street, West on Thirteenth to Lewis Street, North on Lewis to Eleventh Street, West on Eleventh to Madison Street and /or Monroe Street, North on Madison and /or Monroe to Eighth, West on Eighth to present street car loop in Fair Park, thence return to Fifth and Main over the same route. E. The line known as the South Highland Line, as follows: Beginning at Fifth and Main, West on Fifth to Victory Street, South on Victory to Eighth, West on Eighth to Wolfe Street, South on Wolfe to Eleventh Street, West on Eleventh to Park Avenue, South on Park to Thirteenth Street, West on Thirteenth to Woodrow Street, South on Woodrow to Twentieth Street, West on Twentieth to Pine Street, South on Pine to Twenty Fifth Street, West on Twenty Fifth to Washington Street and /or Adams Street, thence North on Washington and /or Adams to Twenty Third Street, thence East on Twenty Third to Cedar Street, North on Cedar to Twentieth, East on Twentieth to Pine, returning to Fifth and Main over same route as outbound. F. The line known as the Fifteenth Street Line, as follows: Beginning at Fifth and Main, South on Main to Fifteenth Street, West on Fifteenth to Pulaski Street, South on Pulaski to Sixteenth Street, West on Sixteenth to Park Avenue, South on Park to Wright Avenue, East on Wright to Summit, South on Summit to Twenty Seventh Street, East on Twenty Seventh to Battery, South on Battery to Twenty Ninth Street, thence return to Fifth and Main over same route. G. The line known as the Oak Forest Line, as follows: During the A.M. and P.M. peak periods of operation the Oak Forest Line will operate as follows: Beginning at Fair Park, which will make connection with the proposed new Fair Park trackless trolley line, West on Eighth Street to Fair Park Boulevard, South on Fair Park Boulevard to Asher Avenue, thence East, following Asher Avenue to intersection of Roosevelt Road, thence East on Roosevelt Road to Park Avenue, North on Park to Twenty First Street, East on Twenty First to Wolfe Street, North on Wolfe to Twentieth Street, East on Twentieth to Broadway, North on Broad- way to Seventh Street, East on Seventh Street to Main, South on Main to Eleventh Street, West on Eleventh to Broadway, thence return over same route to Fair Park Boulevard and Twelfth Street, East on Twelfth to East Jonesboro Drive, thence North to point of beginning. During the base period of operation the Oak Forest Line will operate as follows: Beginning at Fair Park, which will make connection with the proposed new Fair Park trackless trolley line, West on Eighth Street to Fair Park Boulevard, South on Fair Park Boulevard to Asher Avenue, thence East, following Asher Avenue to intersection of Roosevelt Road, thence East on Roosevelt Road to intersection of 2 Roosevelt Road and Summit Avenue, making connection with the West Fifteenth Street bus line, thence returning to Fair Park over same route to Fair Park Boulevard and Twelfth Street, East on Twelfth Street to East Jonesboro Drive, thence North to point of beginning. H, The line known as the West Seventh Street Line, as follows: Beginning at Fifth and Main Street, South on Main to Seventh Street, West on Seventh to Johnson Street, South on Johnson to Lamar Street, West on Lamar to Valentine Street and /or Maple Street, South on Valentine and /or Maple to Eighth Street, West on Eighth to Cedar, North on Cedar to West Capitol Avenue, East on West Capitol to Johnson Street,South on Johnson to Seventh Street, thence following the same route as outbound, to Fifth and Main. I. The line known as the West Markham and Missouri - Pacific Station Line, as follows: Beginning at Fifth and Main, North on Main to Markham Street, West on Markham to Chester Street, North on Chester to Garland Avenue, West on Garland to Victory Street, thence South on Victory to Third Street, East on Third to Cross Street, North on Cross to Markham, East on Markham to Chester, thence following the same route as outbound, to Fifth and Main. J. The line known as the Stifft Station Line, as follows: Beginning at Markham and Pearl Streets, thence West on Markham to Van Buren Street, North on Van Buren to Lee Avenue, West on Lee Avenue to Tyler, South on Tyler to "C" Street, East on "C" to Van Buren, return- ing to Markham and Pearl. K. The line known as the Airport Line, as follows: Beginning at Fifth and Main, South on Main to Ninth Street, East on Ninth to Bond Street, Southeast on Bond to East Eleventh Street and /or Thirteenth Street, East on Eleventh and /or Thirteenth to Harrington Street, North on Harrington to Tenth Street, thence East on Tenth to Picron, thence returning to Fifth and Main over same route. L. The line known as the East Sixth Street Line, as follows. Beginning at North Main and Bridge Street, South on Main to Capitol Avenue, East on Capitol to Ferry Street and /or Rector Avenue, South on Ferry and /or Rector to Sixth Street, East on Sixth to Townsend Street, to the present street car loop, thence returning to point of beginning over same route. 