AN ORDINANCE DEDICATING CERTAIN CITY PROPERTY TO PUBLIC UTILITY PURPOSES
AND IN CONNECTION THEREWITH ALSO TRANSFERRING CERTAIN CITY PROPERTY TO
THE BOARD OF COMMISSIONERS OF THE LITTLE ROCK MUNICIPAL WATER WORKS FOR
THE CONSTRUCTION OF A STORAGE TANK TO BECOME PART OF THE CITY WATER SYSTEM
FOR THE USE OF THE LITTLE ROCK MUNICIPAL WATER WORKS AND FOR OTHER PURPOSES.
WHEREAS, The Housing Authority of the City of Little Rock, Arkansas,
is constructing Little Rock Housing Project No. 4 -4 on Granite Mountain near
Gillam- Park, and there being no utilities in the immediate vicinity, it is
necessary that gas and water pipelines, appVft03 ndse, and
utilities, be constructed on, over, and through property owned by the City of
Little Rock and known as Gilliw Park, in order to extend existing mains and
facilities to said Project 4 -4, and;
WHEREAS, There is insufficient water pressure in the available water
main in this area to furnish adequate water supply to said project and adjoin-
ing territory making it necessary that the Little Rock Municipal Water Works
erect a storage tank and connecting line near said project and, for that pur-
pose, requires a high location for said tank and a right -of -way for a pipeline
to connect said tank with the Little Rock Water System, and;
WHEREAS, The City owns a site and property not used for other purposes
suitable for the location of said tank and connecting pipe and for the location
of the equipment of all other utilities, and all necessary accessories and attach-
ments and appurtenances; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section I. A strip of ground twenty (20) feet in width along the
entire East side of the property now owned by the City of Little Rock in Sections
23 and 26, Township 1 North, Range 13 West, Pulaski County, Arkansas, and known as
Gillam.Park, is hereby dedicated for use by all utilities and each public utility,
its successors and assigns, which now or hereafter shall make use of said dedi-
cated area, shall have the free use of said property for any purpose deemed
necessary by the public utility, and shall have full right of ingress and egress
to, on, and over said dedicated area at all times for the operation, maintenance,
installation, repairs, servicing and removing of equipment on condition that on
making an excavation or otherwise disturbing the ground surface, it shall replace
the ground surface in substantially the same condition as existed prior to any
such excavation.

Section 2. In consideration of the Board of Commissioners of
the Little Rock Municipal Water Works constructing a tank and connecting
pipe to the municipal water system upon a plot of ground fifty (50) feet
square, the same be and is hereby granted, transferred and delivered to
the Board of Commissioners of the Little Rock Municipal Water Works for its
exclusive use in erecting a storage tank and for such other uses as are
necessary and convenient for the Little Rock Municipal Water Works to supply
water in adequate quantities to said project b-4 and surrounding territory
of the City, said ground being more particularly described as follows:
Beginning at a point 1500 feet North of the Southeast corner
of Section 23, Township 1 North, Range 12 West; thence North
along the East boundary of said Section a distance of 50 feet;
thence West 50 feet; thence South 50 feet; thence East 50 feet
to the point of beginning.
Section _3 . All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section k . It is.found and declared that the erection of the
houses in Little Rock Housing Project No. /+ -/+ havinjg already begun and
steel for tanks being restricted and scarce, and water and other utilities
being needed for uee as soon as the houses are eompleted, therefore an
emergency exists and is hereby declared, and for the immediate preservation
of the public peace, health and safety, this Ordinance shall take effect
from and after its passage.
