7449ORDINANCE N0. 7449 ORDINANCE PERti2ITTING CONSTRUCTION OF ORDINARY BUILDING AT 1709 EAST NINTH STREET, LITTLE ROCK, ARKANSAS, OF MORE THAN 6000 SQUARE FOOT AREA WITHOUT FIREWALL, AMENDING ORDINANCE NO. 4866, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS: SECTION 1. That Winburn Tile Manufacturing Company owns property located at 1709 East Ninth Street in the City of Little Rock, Pulaski County, Arkansas, and more particularly described as follows: Part Lot 3, Pope's 1000 Acre Grant beginning at the corner of Sections 1, 2, 11 and 12, Township 1 North, Range 12 West, thence North 451.6 feet to south side of Ninth Street, thence East on Ninth Street 463.6 feet to starting point, thence East 100 feet; thence South 303.5 feet to north line of C.R.I.& P.Railroad switch; thence West along railway 103.2 feet; thence North 333 feet to beginning. and in order properly to utilize said property is required to con- struct a building of ordinary or all metal construction for building or storage purposes exceeding 6000 square feet in area without a firewall, but not to exceed 15,000 square feet. SECTION 2. That said property is located outside a congested area of the City. Its construction will not create a hazardous condi- tion since neither this building nor those nearby on said property will be used for combustible occupancy and its construction will not involve use of combustible material in its structural parts. SECTION 3. That Article 4, Section 34, Paragraph 7 of Ordinance No. 4866 be and it is hereby amended for the purpose only of permitting the owner of the above described property to construct an ordinary building or all metal construction building for business or storage purposes as above described exceeding 6000 square feet in area without the necessity of a firewall, but not to exceed 15,000 square feet. That the City Engineer of the City of Little Rock, Arkansas be and he is hereby authorized and directed to issue a permit authorizing its construction. SECTION 4.
