BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKATJSAS : SECTION 1. POLICY AND PUPPOSE (a) By reason of the existing and increasing possibility of the occurrence of disaster of unprecedented size and destructiveness resulting from enemy attack, sabotage, or other hostile action, or from fire, flood, tornado, cyclone or storm, or other natural causes, and in order to.insure that preparations of this city will be adequate to deal with such disasters and generally to provide for the common defense, and to protect the public peace, health, safety, and general welfare, and to preserve trz lives and property of the people of the city, it is hereby found and declared to be necessary: (1) to create a Little Rock Civil Defense Committee; (2) to designate the I.ayor as Director of Civil Defense and to confer upon other executive heads of the city certain emergency porters provided herein; and (3) to provide for the rendering of cooperation and mutual aid, if necessary, to surrounding and contiguous political subdivisions of the state. (b) It is further declared to be the purpose of this ordinance and the policy of the City of Little Rock that all civil defense functions of the city be coordinated to the maximum extent with aqm- parable functions of the State of Arkansas and of the Federal Govern- ment including its various departments and agencies, and other states and localities, and of private agencies of every type, to the end that the most effective preparation and use can be made of the city's manpower, resources, and facilities for dealing vrith any disaster that may occur. SECTION 2 - DEFINITIONS "Civil Defense" shall wean the prepa rati on for and the carrying out of all emergency fu noti ons, other than bancti ons for which the mili- tary forces are priaarily responsible, to minimize and repair injury and damage resulting from disaster caused by enemy attack, sabotage, or other hostile action, or by fire, flood, earthquake, tornado, cyclone, storm, or other natural causes, These functions include, without limitations, by reason of enumeration, fire fighting service, police service, medical and health service, rescue, engineering, air raid warning service, oommu- nioation, radiological, chemical, and other special defense weapons# evacuation of persons from stricken areas, emergency welfare service„ civilian war aid service, emargenoy transportation, existing or properly assigned ftinotions for plant.proteotion, temporary restoration of public utility service, and other functions relating to civilian protection, tgg9%h.w xlth all other activities necessary or incidental to the prep- aration fw any carrying out of the foregoing f uaotionse SECTION 3 - LIME ROCK CIVIL DEFENSE COM AITTEE (a) There is hereby created within the office of the Mayor a committee of civil defense, hereinafter called the "Civil Defense Comittee; to include, but not limited to mambers of the City Council and one person or persons representing each of the following organizations, such person or parsons to be selected by the respective organization. Fire Department Police Department Health Department Street Department Building Inspector Local Red Cross Chapter Army Advisory Committee All Veterans Organizations Volunteer Societies Industrial Plants Labor Organizations Civic Organizations Ham Radio Operatmrs Ladies Auxiliaries Doctors and Nurses Civilian Air Patrol District Offices of the State Churches (2) (b) The Mayor shall immediately request all of the above groups to select a representative from their respective organizations to serve as members of the Civil Defense Committee, =o) The Executive Secretary of the Mayor shall be the Executive Secretary of the Little Rook Civil Defense Committee and shall serve in place of the Mayor during his absence from the city. (d) The Mayor nay employ from the Civil Service roster such necessary clerical, stenographic and other personnel to carry out the p1rovisions of this ordinance subject to the consent and approval of the City Council. (e) The Mayor shall designate certain of the space available at the City Hall for the use of the Civil Defense Committee and members Vhereof, and shall provide needed furniture, equipment, supplies, sta- tionery, and printing in the same manner as provided for personnel of other city depa rtment s and agencies. (f) The Mayor shall be the executive head of the Civil,Defenee Committee mad s% 11' be responsible for darrying out the program for civil defense in the city. He slue coordinate the activities of all organizations for civil defense within the city, and shall maintain liaison with and cooperate with civil defense agencies and organizations of other political subdivisions and of the State of Arlansas and other