AN ORDINANCE APPROPRIATING FINANCIAL AID TO
STREET IMPROVEMENT DISTRICT NO. 567 AND CURB
AND GUTTER IMIPROVEMENT DISTRICT NO. 568 IN
ORDER TO CONSTRUCT A DRAINAGE STRUCTURE WITH
THE IMPROVEMENTS 'JADE BY SAID DISTRICTS WHICH
WILL DRAIN SEVERAL BLOCKS OF PROPERTY IN THE
SOUTHWEST PART OF LITTLE ROCK; FINDING THE
NECESSITY FOR SUCH A STRUCTURE AND AID; DE-
CLARING AN EMERGENCY; AND FOR OTHER PUB POSES.
WHEREAS, Street Improvement District No. 567 and Curb
and Gutter Improvement District No. 568 have been csr ganized for
the purpose of grading, draining, curbing, guttering and paving
West 20th Street from Cedar to Lewis Streets, Lewis Street from
West 20th to West 29th Streets, and West 29th Street from Lewis
to Asher Avenue, amounting to some twelve and one -half blocks of
pavement; and
WHEREAS, each district is limited by law to an expendi-
ture of forty per centum (409) of the assessed valuation of the
property in each district, and the total which both districts are
allowed to spend according to their said assessed valuation amounts
to $47,000, which is actually 809 of the assessed valuation of the
property in the area to be improved; and
WHEREAS, there runs along Lewis Street for some six
blocks a large open drainage ditch which drains approximately
100 olty blocks in the southwest part of the City of Little Rock,
and said ditch has in the past, due to large and heavy rains,
enlarged itself until it has in some parts of it, washed away
abutting property, including parts of Lewis Street and the property
of private owners; and
WHEREAS, it is necessary that this ditch and the waters
running through it be confined to prevent further erosion and
flodding and to insure proper drainage before it would be safe
and possible to pave Lewis Street, and the estimated cost of
confining this ditch and its waters to concrete pipe would amount
to 417,169.50, and said districts can spend only $5000 of this
amount and pave the streets also and keep within their statutory

limit of expenditures, leaving a total of $12,169.50 needed to
complete their improvements; and
WHEREAS, it would be grossly unjust and unfair to require
twelve and one -half blocks of property owners to pay for a drainage
structure that would benefit some 100 city blocks of the city; and
WHEREAS, it is possible that the cost of improving the
streets in said district will not amount to the present estimated
cost and that said districts may be able to contribute more than
45000 to the drainage costs; and
WHERE AAS, said districts have agreed to expend the full
amount to which they are limited in making said improvements and
to contribute to the cost of said drainage all amounts within
said legal limit over and above the cost of grading, curbing,
guttering and paving said streets, and in consequence the amount
required in aid from the City of Little Rock may be reduced if the
cost of improving said streets does not amount to the present
estimate of cost; and
WHHEREAS, the City of Little Rock should correct and
improve this faulty drainage condition for the benefit of some
100 city blocks of citizens;
NOW, THEREFORL, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF LITTLE ROCK, AM ANSAS:
SECTION 1. There is hereby appropriated from any funds
whatsoever of the City of Little Rock available for this purpose
the sum of Twelve Thousand One Hundred Sixty -nine and 50/100
Dollars (�12,169.50) , to the use and benefit o f.. S. -t .,x a e: t
Improvement District No. 567 and Curb and Gutter Improvement
District No. 568, both of the City of Little Rod; to be used in
whole or in part in constructing a drainage structure along and
under Lewis Street between West 20th and 'vest 29th Streets and
along and under that portion of West 29th Street to be improved
by said Districts.

SECTION 2. Due to the fact that tine City of Little
Rock is in dire need of improved streets in this southwestern
portion of the city, and due to the present and urgent necessity
of proper drainage along Lewis Street to prevent the further
flooding and erosion of private and public property, and due to
the hazard Lewis Street constitutes to fire - fighting equipment,
an emergency is hereby declared to exist, and this ordinance
shall take effect and be in force immediately from and after its
passaLe.
