8097.. -. 4 _ - ,IV ORDINANCE N0. 8 AN ORDINANCE GRANTING A RIGHT OF WAY TO CAPITAL TRANSPORTATION COMPANY THROUGH BLOCKS 11 AND 22, CUNNINGHAM'S ADDITION TO THE CITY OF LITTLE ROCK; PROVIDING FOR CERTAIN LIMITED USES OF THE SAID RIGHT OF WAY;. PROEUITING. OTHER USES OF THE SAID RiGAV OF" `'wir MOLARING PROEIBMD USES OF THE RIGHT OF WAY TO BE A MISDEMEANOR AND PRESCRIBING THE PENALTY THEREFOR; AND FOR OTHER PURPOSES. WHEREAS, it is to the beat interest of the City of Little Rock, Arkansas and the public thereof that Capital Transportation Company, a corporation, operate its trolley coaches, busses and other vehicles used for the purpose of transporting passengers on the line authorized and described in Ordinance No. ?373 as the "Fair Park Linea down West Eleventh Street and across private right of way to its turn - around in War Memorial Park, rather than down West Twelfth Street and North on Jonesboro Drive to the said turn- around; and WHEREAS, in order to route the said line and vehicles operating thereon West on hest Eleventh Street It is necessary for the said Capital Transportation Company to obtain a private right of way from West Eleventh Street to West Eighth Street; and WHEREAS, the City of Little Rock is the owner of Blocks 11 and 229, Cunningham's Addition to the City of Little Rock, Arkansas, through ehich the said right of way must run; and WHEREAS, it I$ to the advantage of the City of Little Rock to grant to the Capital Transportation Company a right of way across the two said blocks of land in order to obtain the above described routing of the said Fair Park line of the said Capital Transportation Company; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Sec. 1. That a right of way for the purpose of constructing, surfacing, repairing and maintaining a road bed, roadway and street for the operation of public transportation vehicles and the erection and installation of poles, wires, cables, guys, supports and other equip- ment for the transmission of electric current and messages, together with the conducting of any other lawful activities in connection with the business of Capital Transportation Company, be and it is hereby granted and conveyed unto the Capital Transportation Company over, across and upon the following described strip of land, to -wit: The East 10 feet of a strip of land originally platted and dedicated as an alley in Block 11, and the Hest 40 feet of Lots 7, BP 92 109 11 and 12, in Block 11, Cunningham's Addition to the City of Little Rock, Arkansas; The Bast 10 feet of the North 100 feet of the strip of land originally platted and dedicated as an alley in Block 22, and the best i}0 feet of Lots 11 and 12, in Block 22, Cunningham's Addition to the City of Little Rock, Arkansas; A strip of land 35 feet wide across that portion of Block 22 originally platted and dedicated as an alley, and across Lots 7, 8, 9 and 10, all in Block 22, Cunningham's Addition to the City of Little Rock, Arkansas, the center line of which 35 -toot strip is more particularly described as follows: Beginning at a point on the line between Lots 10 and 11, Block 229 which point is 15 feet East of the West common corner of Lots 10 and 11, Block 22; thence South, along a line, 15 feet from and parallel to the West line of Lot 10, Block 22, for a distance of 17.4 feet; thence by a curve to the left, the center line radius of which is 210.78 feet, for a distance Of 210 feet, more or less, to a point on the West line of Monroe Street extended South, at West Eleventh Street, all of the above is Cunningham's Addition to the City of Little Rock, Arkansas. Sec. 2. When Capital Transportation Company has constructed a roadway upon and over the right of way described in Sec. 1, and upon and over its private right of way in Block 6 Cunningham's Addition, the said roadway shall be a private - 2 - . 1 .r 0 , drive for use of vehicles and equipment of Capital Transportation Company and of other persons serving Capital Transportation Company, and for the use of vehicles owned by persons who may now or hereafter own residences situated on lots abutting on the said road - way and other persons performing services to those residences. The Traffic Bureau of the Police Department shall erect appropriate signs at each point where the said private roadway intersects or enters an opened or traveled public street, indicating that the said roadway is a private drive and that use thereof by the general public is prohibited. Sec. 3. Any use of the roadway described in Sec. 2, by any person, vehicle or equipment, except those uses permitted in Sec. 29, is hereby prohibited. Any person violating the provision of this section shall be guilty of a misdemeanor and shall be fined in a sum not less than $5.00 nor more than $25.00. Sec. k. The Mayor and City Clerk of the City of Little Rock be and they are hereby authorized and directed to execute the proper instrument in writing, granting and conveying unto said Capital Transportation Company the right of way hereinabove described.
