AN ORDINANCE AILENDING ORDINANCES NOS. 5452 and 7618
GRANTING THE OWNERS OF LOT 12 AND THE NORTH ONE -HALF
OF LOT 11, BLOCK 75 OF THE ORIGINAL CITY OF LITTLE
ROCK TEE RIGHT TO EXCAVATE AND USE THE SPACE UNDER THE
SIDEWALKS ADJACENT TO SAID PROPERTY BY DELETING THE
PROVISION IN EACH ORDINANCE RESERVING THE RIGHT OF THE
CITY TO BUILD UTILITY LINES AND CONDUITS IN SAID SPACE;
ATTTIE�ORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE gl,''!,TTDATORY LEASE AGREEMENTS TO CARRY OUT THE
PROVISIONS OF THE ORDINANCE, AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF ThE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That Section 1 of Ordinance No. 54522 passed
May 17, 1937, granting the owners of Lot 12, Block 75 of the
Original City of Little Rock the right to excavate and use the
space under the sidewalks adjacent thereto, is hereby amended
b�r,deleting therefrom the portion reading as follows:
It • . provided, that the City of Little Rock reserves to
itself and assigns the right to use all of said area in
excess of ten feet from said property lines and to a depth
of three feet from the present surface of the sidewalks,
for the sole purpose of laying and maintaining public util-
ity pipes, and conduits as a part of the system occupying
Similar space on adjacent property."
SECTION 2. That Section 1 of Ordinance No. 7618, passed
April 26, 1948 granting the owners of the North One -half of
Lot 112 Block 75 of the Original City of Little Rock the right
to excavate and use the space under the sidewalks adjacent there-
to:, is hereby amended by deleting therefrom the portion reading
as follows:
"• . .providing that the City of Little Rock reserves unto
itself' the right to use all of said area in excess of ten
feet from the property line and to a depth of three feet
from the present space of the sidewalk, for the purpose of
laying and maintaining utility pipes and conduits as a part
of the accompanying similar space on adjacent property."
SECTION 3. That the Mayor and City Clerk are hereby auth-
orized and directed to execute amendatory leases to carry out the i
Provisions of this ordinance.
SECTION 4. All ordinances and parts of ordinances in con-
flict herewith are hereby repealed, and this ordinance shall be
in full force and effect from and after its passage and approval.
