7397r ORDINANCE N0. 7397 AN ORDINANCE TO ALLOW THE NORTH CURB OF KAVANAUGH BOULEVARD BETWEEN HAYS STREET AND THE WEST SIDE OF LOT 153 OF THE FOREST HEIGHTS ADDITION TO THE CITY OF LITTLE ROCK TO BE MOVED EIGHT (8) FEET NORTH OF ITS PRESENT LOCATION, AND FOR OTHER PUR- POSES. WHEREAS, Kavanaugh Boulevard between Hays Street and the west side of Lot 153 Forest Heights Addition has an author- ized width of 60 feet, and WHEREAS, The south half of said Kavanaugh Boulevard consists of a 12 foot side walk and 18 feet of paved street, and WHEREAS, The north half of Kavanaugh Boulevard is partially un- paved but has a curb running parallel to the center line of said boulevard located 18 feet north of said center line, and WHEREAS, The remaining 12 feet on the north side of the 60 foot right -of -way of Kavanaugh Boulevard is presently not be- ing used, and WHEREAS, Kavanaugh Boulevard has developed into a commercial and shopping center and now presents traffic hazards and a congested traffic condition has developed, and WHEREAS, Relief from this condition was sought by many property owners in this vicinity as evidenced by a petition bear- ing the signatures of 500 such property owners, urging that Kavanaugh Boulevard be widened, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARK.: SECTION 1. That the North curb of Kavanaugh Boulevard from Hays Street east to the west side of Lot 153, Forest Heights Addition to the City of Little Rock be set back to a point 26 feet from the center line of Kavanaugh Boulevard, provided, however, that the city shall not bear any of the expenses of moving' said curb, and further provided that the city assumes no obligation to pave that portion of Kavanaugh Boulevard herein described. t . k -2- SECTION 2. That ordinance No. 3939 insofar as it per- tains to the street set out in Section 1 is hereby repealed, and all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. It being determined that a congested traffic condition is caused by the fact that lavanaugh Boulevard between Hays Street and Lot 153, Forest Heights Addition to the City of Little Rock is too narrow, an emergency is hereby declared to exist, and this ordinance shall take effect immediately upon its passage and approval.
