8191LOY ORDINANCE NO. 8191 AN ORDINANCE DECLARING THE BUSINESS OF FREE TRI1,1MING AND TREE SURGERY TO BE A PRIVILEGE, PROVIDING A TAX FOR EN- GAGING IN ThE BUSINESS, ESTABLISHING AN EXAMINING COMM- ITTEE TO LICENSE SUCH PERSONS, DECLARIN G AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, Various persons, firms, and corporations within the City of Little Rock are engaging in the business of tree trim- ming and tree surgery without adequate knowledge necessary to en- gage in such business, and WHEREAS, Such persons are mutilating trees of the City of Little Rock and as a result thereof such trees are dying and de- caying, bringing about an unsightly and dangerous condition, YOV; THEREFORE, BE IT ORDAIT1ED BY THE CITY COUNCIL Or THE CITY OF LITTLE ROCK, ARKANSAS: SECTICIN 1. The business of tree surgery, or the business of cutting, pruning, trimming, and the performing of any of such acts upon any trees within the City of Little Rock is hereby de- clared to be a privilege, and no person, firm, or corporation shall engage in such business withcut first having secured a license therefor from the City Collector of the City of Little Rock. SECTION 2. The Mat,or shall immediately upon the effective date of this ordinance, appoint a cor:unittee of three (3) persons who shall be citizens of the City of Little Rock with a knowledge of and well versed in the manner in which trees should be trimmed, cut or pruned, and such committee shall e;amine all persons making an application for a license to engage in such business and cer- tify the results of such examinaticn to the City Collector of the City of Little Rock, stating to the City Collector whether or not such person is qualified to engage in such business. SECTION 3. No person shall be granted a license by the City Collector of the City of Little Rock until he has been certified as being competent to engage in such business without destroying the trees upon which he ray work. SECTION 4. The persons composing such committee shall be appointed by the i,Tayor for f! term co- extensive with his term of office, and they shall serve until their terms of office expire, and their successors are duly appointed. SECTION 5. Any person, firm, or corporation granted a li- cense by the City Collector to engage in such business shall pay to the City Collector the sum of X5.00 per annum for the privilege of angaging in such business. SECTION 6. Any person engaging in such business without the procuring of a license therefor shall be deemed guilty of a mis- deneanor and upon conliction thereof shall be fined any sum not less than w25.00 nor more than $100.00. SECTION 7. All ordinances and parts cf ordinances in con- flict herewith are hereby repealed. Unless the provisions of this ordinance are put into effect immediately, the peace, health and safety of the citizens of the City of Little Rock will be ad- versely affected; therefore, an emergency is hereby declared to exist, . and this ordinance shall be in full force and effect from ana after its passage and approval.