states of the Federal Goverrent, and shall have such additional authority, duties and responsi- bilities as are authorized by this ordinance and as may from time to time be provided by the City Council. SECTION 4 - CIVIL DEFENSE COILAITTEE The Mayor shall serve as chairman of the committee and the members shall serve without oanpensation but may be reimbursed for reasonable and necessary expenses incurred in the performance of their duties with the appro- val and consent of the City Council, excepting that in case of an emergency the Mayor may d Jr eot reimbursement of members of the committee and other members of the Civil Defense organization from Civil Defense funds made available by the City Council. (3) SECTION 5. CIVIL DEFENSE P017ERS OF THE I:IAYOR (a) The Mayor shall have general direction and control of the Civil Defense Committee, and shall be responsible for the carrying out of the provisions of this ordinance. (b) In performing his duties under this ordinance, the mayor is authorized to cooperate with other political subdivisions, with other states, with the Federal Government, and with private agencies in all matters pertaining to civil defense of the city, state and nation. (c) In performing his duties under this ordinance, the Mayor is further authorized and empowered: 1. To make, amend, and rescind the necessary orders, rules, and regulations within the limits of the authority conferred upon him here- in, and v!ith due consideration to the plans of the State of Arkansas and the Federal Government, as well as the plans of other political subdivisions for civil defense. 2. To prepare, or cause to be prepared by and with the advice of the Civil Defense Committee, a comprehensive plan and program for the civil defense of the city, such plan and program to be integrated into and coordinated with the civil defense plans of the Federal Government, or other subdivisions, of the State of Arkansas, and with other states to the fullest possible extent. 3. In accordance with such plan and program for civil defense of this city, to procure, or cause to be procured supplies and equipment, to institute, or cause to be instituted, training programs and public information programs, and to take, or cause to be taken, all other preparatory steps including the partial or full mobilization of civil defense organizations in advance of actual war or disaster to insure the furnishing of adequately trained and equipped forces of civil defense personnel in time of need. 4* To make, or cause to be made, by and with the advice of the Civil Defense Committee, such studies and surveys of the industries, resources, and facilities in this city and surrounding political sub- divisions as may be necessary to ascertain the capabilities of the city for civil defense and to plan for the most efficient emergency use thereof. 5. To declare by proolamation or executive order a state of emergency and the termination tforeof unless the Council by resolution or ordinance shall sooner declare the termination of th3 state of emergency. SECTION 6 - I&YOR MAY AUTHORIZE EXPENDITURES WITHIN LIMITATION IN CARRYING OUT THE PROVISIONS OF THIS ORDINANCE The Mayor shall have the power, daring time of disaster as des- oribed in Section 1, to enter into contracts and incur obligations necessary to combat such disaster, protecting the lives and safety of persons and property and providing emergency assistance to the victims of such disaster, The Mayor shall, however, be limited to the amount appropriated by the Council and set aside as a Civil Defense Fund. In no event shall the liability of the City of Little Rook under any circumstances exceed the fair and reason- able value of the services rendered or supplies and equipment furnished or materials furnished, SECTION 7 - MUML AS ARRAS s (a) It is recognized that- it is imperative that the first mutual aid pact developed shall be in cooperation with the city of North Little Rook and the surburban area of Pulaski County for the mutual protection of life and property of the citizens of this area. The Mayor shall meet with the Mayor of North Little Rook and Judge of Pulaski County for the purpose of seeking establishment of a Pulaski County Defense Plan. The Mayor is hereby empowered to join with the Mayor of North Little Rook and the Judge of Pulaski County in the selection of a resident of Pulaski County to be designated as the Civil Defense Chairman or Director of the County, who will oo- ordinate the Little Rock, North Little Rook, and Pulaski County Defense Plans. (b) The Mayor shall, subject to the approval of the Council, enter into mutual aid arrangements with civil defense agencies or orgbnizations in other political sub - divisions or in the