AN ORDINANCE GRANTING TO THE KEMPNER REALTY COMPANY AND /OR THE LESSEES
OF THE NORTH HALF OF LOT ELEVEN, BLOCK SEVENTY -FIVE OF THE ORIGINAL
CITY OF LITTLE ROCK, ARKANSAS,, THEIR HEIRS AND ASSIGNS, FOR A PERIOD
OF FORTY-FIVE YEARS FROY THE 1st DAY OF MAY, 1948, FOR AN ANNUAL RENTAL
OF ONE DOLLAR ($1.00), THE RIGHT TO EXCAVATE AND USE THE SPACE UNDERNEATH
THE SIDEWiALK ALONG AND ADJACENT TO THE EAST SIDE OF THE SAID LOT AND EX-
TENDING TWELVE FEET EAST OF THE WEST LINE OF MAIN STREET.
BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the Kempner Realty Company and/or the lessees
of the North Half (Nr) of Lot Eleven (11), Block Seventy -Five (75), of
the Original City of Little Rock, Arkansas, their heirs and assigns, be,
and they are hereby granted the right to excavate and use the space under-
neath the sidewalk along and adjacent to the East side of said lot and ex-
tending twelve (12) feet East of the West line of Main Street and to con-
struct and maintain therein foundations, footings, structures, and base-
ment of the building which now stands or which may hereafter be erected
on said property, providing that the City of Little Rock reserves unto
itself the right to use all of said area in excess of ten feet from the
property line and to a depth of three feet from the present space of the
sidewalk, for the purpose of laying and maintaining utility pipes and
conduits as a part of the accompanying similar space on adjacent property.
SECTION 2. That the Kempner Realty Company and /or the lessees of
the North Half (Nl],) of Lot Eleven (11), Blook Seventy -Five (75), of the
Original City of Little Rock, Arkansas, their heirs and assigns, be, and
they are hereby granted the right to construct and maintain ventilating
grills level with the surface of the alley along the West side of the East
property line of said property.
SECTION 3. That the Board of affairs of the City of Little Rock,
Arkansas, be, and it is hereby authorized and directed to enter into and
keep a Lease Agreement for the use of the above mentioned area as herein-
after provided for a period of Forty -Five (45) years from the 1st day of
May, 1948, at the annual yearly rental of One Dollar ($1.00).

SECTIOX 4. That all ordinances and parts of ordinances in
conflict herewith are hereby repealed only insofar as they affect
this ordinance.
