3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY CLERK AND
4 CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS,
5 CONVEY CERTAIN REAL PROPERTY AND A TEMPORAY
6 CONSTRUCTION EASEMENT LOCATED ALONG A PORTION OF
7 CANTRELL ROAD IN THE CITY OF LITTLE ROCK, ARKANSAS, TO
8 THE ARKANSAS HIGHWAY AND TRANSPORTATION DEPARTMENT
9 FOR A ROADWAY IMPROVEMENT PROJECT; AND FOR OTHER
10 PURPOSES.

WHEREAS, the Arkansas Highway and Transportation Department is undertaking a street widening
project along State Highway 10, Cantrell Road between Mississippi Avenue and the Perryville Road,
which will necessitate the acquisition of real property and temporary construction easements from the
City and the reconstruction of a driveway on land owned by the City at Fire Station 12; and,
WHEREAS, the Arkansas Highway and Transportation Department has offered to pay the City fair
market value for the property and easements needed from the City to accomplish the construction; and,
WHEREAS, the City Board of Directors has determined that it is in the best interests of the City and
its inhabitants for the City to sell the property needed by the Arkansas State Highway Department for the
street widening project;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. The Mayor, City Clerk, and City Manager are hereby authorized to execute, in a form
approved by the City Attorney, any documents required to sell and convey to the Arkansas State Highway
Department for the total sum of Twenty Thousand, Six Hundred Dollars ($20,600.00) certain lands
located in the Pulaski County, Arkansas, more particularly described as follows:
Parcel 1: Part of Block 5 of Plunkett's Subdivision of Forest Park to the City of Little Rock,
Township 2 North, Range 13 West, Pulaski County, Arkansas, more particularly described as
follows:
Commencing at a point being used as the Northwest corner of Lot 6 of Abram's
Subdivision of Block 6 of Plunkett's Subdivision of Forest Park; thence North 01° 50' 09"
East a distance of ten (10) feet to a point on the Southerly right -of -way line of Kentucky
Avenue as established by the Plat of Plunkett's Subdivision of Forest Park recorded in Plat

1 Book 1, Sheet 32; thence North 86° 56' 26" West along said right -of -way line a distance of
2 274.24 feet to the POINT OF BEGINNING; thence South 10° 12' 55" West a distance of
3 15.16 feet to a point on the Northeasterly right -of -way line of Arkansas State Highway 10 as
4 established by AHTD Job 6189; thence North 48° 44' 24" West along said right -of -way line a
5 distance of 24.32 feet to a point on the Southerly right- of- way line of Kentucky Avenue as
6 established by the Plat of Plunkett's Subdivision of Forest Park recorded in Plat Book 1,
7 Sheet 32; thence South 86° 56' 26" East along said right -of -way line a distance of 21.00
8 feet to the point of beginning and containing 158 square - feet, more or less as shown on
9 AHTD plans referenced as Job 061194.

Commencing at a '/2 -inch rebar being used as the Northwest corner of Lot 1 of
Block 2 of Riffel and Rhoton's Forest Park Highlands Addition, which is also on the
Southerly right -of -way line of Kentucky Avenue as established by the Plat of Riffel and
Rhoton's Forest Park Highlands Addition as recorded in Plat Book 1, Sheet 18; thence South
87° 19' 59" East along said right -of -way line a distance of 94.63 feet to a point on the
Southwesterly right -of -way line of Arkansas State Highway 10 as established by AHTD Job
6189; thence South 48° 44' 24" East along said right -of -way line a distance of 99.77 feet
to the POINT OF BEGINNING; thence continue South 48° 44' 24" East along said right -of-
way line a distance of 97.21 feet to a point; thence South 01 ° 45' 05" West a distance of
6.87 feet to a point on the Southwesterly right -of -way line of Arkansas State Highway 10
as established by AHTD Job 061194; thence North 48° 30' 43" West along said right -of-
way line a distance of 97.53 feet to a point; thence North 01' 45' 05" East a distance of
6.36 feet to the point of beginning and containing 496 square -feet, more or less as shown on
AHTD plans referenced as Job 061194.
Temporary Construction Easement: an exclusive temporary right -of -way and temporary
easement for the sole purposes necessary for Highway construction, together with free ingress
and egress, to, across, through and over the lands shown on the Right -of -way Plans for Job
No.061194, and designated as Tract No. 21 situated in the County of Pulaski, State of
Arkansas. This temporary easement as conditioned above shall terminate when the above subject
job has been completed by the contractor and accepted by the Arkansas State Highway Commission.

Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