State of Arkansas or in other states for reciprocal civil defense aid and assistance in case of war or disaster too great to be dealt with unassisted. (5) 4 � � SECTION 8 - APPROPRIATION AND AUTHORITY TO ACCEPT SERVICES, GIFTS, GRANTS, AND LOANS (a) The City Council may appropriate from time to time such matey as may be necessary for the carrying out of the purposes of this ordinance. (b) Whenever the Federal Goverruaeat or the State of Arkansas, or any agency or officer thereof, or any person, firm, or corporation, shall of fer to the city or to the Civil Defense Corwnittee services, equipment, supplies, materia is or Hinds by way of gift, grant, or loan for purposes of civil defense or disaster relief, the city, acting t hro ugh the Mayor, may accept sus h of fer , and upon s uoh acceptance the Mayor uay authorize any of- ficer of the city to receive such services, equipment, sa pplies, materials, or Hands on behalf of the city, and subject to the terms of the offer and the rules and regulations, if any, of the agency making the offer. Such accept- ante, however, shall not create any liability on the part of the city, Civil Defense Committee, or any officer $ agent, or employee thereof for failure to comply with the terms of such offer end the rules and redone# if any, of the agency caking the offer, SECTION 9 - UTILIZATION OF EXISTING SERVICES AND FACILITIES In carrying out the provisions of this ordinance, the Mayor is directed to utilize the services, equipment„ supplies, and facilities of the existing departments, bureaus, offices, commissions, committees, au- thorities, and agencies of the city to the maximum extent practicable, and the officers, agents, employees, and personnel of all such departments, bureaus, offices, commissions, caanmittees, authorities and agencies of the city are directed to cooperate with and extend such services and facil- ities to the Mayor and to the Civil Defense Committee of the city upon re- quest, of the Mayor, SECTION 10 - POLITICAL ACTIVITY PROHIBITED No person employed pursuant to this ordinance shall participate in any fora of political activity. (6) � a SECTION 11 - CIVIL DEFENSE PERSONNEL: LOYALTY No person shall be employed or associated in any civil defense committee, organization, or activity established under this ordinance -pho advocates, or has advocated, a charge by force or violence in the oansti- tutional form of the Government of the United States, known herein as the Federal Government, or in this state, or the overthrow of any government in the United States by force or violence, or who has been o onvi.cted of or is under indictment of information charging any subversive act within the United States. Each person who is appointed to serve in an organiza- tion or committee for civil defense shall, before entering upon his duties, take an oath, in writing, before a person authorized to administer oaths in the State of Arkansas, which oath shall substantially be as follows: "I, , do solemnly swear (or affirm) that I will support and defend the constitution of the United States and the constitution of the State of Arkansas against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties on which I am about to enter. And I do further swear (or affirm) that I do not advocate, nor am I a member of any political party or organ- ization that advocates the overthrow of the Government of the United States or of this State by force or violence; and that during the time as I am a member of a Civil Defense Committee, I will not advocate nor become a member of any political party or organization that ad- vooates the overthrow of the Government of the United States of America or of this State by force or violence." SECTION 12 - SEBILITY If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or application of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable, (7) SECTION 13 - ENFORCEMENT It shall be the duty of pursuant to this ordinance, and of the Mayor and all officers, agents, em- ployees and personnel to execute and enforoe such orders, rules and regulations as may be made by the Mayor with the consent and approval of the Council, SECTION 14 - PEW -`LTY Any person violating any of the provisions of this ordinance or any rule, order or regulation made pursuant to this ordinance shall, upon om- viction, be punishable by a fine of not exceeding Three Hundred Dollars 0300,00), or, in default of payment thereof, by imprisonment not exceeding ninety days in the c as my jail. SECTION 15 - EFFECTIVE DATE All ordinances in conflict herewith are hereby repealed, and unless the provisions of this ordinance are placed into effect at once, the peace, health and safety of tbe oitisma at this city riill --be adrwcsely affe0t4kd.
