NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the approval of Cantrell Falls Revised Long -Form PCD (Z- 7603 -G), located at 2 14910 Cantrell Road, is subject to compliance with the following additional conditions: 3 • That the preliminary site development plan /plat be approved as submitted, including 4 all staff comments and conditions as outlined in the Planning Commission Agenda 5 Staff Report in paragraphs D, E, F and including any conditions indicated in the staff 6 analysis in paragraph H and subject to additional conditions imposed at the Planning 7 Commission Public Hearing as amended by the applicant. 8 • The allowed uses for Lots 3 and 4 are uses as allowed in the C -1, Neighborhood 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Commercial Zoning District. Lot 3 is allowed the placement of an auto care facility limited to All About Tire and Brake. Uses for Lot 2 are limited to the 0-3, General Office Zoning District, with the allowance of the permitted accessory uses. • The hours of dumpster service and the service hours of the supplies are limited to daylight hours. • The hours of operation for the development are from 6:00 AM to midnight, seven (7) days per week. The hours of operation for All About Tire and Brake is limited to 7:00 AM to 7:00 PM, Monday through Saturday. • An earthen berm will be provided along the Cantrell Road frontage within the forty (40) -foot landscape strip constructed to a minimum height of forty-two (42) inches measured from the average grade of the site. • The forty (40) -foot landscape strip along Cantrell Road will include an earthen sculpture and a stone water feature and will be landscaped per the typical standards of the Highway 10 Design Overlay District. Section 3. That the preliminary site development plan /plat be approved as recommended by the Little Rock Planning Commission. Section 4. That the change in zoning classification contemplated for Cantrell Falls Revised Long - Form PCD (Z- 7603 -G), located at 14910 Cantrell Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. 29 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 30 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 31 necessary to affect and designate the change provided for in Section 1 hereof. 32 Section 6. That this ordinance shall not take effect and be in full force until the final approval of the 33 plan. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section S. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