3 M. The line known as the Biddle Shop Line, as follows; Beginning at the present bus loop at Twenty Ninth Street and Confederate Boulevard, North on Confeder- ate Boulevard to Roosevelt Road, West on Roosevelt to Vance Street, North on Vance to East Twenty First Street, West on Twenty First to Rock Street, North on Rock to Ninth Street, West on Ninth to Main Street, North on Main to North Main and Bridge Street, return- ing over same route to point of beginning, with occasional trips across Fourche on the Pine Bluff Highway to about Thirty Seventh and - Confederate Boulevard. N. The line known as the East Fourteenth Street Line, as follows: Beginning at North Main and Bridge Street, South on Main to Fourteenth Street, East on Fourteenth to College Street, South on College to Seventeenth Street, West on Seventeenth to Barber Avenue, North on Barber to Fourteenth, thence returning over same route as outbound, to North Main and Bridge Street. 0. The.line known as the Rock Island Station Line, as follows: Beginning at North Main and Bridge Street, South on North Main to Markham Street, East on Markham to Rector, South on Rector to Second Street, thence East on Second Street to present bus turn- around near Rock Island Station, thence return from Rock Island Station over same route to North fain and Bridge Street Section 2. A. The Company will remove all poles, overhead cables, and other equipment along said routes described in Section 1, which are not necessary to the proper operation of a trackless trolley or motor bus service. The Company is granted the right to install any additional poles, overhead cables, and other equipment necessary to operate trackless trolleys over the routes as described in Section 1 of this Ordinance. B. The Company is granted the right to install any necessary equipment and poles and to operate trackless trolleys and /or buses, along one of the two following routes to be designated by the Traffic Bureau of the Police Department, in order to provide for a loop for said trackless trolleys and buses. First Route: Main Street between Fifth and Fourth, East Fourth Street a een Main and Scott Street, Scott between Fourth and Fifth, and East Fifth between Scott and main. Second Route: East Fifth Street between Main and Cumberland, Cumberland between Fifth and Sixth, East Sixth between Cumberland and Scott, and Scott between Sixth and Fifth. The Company is granted the further right to unite at Fifth and Main any of the lines set forth in Section 1 as may appear advisable to the Company from time to time, in order to provide for the better operation of a continuous transportation system. The Company is also granted the right to install any necessary poles and equipment for the purpose of operating trackless trolleys on High Street between Eighth and Ninth, and on Park Avenue between 4 T . . Thirteenth and Fourteenth. The Company is also granted the right to install any necessary poles and equipment for the purpose of operating trackless trolleys, and is given the right to operate trackless trolleys or buses from Thirteenth and Elm to Twelfth and Elm, and thence from Twelfth and Elm to Twelfth and Lewis, to provide for a turn - around on the Fair Park Line. C. The Company is granted the further right.to use the block b©unded by West Eleventh, Victory, West Twelfth, and High Streets for the purpose of constructing and maintaining offices, shops, and storage facilities in connection with the operation of the transportation system, and is granted the right to use the streets above named, or any of them, for ingress to and egress from said shops and storage facilities, so long as such use does not interfere with the orderly flow of traffic. The right is granted the Company to install any poles, overhead cables, and other equip- ment over and along said streets necessary for trackless trolleys and buses to get into and out of said shops and storage spaces. The Company is granted the further right to use Victory Street from Eighth to Twelfth. for the purpose of getting said buses into and out of said shops and storage spaces. D. The Company is granted the right to construct, maintain and operate a substation on the lot located on the Southeast corner of Twenty Second and High Streets for the purpose of converting Alternating Current to Direct Current, and the Company is given the further right to construct, install and maintain feeder circuits to and from such substation and from the existing substation located at Markham and Elm Streets, for the purpose of providing electric current to the trackless trolley system, and the Company may con- struct such feeder circuits along streets and