8700ORDINANCE NO 8700 AN ORDINANCE VACATING STREETS AND UTILITY EASEMENTS OF BINIORIS SUBDIVISION DEDICATED BY BILL OF ASSURANCE DATED MARCH 2, 1951s OF RECORD AT PAGES 56 -57 OF BOOS 4.55 IN THE PULASKI COUNTY RECORDERS OFFICE, PROVIDING FOR A CERTIFIED COPY OF THIS ORDINANCE BEING PLACED OF RECORD IN SAID RECORDLMS OFFICE, AND FOR OTHER PURPOSES- Whereas, a petition was duly filed with the City Council the City of Little Rock, Arkansas# on dune 25, 1951, asking the City Council to-vacate and abandon three strips of land lying wholly within the bounda�iasof BINIORESI SUBDIVISION of Lot 8, Block 2, HYDE PARK ADDITION to the City of Little Rock, Arkansas; all three strips of land running vast and west between Monroe Str,et and Boulevard Avenue; is 50 feet wide dedicated to the Public use as a street and each of the other two strips 10 feet wide and dedicated to the public use as an easement for utilities, by Frank Biniores and Dora Bil4ires, owners of all of the lots and I blob s in BINIORES t SUBDIVISION of lot 8, block 2, HYDE PARK ADDITION to the City of Litt &e Rock, Arkansaq# The location of these strips of land. dedieateA to .public use are as shawn in the Pte. and gill of Assurance recodded by said owners in Book #45y`at pages 56 -58 of the Deedts Records of Pulaski County, Arkansas, . on March 29 1951. Whereas, after due notice as required by law, the Council ?gas., at the time and place mentioned in said notice, heard all persons desiring to be heard on the question and has ascertd ned that the strips of land hereinabove described have heretofore been dedicated to the public as a street and a utility easements;" i that said strips of land so dedicated have never been used by the publi -o since the dedication thereof; that Frank Biniores and sera Biniores are the owners of all of the property abutting upon said strips of land to be vacated .and have filed with the Council their written consent to such an abandoment; and that the public interest and weXfare will not be adversely affected by the abandomnent of said strips of land for public use. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Sectionl. The City of Little Rock, Arkansas, hereby e releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the following described strips of land heretofore dedicated for use as a street and easements for public utilities by the Bill of .Assurance, dated March 2, 1951, 5 pages 6- of the Deed Records Pulaski and recozided in Book #455 at 5? of County, Arkansas: A strip of land 50 feet wide running east and west between Monroe Street and BpultVard Avenue dedicated to public use as West 23rd Street on Plat and Bill of Assurance= Two strips of land 10 feet wide running east and west k between Monroe Street and Boulevard Avenue dedicatli to public use of public utilities as shown on Plat and Bill of Assurance; and all three . strips of land lying wholly within the bourAeries of BINIORES' SUBDIVISION of Lot 8, Block 2, HYDE PARK ADDITION to the City of Littbe Rock, Arkansas. Section 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the, = Re,6o3 der -' of Pulaski County, Arkansas, Section 3.
