7453ORDINANCE NO._ !} AN ORDINANCE GRANTING A FRANCHISE TO MRS. J. EDWIN LOWE, HER HEIRS OR ASSIGNS, TO PLACE WASTE PAPER METAL RECEPTACLES ON THE STREETS OF THE CITY OF LITTLE ROCK, REPEALING ORDINANCE NO. 7040, PASSED JULY 22, 1946,.AND FOR OTHER PURPOSES, WHEREAS, The unsightly condition of our streets is caused by the indis- criminate throwing of waste paper and other refuse materials thereon, and WHEREAS, There being no waste containers or receptacles on the streets where people may deposit such waste materials, NOW THEREFORE, BE IT ORDAINED RY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The exclusive right and privilege to place metal waste receptacles on the streets of Little Rock in which waste paper and other waste materials may be deposited is here- by granted to Mrs. J. Edwin Lowe, her heirs or assigns. SECTION 2. This franchise shall be for a period of fifteen (15) years and the said Mrs. J. Edwin Lowe, her heirs or assigns, are further granted permission to sell advertising space on the outside of such receptacles, provided however, that no advertis- ements of whiskey, beer, or wine shall be permitted at any time. As a consideration for this franchise, Mrs. J. Edwin Lowe, her heirs or assigns, agree to place upon the streets of the City of Little Rock at no cost to the City, sufficient receptacles in the downtown area in which the people of Little Rock may place waste and refuse ordinarily placed in such receptacles and such receptacles shall be constructed in accordance with the specifi- cations set forth in the petition of J. Edwin Lowe on file in the Office of the City Clerk. The receptacles are to be entirely metal, approximately 45 inches high and 22 inches wide. It shall have an inner metal removeable lining to facilitate emptying. The receptacles shall be anchored to a concrete base for stab- ility and shall be entirely fire proof. I � Sf o -2- SECTION 3. The location of all such waste receptacles shall be approved by the City Engineer and the waste materials deposited in such receptacles shall be removed by the proper authorities of the street cleaning department of the City of Little Rock. SECTION 4. Ordinance No. 7040 passed July 2, 1946 is hereby repealed in its entirety and all ordinances and parts of ordinances in conflict herewith are hereby repealed, and this ordinance shall take effect and be in full force from and after its passage and approval.