alleys wherever such installations are required for the proper operation of the system. Ordinance No, 5420 is hereby amended in order to permit the con- struction and operation of a substation on the Southeast corner of Twenty Second and High streets. Section 3, The Company will pave with six inch (6"), 3000 pound, slab concrete, that portion of the present track area of Kavanaugh Boulevard which is now unpaved, beginning at Kavanaugh and "L" Streets and extending to Kavanaugh and Hayes Street, said area being defined as a strip nine feet (91) wide where single street car tracks now exist, and nineteen feet (191) wide where double street car tracks now exist, provided, however, that the Company may pave over with asphalt surfacing averaging one and one- half inches (12 ") in thickness, any existing track set in pavement in said area. The Companyts plans, specifications and supervision are to be approved by the City Engineer, Section 4, The Com any will remove all existing open track (rails no se n pavement, and will pave over all rails now set in pavement, and between said rails, and two (2) feet on the out- side of each outside rail, with an average of one and one -half inches (12 ") asphalt surfacing, the specifications and supervision to be approved by the City Engineer; and the Company will pay to the City (for the Street Maintenance Fund) the sum of Thirty Six Hundred Dollars ($3600.00) annually, beginning June 30, 19480 and on June 30 of each following year during the term of the franchise and the extension thereof as provided in Section 8 of this Ordinance; and the Company will continue to pay annually to the City, during the period of the franchise and the extension thereof as provided in Section 8 of this Ordinance, five percent (5 %) of its gross receipts received from fares paid in the City of Little Rock; and M + v .W , , for such consideration, the City releases the Company from any and all liability or responsibility for the removing of tracks and ties now existing, and from any and all liability or responsibility for the paving or maintaining of any of the routes and streets described in Ordinance No. 876, or any amendments thereto, and in this OrdiaAegs along which the Company has been or, is given the r:L traakle�i� tr�i � r buses,,_ and Section 5. The'd agrees to maintain all streets along said rou es eseribed in Section 1 in a suitable condition for the proper operation of a motor bus and trackless trolley system. Section 6. When the Company-begins operation of buses and trackless trolley's instead of street cars on the routes described in this Ordinance, title to the rails andities on those parts of said lines located on any public street or way, and all rails and ties on any other existing or former routes, spurs, auxiliary lines or sidings located on any public street or way, except those rails and ties not now set in pavement and which will be removed­ by the Company as provided for in Section 4, shall pass to "the City and the Company shall have no further title to said rails and ties, and' the Company shall not be obligated to maintain any of said tracks. Section 7. During the time the repairs and resurfacing on the streeET-Fereinbefore described in this Ordinance are being completed, or during the time the equipment is being installed for the operation of trackless trolleys,.the Company may use the nearest adjacent streets to its regular routes as-will best serve the con- venience of the public, but following the regular routes as nearly as is feasible. Section 8. The operation of buses and trackless trolleys by the Company erein shall be as a part of, or in lieu of, the street car system operated by the Company under the franchise set forth in Ordinance 876, passed September 27, 1901, and the amendments there- to, and the Company, in addition to all rights, privileges and franchises granted to it in the foregoing Ordinances and in all applicable State statutes, is hereby given and granted by the City of Little Rock, a twenty five (25) year extension to the franchise period covered by the foregoing Ordinances. Section 9, All Ordinances and parts of Ordinances in conflict herewith are h by repealed. Section 10. The citizens of Little Rock being without adequate transportation ilities because of the inability of the Company to get certain equipment during the recent war, and the pavement along certain street car tracks being in an unsafe condition because of the Company's inability to get certain materials and labor during the recent war, and this Ordinance being necessary for the preserva- tion of the public peace, health and safety, an emergency is hereby declared and this Ordinance shall take effect and be in force upon its passage and acceptance by the Company, evidenced by its endorse - ment made upon this Ordinance or the record thereof.
